"JAMES DRAKE: James Drake of Richmond Co, VA, b. in Devonshire, England 8 Mar. 1725 m./1 Sophia Valentine (b. 1725) m/2 Elizabeth Hartwell of Isle of Wright Co, VA, later of Southampton Co, VA. He rem. to Bertie County, NC, and then to Edgecombe Co, probably before 1750 but was defintely there 20 Feb. 1751 when he witnessed a land deed for Samuel Bridges who bought 427 acres of land on Swift Creek in Edgecombe Parrish, adjoining Drake's line. He also surveyed the said land. James bought 250 acres of land in Nash Co, NC 20 Apr. 1778, the same day as Matthew Drake purchased his. James Drake died, 9 July 1791. Inventory of his estate was taken 4 May 1792 and included seventeen negroes."

"The name John Drake (presumably his) appears among six Drake signers (including two other Johns) on an Isle of Wight petition dated 22 may 1723. In 1725 he purchased land in Bertie Precinct, N.C., from John Tiney, adjacent to the land of one Thomas Drake, who appears to be his brother. On 5 January 1728/29 young John drafted his will, naming his father-in-law as executor of his estate. The one child provided for in his will was James.


That John Drake of Bertie Co. had a son named James is proven by his Will. John's son James should have been a minor at the time of John's death, at least if he was the James who m. Sophia Valentine, (I believe the Will also identifies John's son James as a minor at the time of execution of the Will) but, interestingly, no one has found any guardianship proceedings or guardian bond for John's son James. James Drake of Edgecombe and Nash County, NC was a son of John Drake (often referred to has John Jr. to distinguish him from his supposed uncle John, brother to Thomas Drake(son of Richard and Thomazine Drake) James was married a second time to Hartwell Hodges Davis, widow of Thomas Davis. Hartwell was a daughter of Benjamin Hodges. Their son was John Hodges Drake"

As a resident of Nash County (cut from Edgecombe in 1777), he won a place in Wheeler's Historical Sketches of North Carolina for his role in a Revolutionary War skirmish. James Drake lived in that part of Nash that was formerly Edgecombe and died while in Richmond on a business trip. What sort of urgent business could have taken him, an old and ill man, to Richmond is still unknown. His will was probated in Nash County 1770.
John Hill Wheeler's account of James Drake's skirmish with the Tories is told in Historical Sketches of North Carolina:
"ATTACK OF TORIES ON JAMES DRAKE, AND GALLANT CONDUCT OF HIS SON --SOOTHING EFFECT OF ONE OF THE GREAT STAPLES OF NASH


During the Revolution there was a Captain Beard, who spread terror through this County. This account of him, and that of his death, has been narrated to me by my venerable and worthy friend, Michael Collins, Esquire, of Warren, now in the 73rd year of his age, and may be relaied on for its correctness: --


About 1778, Captain Beard, who was a brave and gallant soldier, but mistaken about his duty, attacked the house of James Drake, Esq., of Nash County, but with a band of Tories. There was at the house, no one but Mr. Drake, his son Albritain, then about seventeen, and Benjamin Bridges [sic] his half-brother; Nathaniel Nichols, Henry Massinger, and Robert Piland. Bridges and Nichols retreated. The rest prepared for defence [sic]. Albritain, who was one of a corps of light horse, and had been active duty scouring the country for these very men, ran out with a loaded musket and fired. The Tories then surrounded the house, and ordered a surrender. They had several prisoners, tied, with them. Old Mr. James Drake seized a gun and advanced on the foe, but his gun missed fire; William Ross, a Tory, fired at him with a gun charged with buckshot. His aim missed the old man but wounded both Massinger (cutting off
part of his nose) and Piland (shot in the abdomen). The Tories, headed by Beard, sword in hand, rushed into the house. Beard was met by young Albritain Drake, with cutlass; they engaged; at the first blow young Drake's sword struck the joist above his head, and broke off at the hilt: he was knocked down. The old man then joined in the melee, with his gun clubbed;
but was soon cut down by the sword of Beard, and was so severely wounded that "he was a gore of blood". Seeing her husband cut down, old Mrs, Drake rushed in, not with a weapon, but with a jug of old Nash, even to this day celebrated for its excellent flavor. Her entreaties and the more potent influence of the liquor, produced a parley. She plied them so liberally with
the brandy, than peace was restored. Beard had been aspirant for the hand of her daughter, During this time Captain Peter Goodwin with a troop of horse galloped up; Albritain Drake threw up his hat, and gave a loud halloo;
Goodwin made a furious attack, and Beard and his men made a precipitate retreat. In his retreat, he was encountered by Bridges, who was near. Bridge's gun missed fire and Beard used his sword, but was knocked down by Bridges, and he fell lifeless. Bridges thought he was killed, and came to the house and informed them he had killed Beard. They all went out to see the dead body, but Beard had recovered so as to sit up. He was then taken into custody. A negro man, Simon, who had a wife at Drake's caught another one of his band, named Porch. They were tried by a Court-martial and both were forthwith hung. Such was the end of Captain Beard.


Mr, Drake lived to a good old age, and died in 1790, in the sixty-fifth year of his age. His brave son Albritain married settled in Robeson, where his son John now lives, and then moved to Kentucky, where he raised a large family, who, and their descendants, are highly respectable and scattered over the the south-western States. His son Colonel James P. Drake, commanded the Indiana Regiment in the late war with Mexico. Albritain died at the advanced
age of eighty, loved and respected for his kindness and virtues."


James Drake (b: Bef 1725 in Bertie Co., NC; d: Aft. July 09, 1791 in Richmond, Henrico, VA, lived in Nash Co, NC, md Sophia Valentine & Hartwell Hodges) is an acknowledged Rev War Patriot and accepted for DAR.
