"Any doubt as to the fact that the James IRVINE of Nicholasville KY is the same person who is listed here is removed by his Revolutionary War pension application, which makes reference to sworn depositions by William Fullilove and Anthony Fullilove. William is his brother-in-law and Anthony is his nephew. Both men were residing in Madison Co. KY on the date of his application.


As to his marriage in Halifax Co. VA, the most likely explanation is that he was living with his brother, William IRVINE, at the time and so met his future wife. James was 36 when he married Miss Malone; we might infer therefore that this was a second marriage for him. We find in Halifax Co., in the 1785 tax list, a James Irvine who has a wife and a child. We might also look at a second James Irvine in the same tax list who has no wife and three children. It is unlikely that James, if he had three children to care for, would have waited six years before remarrying. As will be seen from what follows, a delay in finding a second wife was not in James' nature. Therefore the James who had a wife is most likely our subject.


We learn from his Revolutionary War pension file that he removed to Jessamine Co. KY shortly after 6 Oct 1797. A written statement bearing that date, signed by Joseph Yarbrough, Fredk. Nance, John Moon and Robertde Graffenreidt and executed in Lunenburg Co. VA attests to hisRevolutionary War service and states that he "is now about to remove to the State of Caintuckey [sic]."


The above paragraphs remove any possibility that James died at ValleyForge, a contention maintained in certain family histories.


James claimed considerable action during the Revolutionary War in his pension application, which was allowed by the federal government. His Compiled Service Record affirms his service in the 6th VA regiment, enlisting on 3 Feb 1776 in Capt. James Johnson's Company and honorably dischargedon 18 Feb 1778. This regiment was at Valley Forge with General Washington during the dreadful winter of 1777-1778. The muster rolls state that he was "sick in Philadelphia," without providing the dates of his illness. We may reasonably conclude that his illness was endured during the Valley Forge encampment.


James also claimed to have enlisted in the 14th VA beginning in 1778 fora three year term. His Compiled Service Record mentions no unit other than the 6th VA. It happens that the 14th VA was reorganized as the 10thVA in 1778 and James' pension file contains a note by the Department of the Interior, Bureau of Pensions, that it was their belief that James also had received a pension based upon a separate claim. The applicants in both files had stated a Virginia birth, service in one or more Infantry regiments and a 1797 migration to Jessamine Co. KY. The first application is numbered S36611; the second, S4422. It is with reliance on the first application that James' date of birth and marriage data is included in this document. Comments will follow on the reason for the existence of two pension applications.


Following his tour with the 14th (or 10th) VA Infantry, which he said had ended in 1780, one year short of his own declaration of a three year enlistment, James stated that he then enlisted in the Virginia militia. Bennett H.Young, who wrote a history of Jessame Co. KY, wrote in an inquiry to the Commissioner of Pensions on 26 Sep 1908 that it was his understanding that James had been shot during the battle of Guilford Courthouse in 1781. A sizeable contingent of Virginia militia were present at that battle. James made no statement regarding wounds that he had received during the course of his services.


In all, James asserted that he had served a total of seven years. He listed, as battles in which he had participated, Brandywine (11 Sep1777), Germantown (4 Oct 1777), Monmouth (27 Jun 1778), Stony Point (16Jul 1779) and Guilford Courthouse (15 Mar1781). It is certain that, given his extensive service, he saw considerably more action than heattested to in his application."
