John Campbell (1811-1889)


John Campbell was born in Georgia on June 24, 1811. He was admitted to the bar in Georgia at 17 years of age, in 1828. Two years later, he moved to Alabama to practice law, where he was lauded an an excellent advocate. A seat on the Court opened after the death in 1852 of John McKinley, also from Alabama. That was a presidential election year, and Millard Fillmore, a lame duck, was unable to gain Senate approval of any his three nominees to the seat. After the inauguration of Franklin Pierce in March 1853, some members of the Supreme Court urged him to nominate Campbell, who was an experience Supreme Court advocate. Campbell was just 41 years old, although he had been practicing law for over 20 years. As a southerner, Campbell supported the institution of slavery, and in 1857 wrote a strong opinion in Dred Scott asserting the claim that the Constitution was a compact among the states.


This consequence of the "compact" theory of the Constitution was that states possessed the power to leave the Union. When Alabama seceded from the Union in April 1861, Campbell resigned from the Court and returned to the state. He served in the Confederate executive branch, and after the war was imprisoned for several months. After Campbell was released from prison, he moved to New Orleans, Louisiana and practiced law. He was the lawyer for the butchers in 1873 in the Slaughterhouse Cases. Although his clients lost, the Court borrowed his arguments in the late 1890s when it began to strike down state laws on substantive due process grounds.

"The life of John Archibald Campbell reflects nearly every major development of 19th-century American history. He participated either directly or indirectly in events ranging from the Indian removal process of the 1830s, to sectionalism and the Civil War, to Reconstruction and redemption. Although not a defender of slavery, he feared that abrupt abolition would produce severe economic and social dislocation. He urged southerners to reform their labor system and to prepare for the eventual abolition of slavery. In the early 1850s he proposed a series of reforms to strengthen slave families and to educate the slaves so as to prepare them for assimilation into society as productive citizens. These views distinguished him from many southerners who steadfastly maintained the sanctity of the peculiar institution. In this first full biography of Campbell, Saunders reveals the prevalence of anti-secession views prior to the Civil War and covers both the judicial aspects and political history of this crucial period in southern history."

To no one memory of those days do I turn now, with kindlier feeling, than to that of handsome and original Mary Ellen Campbell, who was one of my chosen friends."

WHEAT, John b. 1674 d. 17 MAR 1711 Born Piscattaway Parish, Prince Georges Co., MD and died in Prince George's Co., MD. Married 1st Rachel WILLIAMS. Married 2nd 1699 to Sarah ___ b. 1678 Prince Georges Co., MD d. 1766. Sarah married Jeremiah PERDUE after his death.


John enlisted in the military ("her majesty's service) on 10 OCT 1710, serving in Major Gilbert ABBOT's Company at Annapolis Royal. He died while encamped in Canada on 17 MAR 1711. Troops had been raised by offering a coat worth 30 shillings, one month's wages in advance, freedom from impressment for 3 years, and firearms as royal gifts.


(1) Some say Sarah's maiden name was PERDUE and that Jeremiah was her relative who assumed responsibility for raising John's children. Jeremiah's will dated 5 JUN 1758 was witnessed by Francis, William, and John WHEAT, Jr.


(2) John's death was recorded on 8 AUG 1711. He left 40 to his wife Sarah. On 12 JUN 1712 Jeremiah PERDUE assumed the accounts of John WHEAT.(3)


"enlisted in her Majesty's Service, 10 October 1710, and served in Major Gilbert Abbot's company at Annapolis Royal. Died, 17 March 1711, after 158 days service."
