In the name of God amen, I John Pendleton of Christian County and State of Kentucky being of sound mind and disposing memory (for which I thank God) and calling to mind the uncertainty of human life and being desirous to dispose of all such worldly estate as it has pleased God to bless me with, I give and bequeath the same in manner following, that is to say,


1st I give to my son James M. Pendleton one negro boy named Henry one horse one cow and one bed and furniture to him and his heirs forever.
2nd I give to my son John T Pendleton one negro boy named Richard one horse one cow and one bed and furniture to him & his heirs forever.
3ly I give to my son William H Pendleton one negro boy named Robert, one horse one cow, and bed and furniture to him and his heirs forever.
4ly I give to my son Edmund W Pendleton, one negro boy named
Spencer one horse, one cow, one bed and furniture, to him and his heirs forever.
5ly I give to my son Cyrus N Pendleton one negro named George, one horse one cow one bed and furniture to him and his heirs forever.
6ly I give to my daughter Mary Pendleton one negro girl named Betsy with her future increase, one horse one cow, one bed and furniture (all of which she has received) to her and her heirs forever.
7ly I give to my daughter Frances A Garnett one negro girl named Haney with her future increase, one horse one cow, one bed and furniture (all of which she has received) to her and her heirs forever.

If any of the negroes named above should die before they come into the posession of the respective legatees then, in that event, it is my desire that such legatee have assigned to him or her another negro of as nearly the same value as may be selected by my widow or any two disinterested neighbors, to be held by said legatee as before provided
All the legacies before mentioned to be paid over to the several legatees as they arrive at the age of 21 or when they marry.
11ly All the remainder of my negroes, after the above named bequests together with all the personal property of every description whatsoever I give and bequeath to my wife during her natural life, to be used for the support of herself and children during the time they live with her, provided they continue as heretofore to promote the welfare of the family or estate.
12ly As it respects my landed estate I wish my wife to select one of the tracts as the place of her residence, and that of the unmarried children, and the other tract to be divided among all the children or if more profitable to the legatees to sell said land and divide the proceeds equally among all the children.
13ly At the death of my wife it is my will & desire that the whole of the estate entrusted to my wife during her life, both real and personal be equally divided amongst all my children, or sold if thought most advantageous, and the proceeds equally divided, the selling has reference to the land only, as to the negroes will admit of it. I should prefer them being valued by competent judges and then for each legatee to draw for his lot.


Lastly I do hereby constitute and appoint my son James M Pendleton and John T. Pendleton Executor of this my last will and testament hereby revoking all other or former wills or testaments by me heretofore made. And as I am not, nor do I expect to be largely indebted hereafter, and as I have the utmost confidence in the integrity of my Executors, I request the Court to permit them to qualify without giving security.
In witness whereof I have hereunto set my hand and affixed my seal the 14th day of November in the year 1837.

Philip Anthony (1754-1838), enlisted, 1775, from Rowan County, North Carolina; re-enlisted, 1776, until 1781, serving three months each year, and was in the battle of King's Mountain. He was placed on the pension roll, 1835, from Henderson County, Ky. He was born in Philadelphia; died in Henderson County.

"William G. Smoot, son of John and Lucy (Thornton) Smoot, was born 1826 in Madison County, Virginia. He accompanied his parents to Christian County, Kentucky, but after 1850 he settled in Calloway County, same state, where he was the head of a family at the 1880 census. He stated in that year that his father was born in Maryland. His wife was Susan C. Bennett, born 1828 in Kentucky. His household in 1880 consisted of, besides himself and wife, his son Jefferson D., born 1861; daughter Lucy E., born 1864; and his sister-in-law Elizabeth J. Bennett.
Living in Calloway County in 1880 was also C. M. Smoot, born 1852 in Kentucky, with a wife Maggie born 1856, and an unnamed infant aged two months."

"It is conjecture on my part that Elizabeth is the sister of Thomas Underwood. She was married 4 times. Her 2nd husband seemed to be a peer of her possible brother William in a 1656 Old Rapp. Co. deed. Her married names were Taylor, Slaughter, Catleet and Butler. (C-2394) It's her husband's will (Catlett) that definitely seems to connect her to likely sisters Mary and Margaret as their husbands are mentioned as brother-in-laws in his will."
