JOHN, b. about 1632 (deposed 8 March 1705/6 aged "about seventy-four years" [MD 5:46, citing PLR 7:35]); m. (1) by about 1656 Rebecca Simonson, daughter of MOSES SIMONSON (estimated b. of eldest child [MF 3:7]); m. (2) by 1679 Esther (Delano) Samson, daughter of PHILIP DELANO and widow of Samuel Samson [TAG 15:165-67; TG 1:233; MF 3:7].


John, b., say about 1632, married 1st by about 1656, Rebecca Simonson. Married 2nd Esther ( ) Samson, widow of Samuel.


"This John Soule died (???), 1707, aged 75 years. She died Sept. 12, 1733, aged 95 years. Their gravestones are standing in the old Duxbury cemetery, leaning and weather-beaten.


John Soule became a Freeman in 1653 and sometime during the same year he was involved in a quarrel with Kenelm Winslow for "speaking falsely and of scandalizing his daughter in carrying divers falce reports betwixt Josiah Standish and her." After various devices for delay, he was fined on the 8th June o10 and costs, in a suit of defamation for o200. During the excitement against the Quakers John Soule was fined for his interference upon their religious services 2d Oct., 1660. He was survcyor of highways in 1672; Grand-juryman, 1675-6-7-8 and 1683-4; arbitrator between Marshfield and Duxbury, 1698, involving land disputes; also a witness to the Indian deed of Bridgewater, dated 23d Dec., 1686; joined in a remonstrance, 1687, against increasing the salary of Rev. Ichabod Wiswell. He was also administrator of the estate of Samuel Chandler, 1683, and chosen guardian; and the same year was chosen guardian for John Simmons and Samuel Sampson, minors. He must have held the respect and confidence of his fellow-citizens in the maturity of his life.


His sons received their portion of his estate during his life-time; the daughters, on petition Mar. 5, 1707-8, were rewarded in an equal division of five lots of land, situated in Middleboro, which were appraised o17-5-0. His personal property was valued at o24-12-12. Among the items mentioned in the settlement of his estate was a library. a rare possession at that time. See account as given by the author under George Soule, his father. This was evidently the collection of "books" mentioned in the will of his father. There were ten children in this family; all but Joshua by his first wife.


Will: 3Deposition of John Soule.
"John Soule of Duxbury aged about seventy-four years: Testefieth and Sayeth yt upwards of forty years agoe (1665) he was with ye men that laid out the Garnet Marshes into lots, and at that time there was not any meadow or marsh land on ye Southerly Side of ye Stage beach between ye Sea wh'ch bore any grass, or not to ye quantity of a Cock, for several years, and that the first lot of Marsh land was laid on ye Northerly side of ye said Stage Beach, ye said being reputed to ye Southerly bounds of ye said lott." (Born 1631.)


The Oath of said John Soule taken 8th day of March, 1705.


Statement of John Soule's Estate.
"March 5, 1707. John Soule had settled all of his lands on his sons by deeds and none on his daughters, and now the heirs hand in a petition for their portion.
Sarah Soule had only one cow.
Rachel Soule and Rebecca Soule, nothing.
Adam Wright signs petition for his children, his wife having died.


Sarah Soule, John Cobb and Rachel Soule his wife, Rebecca Soule the wife of Edmond Weston, mutually agree to the parcels of land in Middleboro prized o.15-5-0 and the Cow Sarah had at 40 shillings, making o.19-5-0, which divided in three parts makes o.6-8-4 to each &C., &Co. (???) Equally divided."


Settlement of the Estate of John Soule.
The exact date of the death of John Soule, the son of George Soule the Pilgrim, is not known; but he died intestate and his widow, Hester (Nash) was appointed Administratrix Nov. 14, 1707. The Inventory following was taken at Duxbury, Mass., Dec. 3, 1707:

Proof of the Names of John Soule's Sons.
In the records of the settlement of the estate of John Soule, it was stated that he gave his sons their portion of his property during his lifetime, but the names were not recorded. By a careful examination of the Registry of Probate and the Registry of Deeds these names were discovered; and we subjoin sufficient abstracts to prove their names. As represented in a Family Record seen by the author these names were: Aaron, Benjamin, James, John, Joseph, Joshua, Josiah, Moses and Zachariah; the latter dying March 16, 1690-1.


On July 31, 1695, John Soule of Duxbury "for the natural affection which I bear unto my son Aaron Soule" I give him forty acres at Pudding Brook in Duxbury.


On July 24, 1697, John Soule of Duxbury "for the affection which I have unto my son John Soule of Middleboro" give unto him my one hundred acres in the Twenty-Six-Men's Purchase in Middleboro, being the 22d Lot of the last division of Upland in said Purchase.


On May 17, 1698, for o6-6 paid unto my son Benjamin Soule of Middleboro by my son James Soule of said town, sold him 25 acres in the Twenty-Six-Men's Purchase being the 15th Lot and Butteth upon ye Great River."
