George Nyleve's Will

The will is dated 16 June 1840, though the testator says he is leaving London the next day, Wednesday 16 June.     As 16 June 1840 was a Tuesday, he presumably meant that he was leaving London on Wednesday 17 June 1840.

Certain words have been verified by other sources. E.G. Mary Romane's surname is written as Romayne in the death duty record IR26/1653, folio 354; and the attornies holding John Evelyn's papers are listed in the Post Office Law Directory (held with the 1841 Census street indexes in the FRC), as (according to notes rather than a transcription) Whitmore, Roumieu & Walters (Robert Whitmore, John Roumieu, & John Eldad Walters) 9 New sq., Linc. inn

I George Nyleve by the Grace of God being at this instant of time in my sound mind and judgment do will authorise and appoint Matilda Gatrill the charge of all my good and chattles in my absence at this time (to wit) as I am leaving town tomorrow morning Wednesday the sixteenth of June 1840 and in case of my death I leave to my wife Elizabeth (whose maiden name was Elbth Brown) five shillings I leave to my daughter Kezia one pound I leave to Matilda Gatrill one third of my freehold and leasehold property I leave to my daughter Mary Mary Romane the other two thirds and all my goods and chattles to be equally divided between my daughter Mary and Matild Gatrill and also appoint her Matilda my Executerix and Edward Cross Esqr my Executor if he will undertake it I request no expensive funeral  The freehold and leasehold writings of my property in Sidmouth Devonshire are in the possession of Messrs. Whitmore Roumieu and Walter Esqrs. Attornies at Law No nine Lincolns Inn among the documents of the late John Evelyn Esqr. of Wotton in Surrey who died in the year of our Lord 1827.

7th June 1843

Appeared Personally Thomas Ogden of Harveys Buildings in the County of Middlesex Messenger in the Office of the Solicitor to the Stamp and Taxes Mary Ogden (wife of the said Thomas Ogden) of the same place and Elizabeth Ogden of the same place Spinster and made oath that they knew and were well acquainted with and are the subscribed witnesses to the last Will and Testament of the said George Nyleve late of Amelia Place Walworth in the parish of Saint Mary Newington in the County of Surry deceased bearing date the sixteenth day of June in the year one thousand eight hundred and forty and now hereto annexed And they further say that the said testator formerly resided in the house of the appearer the said Thomas Ogden and on the sixteenth day of June one thousand eight hundred and forty aforesaid the deceased requested the appearers to witness the execution of his said will which he then produced to them being the paper writing now hereunto annexed and written on two sides of half a sheet of paper the same beginning thus 'I George Nyleve by the Grace of God' ending thus 'As witness my hand this 16 day of June 1840' and thus subscribed 'George Nyleve' and they further say that the whole of the said will beginning ending and subscribed as aforesaid is as they verily believe in the handwriting of the testator And they further say that the said testator at such time vizt on the sixteenth day of June one thousand eight hundred and forty aforesaid being the day the same bears date duly executed his said will by signing the name "George Nyleve" at the foot or end of the second or last side thereof in the presence of these appearers all of whom were present at the same time and the appearers accordingly set and subscribed their names as witnesses to the due execution thereof in the presence of the said testator in the manner and form the same now appear And they further made oath that having now carefully viewed and inspected the said will or paper writing as now hereto annexed they have no doubt but verily believe the whole thereof as contained on the two sides of the said paper were so written by the said testator and signed by him as well on the first as on the second sides thereof on the said sixteenth day of June one thousand eight hundred and forty aforesaid the said signature in the second side being made they are certain in their presence as aforesaid but whether the signature on the first side was so made in their presence or only acknowledged they are not enabled with certainty to depose but they positively make oath that the said will is now in all respects in the same plight and condition as when executed by the said deceased on the same day in manner aforesaid and hath not since received any manner of alteration or addition whatever - Thos Ogden - Mary Ogden - Elizabeth Ogden - Same day the said Thomas Ogden Mary Ogden and Elizabeth Ogden were duly sworn to the truth of this Affidavit Before me - John Danberry Suro - Prest - Richd Addams Jr Not. Proved at London 12th June 1843 before the worshipful John Danberry Doctor of Laws and Surrogate by the oath of Matilda Gatrill Spinster one of the Executors to whom Admon was granted having been first sworn duly to administer power reserved of making the like grant to Edward Cross Esquire the other Executor when he shall apply for the same.
