"Other evidence offered by Abner Williams referred to an act of the Virginia Legislature passed 15 Feb 1812 relinquishing claim to Alexander Whitely's estate. The text was as follows: Chap.CIII, page 127, An Act releasing the commonwealth's claim to the estate of which Alexander Whiteley died seized. (Passed February 15, 1812)
1. Be it enacted by the General Assembly, That all the estate, both real & personal, of which a certain Alexander Whitely died seized, and which is supposed to be escheatable to the commonwealth, shall be, and the same is hereby vested in the hands of Francis, John and Charles Whitely, and Anne Skillman, formerly Anne Whitely, who are the brothers and sister, by half blood, of the said Alexander Whitely; to be distributed among them in such a manner as the same would have been if devised to the jointly by will; reserving nevertheless, to all persons, other than the commonwealth, any right or claim, which they might, or would have had, in, to the said estate, or any part thereof, if this act had not been made.
2, This act shall be in force from the passing thereof".
"To my regret, this Act does not mention my ancestor #1.1.3 William Whitely. However, in Loudoun Co, the Court Order Book shows an entry on 13 Mar 1809, for a suit in a debt case; "William Whitely assignee for Isaac Skillman vs Abner William Adm of Alexander Whitely Dcd - Deft." The plaintiff recovered 67 dollars from the estate. (As indicated earlier, Isaac Skillman had married Nancy (Anne) Whitely)".


"Mildred's daughter Cynthia Taylor brought suit to claim part of the estate of her half-brother Alexander. This suit was brought by Cynthia Compton, alias Taylor, and her husband Hanson Humphreys to recover her part of the estate of Alexander Whitely, deceased, her alleged half brother. Alexander had died intestate early in 1808 and Abner Williams was appointed Administrator of his estate. Inventory of his estate showed bonds totaling about $1862".


Alexander Whitely, deceased Loudoun Co, Virginia, Chancery Court Case # 479, Aug. 15, 1833: The deposition of Walter Powers taken at the office of xxxx in Leesburg on the 15th day of August 1833 persuant to the enclosed motion to be read as evidence in the suit now xxxx in the Circuit Superior Court of Law and Chancery for the County of Loudoun in which Hanson Humphreys & Catherine Humphreys as Plaintiffs and Abner William adm. of Alexander
Whitely dec' and others as defendants the deposed being first sworn deposeth and saith, as follows:


1. Quest by Plttfs Council. Were you acquainted with Alexander Whitely now decd'? late of Loudoun County?
Ans. I was when a boy and up to manhood.
2. Q. by same. Whose son was he?
Ans. He was, as I understood, the son of William Whitely, by a Mildred Compton, or some such name, as well as I now recollect the name, but does not recollect positively that that was her name.
3. Q. by same. Has this woman any other Children?
Ans. She had three others, one daughter & two sons.
4. Q. by same. What was the daughters name:
Ans. Her name was Scyntha, the sons names John and Craven.
5. Q. by same. Who did she marry?
Ans. Hanson Humphreys
6. Q. by same. Do you know whether or not the sons are living?
Ans. I do not know Craven I understood died before he came of age; the last time I heard from John he was living.
7. Q. by same. Has it not been reported and generally believed for the last fifteen years at least, that Craven was dead?
Ans. Yes, and for a longer time than that.
Question by Defs. Council
Which was the elder? year on Alexander Whitely?
Ans. Alexander Whitely was some few years older than I was, I am now
about 60 years old.
2. Q. by same. Where did these persons reside at the time you have
mentioned in your deposition?
Ans. On the land which is now called the Oatland farm and in the immediate neighborhood of it.
3. Q. by same. Where was Hanson Humphreys married and by whom?
Ans. I am not now prepared to say, for I do not now recollect. I was frequently with them during their Courtship and after their marriage.
3. Q. by same. Do you know of your own knowledge that they ever were married.
Ans. I do not, I only know it from hearsay and from circumstances in the way I know of all other marriages.
4. Q. by same. How long has it been since you heard John was alive? Do you think it has been 20 years or more?
Ans. I think it has - I am certain it has been more.
8. Q. by Pltffs Council. What was the circumstances which xxxx you to believe they were married?
Ans. There was a family connection, one of my sister married a half brother of Synthia Comptons, and there was a considerable intimacy and we were near neighbors, they were reported to be married & lived as man and wife.
5. Q. by Defts council. how many half brothers & sisters had Scyntha Compton?
Ans. She had five and they all married and had children.
6. Q by same. Had William Whitely, the father of Alexander any other children, if so, how many and by whom?
Ans. He had five or six by Suckey Tyler, and then married her and had another.
9. Q. by Pltffs. Council. Who was the reported father of Scyntha Compton?
Ans. George Taylor.
10. Q. by same. Who was the father of the five half brothers and sisters of Scynthia Compton's above spoken of ?
Ans. George Taylor.
11. Q. by same. Who was the mother of the five?
Ans. the lawful wife of George Taylor.
12. Q. by Defts. Counsil. How long has it been since Hanson Humphreys moved away from theis Country?
Ans. About 35 years or more.
and further saith not Walter Power
Walter power claims .... 53 cents

The foregoing deposition of Walter Power was taken subscribed and sworn at the time and place set forth in the Caption. Signature unreadable"
Virginia Legislature Act in 1812 which allowed Alexander Whitely's estate to go to his half brothers & sisters.


Alexander died and Cynthia Compton (Taylor) and her husband Hanson Humphrey sued to recover part of the estate of Alexander Whitely, her alleged half brother. (Loudoun County Chancery Court records, Suit #M479--Humphrey vs Abner Williams) George Taylor acknowledged his three children by Mildred in his will, one of them Cynthia".
