Wm. Oglesby's Will 1852


Georgia ) In the Name of God Amen
Elbert County ) I William Oglesby of the state and county aforesaid calling to mind the uncertainty of life and knowing the uncertainty of death, and being aged and infirm in body,
but of sound and disposing mind and memory do make and ordain this my last Will and Testament, hereby revoking all other wills by Me here before Made


First: I resign my body to the earth from whence it came and my soul into the hands of God who gave it.


Second: It is my desire that all my just debts be first paid.


Third: I give to wife Purlinah S. during her natural lifetime or widowhood the tract of land on which I now reside containing twelve hundred and fifty acres more or less and embrasing parts of several different original surveys. The following named negroes to wit, Vann, Harper, Little Jim, Big Jim, Billy, Middleton, Berry, Harriet, Caroline, Creacey, Silvey, all the crop on hand at the time of my death (except the cotton crop) and seven hundred dollars in money. And it is further my will that at the death of my said wife (or if she should marry) the property above left to her be subject to division in the manner herein after pointed out.


Fourth: I give to my son Adkins Oglesby the tract of land on which he now lives known as the Dover tract of Mariah Hall widow of John Hall deceased containing three hundred and eighty four acres of land more of less at the price of five dollars per acre which amounts to $1920, one negro man named Daniel at four hundred dollars and one named Willis at six hundred dollars, one horse, saddle and bridle, bed and furniture and cow and calf at one hundred and sixty dollars amounting in all to $3080 all received -


Fifth: I give to my five Grand Children (the children of my daughter Elizabeth) a negroe woman named Milly Ann and her increase, at three hundred fifty dollars, and other property and some money, to the amount of two hundred and ten dollars - all of which property and money above named has been received by, and was in the possession of my said daughter Elizabeth, and her husband Henry David, at the time of their deaths.


I also give to my son Adkins Oglesby in trust for my said five Grand Children for their use and benefit, seventeen hundred and fifty dollars in Money, to be equally divided among them, as they marry or become of lawful age after my daughter Nancy Ann marries or becomes twenty one years old - in all $2311 -


Sixth: I give to my son in-law, Claiborn Webb a negro woman named Edna and her increase at the value of three hundred and fifty dollars Forn a negro man at six hundred dollars, other property and some Money estimated at two hundred and two dollars, and also nine hundred and fifty one dollars in Money - which he has received and for which I hold his two promissory notes, which are not to bear interest, in all recd. $2111.


Seventh: I give to my son William Oglesby a negro man named Big Jack at six hundred dollars and a negro boy named George at four hundred dollars, a horse, saddle, and bridle, bed & furniture, and cow & calf at one hundred and sixty dollars, also the tract of land in Elbert County lately purchased from and deeded to me by Calvin S. Moore, and on which he now resides containing three hundred and eighty seven acres more or less, at the price of twelve hundred dollars - horse saddle and bridle only recd, making in all $2360.


Eighth: I give to my son in-law William M. Settle one negro man named Mitchell at six hundred dollars, and one negro woman named Alcy at five hundred dollars, one saddle and bridle, bed and furniture, and cow & calf at sixty dollars also one hundred and twenty five acres of land more or less (including the house wherein said Settle now lives) beginning as a red oak X at Chambers tract of land thence to the west fork of Doves Creek, in such a direction as to include the number of acres here specified at the price of four dollars per acre $500. and also the sum of five hundred dollars in money. The above property recd except the $500 in money - Making in all the sum of $2,160.


Ninth: I give to my son John Oglesby all the balance of the John Hall tract of land, lying on the west side of the west fork of Doves Creek containing four hundred and forty eight acres more or less at the price of three dollars per acre ($1374) one negro man named Lindsay at six hundred and also a boy at two hundred & fifty dollars, one horse, saddle and bridle bed & furniture and cow and calf at one hundred and sixty dollars. Horse saddle & bridle & bed & furniture only received - Making in all $2384.


Tenth: I give to my son Adkins Oglesby in trust for my daughter Susan M. and her children and for their use and benefit one negro woman named Delilah (or Lylo) at five hundred dollars, Mary a girl at two hundred and fifty dollars and Bob a boy at one hundred dollars, one hundred dollars in money (or a horse worth this amount) saddle and bridle, bed and furniture and cow and calf, at one hundred and sixty dollars, and also the sum of thirteen hundred and seventy four dollars in money, Making in all $2384. Saddle & bridle only received.


Eleventh: I give to my son Thomas Oglesby a negro boy named Clark at five hundred and fifty dollars and Henry a boy at two hundred and fifty dollars, also two hundred acres of land more or less lying above and adjoining the Dover tract (herein given to my son Adkins) at three dollars per acre $600 and is the balance of the John Hall tract, one horse saddle and bridle, bed and furniture and cow & calf at one hundred and sixty dollars, and also eight hundred and seventy four dollars in money when he becomes of lawful age, Making in all $2384.


Twelfth: I give to my son Abda Oglesby a negro boy named Jackson (sometimes called Little Jack) at five hundred dollars and Adam a boy at two hundred and fifty dollars, one horse, saddle and bridle, bed and furniture and cow and calf at one hundred and sixty dollars. It is also my will that my said son Abda shall have four hundred acres of land laid off to him at the upper part of the tract (herein set apart in the third item: for my wife) adjoining William W. Hewell including such improvements as he may have put thereon at the price of three dollars per acre $1200 and also the sum of two hundred and seventy four dollars in money. The land to be set? off and the money paid to him, when arrives at lawful age, Making in all $2384


Thirteenth: I give to my son Drury P. Oglesby a negro boy named Sims at four hundred dollars and Elbick a boy at two hundred and fifty dollars, one horse saddle and bridle, bed and furniture & cow & calf at one hundred and sixty dollars. It is also my will that my said son Drury P. shall have the Johnson tract of land containing four hundred acres, at three dollars per acre $1200 and the sum of four hundred and seventy four dollars in money. This money to be paid to him and the and possessed when he arrives at twenty one years of age, Making in all $2384.


Item Fourteenth: I give to my son Adkins Oglesby in trust and for the sole and separate use of my daughter Nancy Ann and her children a negro girl named Sally at three hundred dollars, and Edna a girl at two hundred dollars, one horse, saddle and bridle, bed & furniture and cow and calf at one hundred and sixty dollars and also the sum of seventeen hundred and twenty four dollars when she my said daughter Nancy Ann marries or becomes twenty one years of age, Making in all $2384.


Fifteenth: It is my will that all the balance of my negroes (not herein disposed of) with their increase remain on the plantation with my wife during her life or widowhood, until my daughter Nancy Ann marries or becomes of lawful age, for the purpose of aiding my wife in the support and education of all my minor children who together with this property are to remain with her, and in the manner and for the purposes aforesaid, I further give to my said wife Purlinah, all (or so much thereof as she may desire) of my stock of all kinds, household and kitchen, farming, plantation tools and farming utensils and road? and ox wagon and all the provisions on hand at my death.


Sixteenth: Soon after my death I wish my four wheel carriage and such of my stock (if any, as my wife may not wish) to keep to be sold in such manner as my Executor may think most advantageous.


Seventeenth: In the event that any of those negroes herein given to any of my minor children should die or become of little or no value before such minor becomes of lawful age then and in that case, it is my desire that such deficiency or loss be made up to such child or children so losing out of my Estate.


Eighteenth: It is my will that when my daughter Nancy Ann marries or becomes of lawful age that the negroes not herein willed away, and left with my wife, be sold, and the legasies herein given to my daughter Elizabeths five children be paid to them in the manner pointed out in the fifth Item of this instrument. And also that the money legacied herein given to my minor children be paid in the manner and at the time herein before pointed out.


It is also my desire that soon after my death the shares of my son in-law Claiborn Webb & William M. Settle, and my son William be made up and paid in money equal to the amount herein given to my son John.


Nineteenth: It is further my will that all the balance of my estate, together with what is herein left to my wife during her life, or widowhood except the land at her death or marriage be equally divided among all my own children and the children of such as then may be dead (the child or children of such as may be dead drawing or being entitled to one share only) (except the children of my daughter Elizabeth ( and the children of my daughter Sarah wife of Lindsay Johnston who are not to have anything in this division) and except also my son Adkins Oglesby until all the shares of those hereby entitled are made equal to his, then he together with all my children & Grand Children (except those herein before excepted) are to share and share alike.


Twentieth: If any of my children die without child or children, then the property herein willed to such, together with the increase hereof shall be divided in the manner pointed out in the Nineteenth Item of this instrument.


Twenty first: At the death of my wife, it is my will that my son Thomas have the balance (say four hundred and fifty acres) of the land herein given to her during her lifetime or widowhood at the sale of three dollars per acre if he chooses to do so, but if he refuses to take it at that price then it must be sold with the balance of my estate and the proceeds distributed in the manner pointed out in the Nineteenth Item of this Will.


Twenty Second: I hereby nominate and appoint my son Adkins Oglesby and my son in law Claiborn Webb Executors to carry into effect this my last Will and Testament.


In testimony whereof I have hereunto set my hand and seal this fourth day of August eighteen hundred and fifty two.

"1795 WILL: Culpeper Co, VA, WB D-154, dtd 29 Mar, probated 20 Apr 1795. Bequeathed to his wife, Mary, 1/3 part of all lands and Negroes for her natural life and 1/3 of personal property. George & John Strother sons of my daughter, Ann Strother, and unto Michael Lawler, son of my daughter, Susanna Lawler, 25 pounds. My daughters Mary Browning, Sarah Hughes, Lucy Covington, Elizabeth Browning, and Mildred Covington that each of them who have not received 300 pounds shall have that amount made up to them. Son Joseph all debts due; in the recording it says that "they believe Mary Strother, widow and relict of the decedent did not wish to administer on the estate but wished John Strother, Jr., to administer on it.
1799 DEED: 5 Apr, Charles Lewis Yates bought 110 acres in Culpeper on Fork Mountain and Thornton River from John Strother who was acting as attorney for Joseph Strother, Charles Browning and Mary his wife, William Hughes and Sarah his wife, Frances Covington and Mildred his wife "joint heirs and devisees of John Strother the Elder, deceased." (Culpeper Deeds, Liber U, folio 360)."
