HIRST FILES ETHICS COMPLAINT AGAINST FELLOW COUNCILOR

     HOPKINTON - Town Council Vice-president Scott Bill Hirst has filed an ethics complaint against fellow councilor Marilyn Grant after Grant took part in a vote to appoint her husband to the Planning Board.
     Three town councilors - including Hirst, Grant and E. Robert Corrigan -- were present for the July 15 vote. The council voted 2-1 to appoint Grant's husband, Malcolm Grant, and Howard Walker to the board.
     Hirst said the vote by Grant could constitute a conflict of interest.
     "Mrs. Grant seconded the motion to appoint her husband and voted for the appointment," Hirst said in his hand-written complaint to the state ethics commission, dated July 16.
     Town Solicitor F. Thomas Lenihan said he reviewed the code of ethics and found no basis for a conflict of interest, in his opinion.
     "There's no monetary value or gain associated with appointment to the Planning Board," he said.
     Hirst voted against both appointments, even though he said he saw no conflict or possible conflict in the appointment of Walker.
     "I think there are other candidates out there who deserve consideration," he said at the time.
     Hirst said nothing about Grant's vote or a possible conflict of interest at Monday's meeting. He presided over the meeting in the absence of President Jill Matson.
     The appointment of Grant to the Planning Board "was the only one that needed a vote from a family member to be made," Hirst wrote in the complaint.
     He also charged that Planning Board alternates Ronald Reposa and Kenneth Mott were "passed over" for full board appointments.
     "Also other candidates included a woman and man who served a number of years on the Zoning Board," Hirst said.
