"(said to be) Daniel Gaines, d. Rappahannock Co. between 18 Aug. 1682 & 1 Oct. 1684 (his will mentions no daughter Elizabeth) (said to be) Margaret (poss. Bernard), d. post 1686, m. (2) John Daingerfield. Will 18 Aug 1682, Essex Co. Va mentions wife Margaret and orphans of Col. Jno. Catlett to be paid our of the negroes who belong to his estate, and calls Jno. Catlett his kinsman, and direct that children of Col. Jno. Catlett to remain with my wife until they come of age or until she marries.


In 1671, Mrs. Eliz Catlett, widow of Col. Jno. gave power of attney to Mr. Dan'l Gaines and also later made him overseer of her will and to have main charge of the children, 1673.


Daniel Gaines married Margaret Bernard and had (1) Elizabeth (2) Bernard, (3) Margaret (who married Ralph Rowzee (4) Mary (who married John Smith.)


Elizabeth, daughter of Daniel Gaines and Margaret Bernard Gaines, married John Catlett, Jr., and had Rebecca Catlett who married Francis Conway and they were parents of Eleanor Rose Conway, who married James Madison and had James Madison, second President of the United States.


Captain Daniel Gaines was born about 1623 in England, died about 1683. He made his will in Sittingbourne, Parish, Rappahannock--now Richmond County, Virginia, which was probated 16 October 1684. He was Captain in Virginia Militia in 1680. (See Virginia Colonial Militia, by William Armstrong Crozier (1651-1776). His four children by Margaret Bernard: (1) Elizabeth; (2) Bernard; (3) Margaret; (4) Mary, are mentioned above. BERNARD GAINES married Martha Taylor (as above mentioned), daughter of Col. George Taylor and his first wife, Martha Tomlin. In the will of Colonel George Taylor, probated in Rappahannock Co.--now Richmond Co., Virginia, he mentioned, besides his second wife, Susanah (will probated 7 August 1706), as his legatees, his daughter, Martha Taylor Gaines; her youngest son George Gaines, and her oldest son, Daniel Gaines. To the orphans of Col. John Catlett , decd.; son Bernard ; daughters Margaret and Mary ; grandson-in-law John Smith ; Ralph Rouzey ; wife Margaret executrix; witnesses William Murrow , John Catlett , William Browne."


"His will, made 8/18/1682, proved 10/16/1684 in Old Rappahannock Co., Virginia names his wife-Margaret Rowzee, children as his son-in-laws (step Children).
He was first, Justice of the Peace in Old Rappahannock Co., Virginia and was a Captain in the local militia. He was reputed to have been born in Virginia, educated in England and returned to to the Rappahannock river area in 1656. The year of his birth is problematical. If the year of his birth had been documented it would have solved many of the problems arising from his will and issue.
Various sources have his year of birth at great variances such as 1600, 1620, 1625, 1630, and 1640.
The Will of Daniel Gaines
In the name of God, amen. I Daniel Gaines of the Parish of Sittenburne, in the county of Rappa, being in good health of body and of sound and perfect memory praise be therefore given to almighty God do make and ordaine this my last will and testament in manner and forme following. That is to say, first and principally, I, command my soul into the hands of Almighty God hoping through the merits of death and passion of my Savior Jesus Christ to have full and free pardon and forgiveness of all my sins and inherit everlasting life, and my body I commit to the earth to be decently buried at the discretion of the Exeutrix hereafter named, and as touching the disposition of all such world estate as it hath pleased God to bestow upon me, I give and dispose thereof as followeth:
Imprimis.
It is my will that all my just debts that I justly owe to any man may be well and truely paid and in the first place that the orphans of Colonel John Catlett, decd. to be paid out of the negroes and other good that did belong to the said John Catlett's estate, the negroes and goods to be paid as they were appraised to me as may appear by inventory.
Item. I give and bequeath unto my son, Bernard, all my land that I now live upon to him and his heirs lawfully begotten and that he shall not let, sell or mortgage any part or parcell of the same as long as his two sisters, Margaret and Mary, or their heirs be alive. It is my will that if all of my children die without heirs of their bodys then my land to fall to my grandson, John Smyth, and to his heirs forever.
Item. I give to my daughter, Mary, the mare colt that now sucks on my mare Betty and all her increase to her and her heirs forever.
Item. It is my will that the mare, heyfer, and hogs that I have given to my grandson-in-law, John Smyth be and remain to his proper use forever.
Item. It ismy will that the first living child that my negro Cate doth bring to be given to my daughter Margaret and to her heirs forever and if it lives to the age of three years to be in lieu of a man servant otherwise to be in no stead.
Item. I do give to my son Bernard my silver hilted sword and belt and my seale ring.
Item. I give unto my dear and loving wife Margaret one third of my estate in lieu of her dower.
Item. My will is that the other two parts of my estate be divided between my three children, Bernard, Margaret and Mary and no part of it to be appraised but to be inventoried and delivered in kind.
Item. It is my will that my daughter Margaret have a good feather bed and furniture at my death in full of her part of my bedding.
Item.It is my will that my daughter Mary have the use of so much housing and land as she needs so long as she continues unmarried.
Item. It is my will athat as soon as it can a man servant be bought with tobacco for my dauthter in part of her portion.
Item. It is my will that my wife, son Bernard and daughter Mary keep their shares together for their menteynance doing their best by endeavors to increase the same, as longe as my wife continues a widow or so longe as either of my children continue unmarried and at the day of marriage of my wife or either of my children, then my children's part to be delivered the........."
