Will of WILLIAM HARRIS, dated Oct. 26, 1788, proved Dec. 11, 1788 Albemarle County Will Book III, page 55:


"In the name of God Amen the 26th day of October anno domini 1788 I William Harris of the County of Albemarle and the Parish of St. ...... (unreadable) being in perfect Memory and Remembrance praised be to God for the same But weak in body I do make and Ordain this my last Will and Testament in manner and form following Viz First I bequeath my Soul unto the hands of Almighty God hoping that through the Victorious Death and Sufferings of my great Redeemer to Receive free pardon and forgiveness of all my sins and my body to the grave to be Buried at the Discretion of my Executors herein and after nominated as for my worldly goods with which the Almighty hath been pleased to Endow me with I give and bequeath in measure and form following Viz I give and bequeath


to my son MATTHEW HARRIS the land and plantation whereon he now lives with all the land that is my property on Rockfish River in Amherst County. I give


to my son BENJAMIN HARRIS the plantation whereon I now live with all the lands which I posess on the waters of Green Creek only a small part Joining the lands of Samuel Hensley and William Thurmond and bounded as followeth To Wit Beginning at a Red Oak on...... where the path crosses the Branch which lies Betwext my land known by the Name of the Red Oak Field and Jerusha Turner's old place and Running with my line to a corner in Hensley's line and with Hensley's line down the Creck (sic) to Thurmonds line and with his line to the Branch above mentioned and then up the said Branch to the first Station which land last mentioned I give and bequeath

my sons JOHN HARRIS and WILLIAM HARRIS and BENJAMIN HARRIS as my executors to execute this my Last Will and Testament My will is that my three sons John William and Benjamin above mentioned have the management of all my property which I left for the maintenance of my wife MARY HARRIS and all the profit arising therefrom which is over and above maintaining and supporting her at her own discretion is to be equally divided betwixt my said three sons JOHN WILLIAM and BENJAMIN and my will is that on the death of my wife MARY HARRIS that all the property that is now left to support her to be equally divided amongst all my children above mentioned as Witness my hand and Seal this the date above mentioned.

History of Albemarle County, in Virginia By Rev. Edgar Woods, p. 219:
"William Harris, in all likelihood a brother of Matthew, was long one of the early and leading citizens of Albemarle. His first patent was located on Beaverdam of Hardware in 1739. He also made entries on Totier and Green Creeks, until during the next forty years he possessed more than two thousand acres. He was evidently a man of fine judgement and great energy. He established on Green Creek one of the first mills erected in that part of the county, and it has ever since been an important centre to the surrounding country. In 1746, the year after the county was organized, he was appointed one of its magistrates. He died in 1788.


His wife was Mary Netherland, and his children, Matthew, Sarah, the wife of a Mosby, Elizabeth, the wife of John Digges, Catherine, the wife of a Steger, John, William, Mary, the wife of a Woodfolk, Benjamin, Ann, the wife of Hawes Coleman, and Judith, the wife of George Coleman. From this stem has sprung a greater number of families perhaps than from any other ever domiciled in the county."

Matthew's oldest son William was born between June, 1712 when his grandfather Robert Harris made his will, and 1715, the last year which would have allowed him to be 21 years old in 1736, therefore old enough to enter the bond recorded in York County in that year (Bk. 18: 324-325). He died in Albemarle County, Virginia in 1788 (Will Book 3:55) at about 75 years of age. The Harris Bible in the Virginia State Library says he was "upwards of 80 years old" as was his wife at her death.


William Harris married before 1736 Sarah Netherland (1719-1799), the daughter of John Netherland ( -1740) and Sarah Netherland ( -1745, see Deed Book 5:91 Goochland County). The Netherlands left James City and New Kent Counties to settle in Goochland and Powhatan Counties...


The map which accompanies the 1977 edition of Rose's Diary (Fall, ed.) shows William Harris's home south of Carter's Bridge not far from the Joshua Fry's home "Viewmont" (which William's son John Lee Harris late purchased). This may have been the location of William Harris's first house, built on the patent of 1739 which lay on Beaverdam of the Hardware River, however by 1745 he had built a mill on Green Creek. Today the site of the mill and the Harris graveyard are both located on the north side of Rte. 6, some 10-12 miles west of Scottsville, VA, the former county seat of Albemarle. The home of Benjamin Harris, William's youngest son to who he left his home plantation, is nearby. The foundation ruins of a large house are located directly across Rte 6 from the Harris graveyard. This is, without doubt, a house belonging to William Harris and may have been the home site.

Amherst Co. VA Will Book 7 Page 91 12/12/1827; 11/11/1826 In the name of God amen I Joseph Higginbotham of the (County) of Amherst and state of Virginia being in sound mind and memory for disposing of all my temporal concerns have thought proper to make this my last Will and Testament revoking and disannulling all others made by me or in my name. First of all I recommend my soul into the hands of God who gave it and my body to be buried in a Christian like manner.


Item 1st. It is my wish and desire that all of my just debts be paid.
Item 2nd. I give to my well beloved son James S. Higginbotham during his natural life and no longer all the land that I may have in my possession at my death except my right and title to part of a tract of land belonging to the estate of my brother Charles Higginbotham deceased; also one Negro man named Pleasants.
Item 3rd. I give to my said son James S. Higginbotham during his natural life and no longer all household and kitchen furniture except my feather beds and furniture.
Item 4th. I give to my said son James S. Higginbotham during his natural life and no longer my waggin and waggin gear; also I give to my said son during his natural life and no longer all my stock of horses, cattle and hogs and one half of my stock of sheep; also one half of all my Negroes exclusive of the one already mentioned.
Item 5th. It is my wish and desire that if my son James S. Higginbotham at his death should have a child or children lawfully begotten by him the foregoing property of every description left to my son James S. Higginbotham during his natural life should go to the said child or children lawfully begotten by son James S. Higginbotham forever.
Item 6th. It is my wish and desire in case my son James S. Higginbotham shall not leave a child or children lawfully begotten by him then and in that case the whole of the property of every description left to him during his natural life as above shall go to the children of my daughter Frances McDaniel viz Joseph McDaniel, Jms. McDaniel, Preston McDaniel and Mary McDaniel.
Item 7th. I give to my well beloved grandchildren of my beloved daughter Frances McDaniel one half of the Negroes I may dire possess of also all my right and title to my part of a tract of land belonging to the estate of my brother Charles Higginbotham deceased; also forty dollars to be paid to them out of my estate for the building of a house on a lot adjoining the lot whereon the Baptist meeting house now stands; also one half of my stock of sheep; also my feather beds and furniture except the best bed I have which I give to my granddaughter Mary McDaniel to them and their heirs forever.
I hereby acknowledge this to be my last Will and Testament revoking all others as heretofore mentioned and I do hereby appoint Thomas Higginbotham, my brother William Higginbotham and my son James S. Higginbotham Executors of this my last Will and Testament given under my hand and seal this 11th day of November 1826.

September 6th 1827. In order to do my son James S. Higginbotham ample justice in disposing of my estate I make this codicil to my last Will and Testament of the 11th November 1826 viz. I do hereby give to my son James S. Higginbotham a fee simple title to the tract of land he now lives on containing about 100 acres be the same more or less to him his heirs or assigns forever. I also give to my son James S. Higginbotham two boys by the name of Reuben and Zackeria to him and his heirs forever.
