WALTER BAYNE, GENTLEMAN (1616-1670)
Walter Bayne, Gentleman, was born in England before 1616 and arrived in the Province of Maryland in 1641 as a free adult, from Virginia. He immigrated to Virginia in the 1630s and came to St. Mary's County, Maryland to join his brother, Ralph. He served in the Assembly 1641/42 -1650/51; was Justice of St. Mary's County 1655-1658 and of Charles County 1660-1667. He received Patent for "Durham" in Charles County, consisting of 750 acres in 1661.


His children were:
1. Captain John Bayne, born before 1662, Charles County
2. Judith Bayne (sometimes referred to as Edith.)
3. Elizabeth Bayne
4. Eleanor Bayne, born 1662


Walter Bayne's will and his wife's are on record in the Register of Wills Office in Charles County. Walter's is dated April 12, 1670, probated May 28, 1670. Eleanor's is dated November 21, 1700, probated 1703. (SEE MARYLAND HALL OF RECORDS microform - COAGSERM 412 A2, i. CR49, 151-2 = This microfilm is rentable through interlibrary loan.)


Walter willed his entire estate consisting of approximately 2800 acres of land, stock of cattle and horses, servants and silverware to his wife and children; his son, John was to have his gold "seale" ring and a silver "boule" in addition to his share of the rest of the estate.


Charles County MD Land Records C.244 dated (Oct.1666) record the following:
JAMES TURNER, s/o Arthur Turner, dec'd chose WALTER BEANE as his guardian;


"Pyney Point", 1500 ac., surveyed 8/20/1649. Patented the same date for Ralph Bean. Bounding on the Potomac River and Herring Creek. Possessor: 750 ac., Hannah Harpam; 750 ac., Thomas Palmer (by his marriage with the widow Waughop.
The rent of this land is reserved in grain. (SMC Rent Rolls, 1639-1771).
NOTE: The widow Waughop is Catherine Countenceau, widow of Thomas Waughop (son of John and Joanna).
When Ralph Bean made his will, he devised all of his real estate to his brother, Walter Bean (aka Bayne). Walter apparently disposed of the property. At some point it was divided into two 750 acre parcels.

Walter, 29 Sep 1660; containing 500 acres with dwelling house, etc.; /s/ Walter Bayne, Martha Bayne; wit. Hickford Leman, John Rogers, Alexander Contee [The amount of tobacco and money paid for this 500 acres seems excessive in relation to other land transactions of the period, but that is what is recorded.]

A deed dated September 19, 1785 in Culpeper County (Deed Book N, pg. 17). "Deed by Stigler and wife to Reuben Garnett, of Culpeper Co., conveying 143 acres in Culpeper County. Witnessed by John Garnett, James Garnett, et als."

A deed dated January 30, 1789 in Culpeper County (Deed Book #P, pg. 61). "Deed by Anthony Garnett of Culpeper County to Edmund Willis, 545 acres land, beginning at corner to Reuben Garnett."


A deed dated December 21, 1793 in Culpeper County (Deed Book R, pg. 182). "Deed by Waugh and wife to Reuben Garnett, of Parish of St. Mark, Culpeper Co., conveying 150 acres in Culpeper County."


A deed dated March 3, 1794 from Culpeper County (Deed Book #U, pg. 334). "Deed by Anthony Garnett to Reuben Garnett, both of Culpeper Co., conveying the tract of land on which he (Reuben) now lives, "which I purchased of John Spotswood." "


This property, which came to be known as "Quiet Shade," was apparently adjacent to his father Anthony's "Horseshoe" plantation, but separate from it. There is (or was) a beautiful old house on the property, which was reported in 1937 by the Works Progress Administration of Virginia Historical Inventory, to have been built by Reuben's father Anthony in 1771. This seems unlikely, so it is not sure when the house was built. It would seem that it may well have been built by Reuben. Apparently he was living on it for some time before 1794. Either way, apparently Reuben lived there for the rest of his life, and the estate apparently passed on to his daughter Tabitha. The estate reportedly stayed in the Garnett family until about 1949, with the house still in good shape.


A deed dated October 16, 1800 in Culpeper County (Deed Book V, pg. 330). "Deed by Slaughter and wife to Reuben Garnett, all of Culpeper Co., conveying 182 acres."


There is apparently a notation in the margin of this deed book, "1835 March 10. Dld. Revd. James Garnett per verbal order."


From The Virginia Genealogist, Vol. 16, #4, pgs. 270-280, "Culpeper Co., VA, District of Aaron Lane, VA, 1800 Tax List":


"Garnett, Reubin: 3 white male, 9 horses owned, 8 slaves over 16, 3 slaves under 16"

Culpeper County Records, Deed Book AA, P. 250 (LDS microfilm #0030953). A deed dated October 18, 1804, Jeremiah and Sarah "Sally" (Willis) Ingram sell 3 parcels of land to Sally's uncle, Reuben Garnett for $5,304. The first parcel is 180 acres of land on which at the time they lived on and had originally purchased from Sally's grandfather Anthony Garnett. The second parcel of 245 acres, was originally purchased from Sally's uncle Reuben Willis. And the third parcel of 15 acres was originally purchased from Reuben Garnett.


Another deed, also dated October 18, 1804 in Culpeper County (Deed Book Z, pg 407). "Reuben Garnett and Mary his wife, to Geiman, use of Jeremiah Ingram and wife, to secure bonds given for three tracts of land, 442 acres, purchased Reuben Garnett of Jeremiah Ingram."

A deed dated December 18, 1816 in Culpeper County (Deed Book II, pg. 192). A tract comprising 176 3/4 acres was conveyed by Pierce Perry and wife to Reuben Garnett.


This tract came to be known as the "Spring Hill" plantation. It was located about 10 miles south of Culpeper, VA, on Highway 15. It was originally conveyed to Pierce Perry and his wife from Philip Slaughter in a deed dated April 20, 1813 (Deed Book FF, pg. 472). The house was described as not a mansion but a "roomy old plantation home," and was apparently built before 1813. The plantation took it's name from a spring at the foot of a little hill an which the house stands.


In 1816 Reuben's daughter Elizabeth Garnett, married James Garnett II, son of Edmund Garnett. "Spring Hill" was reported to have been a wedding gift to them from Reuben and they established their home there.

Reubin Garnett; 1 white male 16-25 years, 1 white male 45 years or older (Reuben); 1 white female 26-44 years, 1 white female 45 years or older (Mary); 11 persons engaged in agriculture; 9 male slaves under 14 years, 5 males slaves 14-25 years, 5 male slaves 26-44 years, 1 male slave 45 years or older; 1 female slave 14-25 years, 3 female 26-44 years, 2 females 45 year or older


The will of Reuben Garnett, dated April 10, 1838 and probated August 8, 1839 (Will Book O, pgs. 444-447) contains the following provisions:


He mentions wife Mary Garnett, daughter Tabitha Garnett, daughter Ann Willis, son William Garnett, daughter Elizabeth Garnett, who is the wife of Rev. James Garnett II.


"Item Eight. I give to my daughter Elizabeth Garnett, wife of Rev. James Garnett, the tract of land on which they reside, purchased of Pierce Perry, to be held by them during their life and at their death to descend to their children."


This apparently formalized the conveyance of the "Spring Hill" plantation, given as a wedding gift to Elizabeth and James 22 years earlier.


"Item tenth. Whereas my son James Garnett left the County of Culpepper several years ago and it is reported that he went to the State of OH years ago. It is further reported that he married, that he has since died, and that he hath left children of his still living I hereby give and bequeath to each such child one dollar and it is my further will that his children (if any such be) shall not inherit or receive any part of my estate except the One Dollar herein devised to them."


The will also recites, "...that the testor's son, Larkin Garnett, recently departed this life leaving widow and a large family of helpless children, therefore he bequeathed to children of Larkin Garnett the land in his possession at the time of his death, with dower right to his widow. Personal Property no otherwise bequeathed to be sold by his executors and divided equally among his children, Larkin Garnett's children to have one share."


Reuben's grandsons Robert Willis and John Garnett were appointed executors and the will was witness by William Slaughter, William Garnett, and Reuben Garnett Jr."
