Elizabeth married Capt. James BABCOCK, son of John BABCOCK and Mary LAWTON, about 1687. James was born 1663 in Westerly, Kings Co., Rhode Island. He died 17 Jan 1736/1737 in Westerly, Kings Co., Rhode Island and was buried in Babcock Burying Ground, Massatuxet, Kings Co., Rhode Island.

    Born in Westerly, Rhode Island about 1663 and died there 17 Jan 1736-7. He being the eldest son, received all his father's real estate, half of which he deeded and contracted to his mother, June 26, 1685. In April, 1686, he was made a freeman at Westerly, and on March 28, 1692, he was voted one hundred acres of land. He united with the Seventh Day Baptist Church of Newport and Westerly in 1692, and when the Westerly branch (now the First Seventh Day Baptist Church of Hopkinton) became an independent body in 1708, he was a constituent member. He continued a member to the time of his death, and bequeathed to it one hundred pounds in money. Prior to 1690 he was commissioned Captain of Militia in Westerly, Rhode Island. On April 1, 1698, twenty days before his mother married Erasmus Babbit, his brothers Elihu, Robert, Joseph and Oliver, chose him to serve as their guardian. He served for many years as town treasurer, was town councilman, was often moderator at town meetings, and for many years he represented Westerly in the Legislature of the Colony of Rhode Island, held at Newport.
    Capt James Babcock's last will, written January 9, 1736/7, eight days before his death, was entered for probate January 31, 17376/7. By his will he gave to his children and grandchildren eight or ten farms, comprising some two thousand acres of land, each farm carefully bonded. He provided that his infant son, James should receive a college education, and also that in case his wife should marry again the three younger children should be taken from her and brought up by his executor, heir half-brother Joshua.
    Captain James Babcock married 1st about 1687, one tradition says Elizabeth Saunders, daughter of Tobias, while another says Elizabeth Babbitt, daughter of Erasmus. James Babcock was married 2nd in Westerly by Theodoty Rhodes, Justice, July 7, 1731, to Content Maxson, who was born at Westerly, Jan 28, 1709, eldest child of Jonathan and Content (Rogers) Maxson. She married 2nd Dec. 22, 1742 William Hiscox (widower), son of Thomas and Bethia (Clark) Hiscox, by whom she had four children.

    James-3 Babcock, better known as Capt. James, eldest child of John and Mary (Lawton) Babcock (James-1), born Westerly, RI, 1663 (?); died there Jan. 17, 1736-7. He was buried in the Babcock burying ground at Massatuxet, which is upon the east side of the road, about midway between Westerly and Watch Hill. His grave is covered by a horizontal tablet, six feet long and four feet wide, and is about three feet above the surface of the ground. The inscription upon the tablet is as follows: "In memory of Capt. James Babcock, who died January ye 17th, 1736, in ye   year of his age. Having been in his life of extensive charity and beneficence and not wholly silent at his death." The year of his age has been, by time or vandalism, completely obliterated.
    John Babcock, father of Capt. James, when eighteen years of age, went, March 1662, to Westerly with the first company of permanent settlers.
    Tradition says that James was the first white male child born in Misquamicut (Westerly). Presuming this to be true James was no doubt born in 1662 or 1663.
    June 22, 1731 (fifteen days before his second marriage), he signed a "Covenant made and contracted between Capt. James Babcock of Westerly yoeman, and Content Maxson daughter to Jona. Maxson," viz.; "I ye sd, Babcock do hereby convenant with sd. Content that on condition shee doth take me as her husband and doth outlive me I do oblige my heirs to pay her within 3 years after my deceased 100 pounds currant Money in Lieu of her right to her thirds. -- On these terms Content is willing and satisfied to be married." (Westerly Town Records, 1719, p. 26).
    Capt. James, being the eldest son, was by the English law of primogeniture heir to all the real estate of his father. "With a devotion to his mother worthy of all praise." he surrendered to his "loving and natural mmother, Mary Babcock." one half of all the real estate left by his father, "to have and enjoy and to dispose of as she shall see it meet during the time of her life or after her decease, provided she shall dispose of it unto my father's male children." The contract was dated June 26, 1685. (Westerly Town Records, Book i, p. 65)
    In public records he is often referred to as "James, the widow's son".
    In 1692 the town council voted 100 acres of and to each of twenty-five citizens, among whom were James and Job Babcock. In that year he united with the Seventh Day Baptist Church and continued a member until his death, when he willed 100 pounds to the church. His title and rank of Captain came from his being commissioned Captain of Militia in Westerly, prior to 1690. When their mother remarried, the four youngest brothers chose James as their guardian. He later deeded some parcels of land to his younger brothers, "for brotherly love".
    For many years Capt. James was Town Treasurer, Town Councilman, and often Moderator at town meetings, and represented Westerly in the Legislature of the Colony of Rhode Island, held at Newport. In 1717 he was Justice of the Peace for Westerly.
    By his will he gave to his children and grandchildren eight or ten farms, comprising some two thousand acres of land. He provided that his infant son James should receive a college education. The family burying ground is reserved from his farm. It has been said of Captain James Babcock that he was a good as he was rich, a true philanthropist who lived for God and his fellow men.

    2. William-2 Crumb (Daniel-1), of Westerly, RI and Hopkinton, RI, son of Daniel and Rachel (Roberts) Crumb, was born between Aug. 1677 and March 1678, died in Hopkinton in 1746. He married first, about 1698, Mercy (daughter of Tobias Saunders) died before 1736, and he married secondly, April 25, 1736 (by Elder John Maxson, J.P.) Hannah Lewis, bapt. 1703, youngest daughter of Daniel Lewis.
    Reckoning from the time of his father's second marriage and from his admission as a freeman, William was born between Aug. 1677 and March 1678. At a town meeting held at Roger Larkin's house March 4, 1699, he was made freeman of the Colony. In 1710-11, he was a purchaser in the "Lewis and Maxson Purchase" in Hopkinton and was called "William Crumb of Hopkinton."

     8. Jemina-3 Crumb (Wm.-2, Dan.-1), daughter of William and Mercy (Saunders) Srumb, was born in Westerly in 1706. She married John Burler, probably son of Samuel. Her father's will mentions her as Jemina "Button." This is thought to be a mistake in writing.
    1747, Jemina's father sold land in Voluntown to John Butler, and the same year brought land of John Butler. John and wife, Jemina, moved to Beekman's precinet, Dutchess Co., NY prior to 1765. Jemina and her son, Truelove, later settled in Glen Falls, New York.
