SIR JAMES NOT G-FATHER OF PETER WARE of 1498; Posted by: Wanda Ware DeGidio Date: November 12, 1999.


DOCUMENT #1: SOURCE: PRODIGY APRIL 1993 (Author unknown at this time.) This is the second posting of this message. My purpose is to advise other researchers of the WARE lineage of an error in containing information on the Southeastern WARES. This message is not intended as paragement of the publications, but as a caution that a major error exists. Sir James, Ware, Sr. DID NOT repeat DID NOT have a son named Robert I have made three trips to England, including Dublin, Ireland, researching the origin of the Virginia Wares. My research in Dublin for a Robert Ware, born 1602 or thereabouts was negative. I also commissioned a professional genealogist to perform the same search which was also negative. I did find a handwritten pedigree chart in Dublin's Trinity College Library that lists several generations of the senior Sir James Ware's descendants. It does not list a Robert as one of the senior Sir James Ware's sons. I also found a handwritten pedigree chart among the Crookshank papers in the British Genealogical Library in London that lists seven generations of the senior Sir James Ware's descendants. It lists two Robert Wares, one as a grandson and the other as a 3rd great-grandson. This pedigree chart, as well as the one from Trinity College indicate that Christopher Ware had another son named John. John settled in County Cork, Ireland and was married to a Mary Owen. John's descendants were known as the WARES of Woodfort and I have not found any Robert Wares in this line that would link to the Virginia Wares. The confusion factor that has misled the Ware researchers is the fact that there were two Sir James Wares. Sir James Ware, Sr.'s first son, James, Jr., was knighted prior to his Fathers death and lived in his fathers household on Castle Street in Dublin, Ireland. Sir James Ware, Jr. succeeded his father in the office as Auditor General of Ireland. The junior Sir James Ware had a son named Robert, born Oct. 23, 1639 and is listed on the above mentioned pedigree charts as the 6th son of James, Jr. and grandson of James, Sr. An assumption made by J. Burke in his 1838 publication of "A GENEALOGICAL HISTORY OF THE COMMONERS OF GREAT BRITAIN AND IRELAND" has been grossly misleading to the Ware researchers. Sir James Ware, Sr. had five sons and five daughters. Two of the sons were named John which were his second and fifth sons and the second John was born after the death of the first John. Burke combined the info on the two Johns and listed them as a single second son entry which left him a vacancy for a fifth son listing. Burke made an assumption that a Robert Ware was the missing fifth son and inserted him there. I quote his insertion as follows: "Robert (not named in his father's will), m. Jane____, and left a daughter, Mary baptized at St. Michan's, Dublin 2nd April, 1665. (This name is added on the presumption that he is the son to whom Walter Harris alludes to but failed in reciting." My analysis is if Robert was born in 1602, then he was 63 years old when Mary was baptized or Mary was 37 years old when she was baptized. Not likely, because the baptism date would fit better with Robert, the grandson, born in 1639, who would have been 26 at the time of Mary's baptism. In addition, Burke made an entry for James, Jr. which totally contradicts the aledgement that the Virginia Ware descend from the senior Sir James Ware. I quote this entry as follows: "James, (the historian), knighted in the lifetime of his father. He was the only one of the sons who left behind him male issue, of whom more immediately." Burke quotes Walter Harris as alluding to a Robert Ware. Walter Harris who was the spouse of Elizabeth Ware, 2nd great granddaughter of Sir James Ware, Sr., and the translator of Sir James Ware, Jr's. historical manuscripts from Latin to English during the 1730s. I have read Walter's translations in London (I have the pertinent pages on microfilm) and there is no doubt that the Robert that Walter refers to is the grandson of Sir James Ware, Sr. The Ware genealogy that Burke included in his 1838 publication was based on the research of Samual Hibbert, MD of Edinbourgh, Scotland. Samual Hibbert married Sarah Ware, 4th great granddaughter of Sir James Ware, Sr. Sarah was the last of the eldest branch of her lineage which was without a male heir to carry the Ware surname forth. Sarah persuaded Samual to change his name to Ware in order to produce new Wares to canyon the line. Samual agreed and did consideralbe research to establish his wife's pedigree which was necessary for his application to assume the Ware name and the title and the coat of arms of his ancestor Sir James Ware, Jr. Fortunately, Samual, now known as Samual Hibbert-Ware, originated extensive correspondence to establish his claim which his daughter gathered together and published in book form. I found a copy in the British Library and copied the pertinent pages. His research confirms the information I found on the handwritten manuscripts-that there were only two legitimate Robert Wares descending from Sir James Ware, Sr., neither being a son. Additional research on Christopher Ware, of Durham, Yorkshire is needed for additional members of his family on the outside chance that he may also have had a son or grandson named Robert. Secondly, research for an Elizabeth Ware in Leistershire. Wilder states that she was the daughter of Peter Ware, Sr., born Leistershire on Feb. 2, 1620 and married John Garrett there. A recent research on the lineage of Elizabeth Garrett, wife of Edward Ware confirms Wilder's statement. So, if Elizabeth Ware can be found there may be a good chance that Peter can be found.
NOTE # HE STATES THAT WILDER CLAIMS SHE WAS THE DAUGHTER OF PETER WARE, SR. BORN LEISTERSHIRE ON FEB. 2, 1620 AND MARRIED JOHN GARRETT IN ENGLAND. I HAVE THAT PARTICULAR PAGE, AND IT STATES SHE WAS BORN ON 2/2/1635 AND MARRIED JOHN GARRETT IN KING AND QUEEN CO.

This investigation was performed by Bluemantle Pursuivant of London and dated October 16, 1975 for a Mr. James C. Ware of Covington, KY.


Dear Mr. Ware:


I write to inform you of the outcome of the investigation I have made among the official records of the College of Arms for the family of Ware.


In the first instance, I have examined records relating to the Office of successive Ulster Kings of Arms in Ireland, copies of which are maintained here. Unfortunately, I find no trace of any Ware pedigree registered therein.


However, there are several Irish Funeral Certificates with Armorial Bearings at respective funerals which enter details of the families of the deceased. One such funeral certificate is that of Sir James Ware, Knight, Auditor to His Majesty's Revenue, who died 14th May 1632 and was buried at St. Werburghs Church, Dublin. The Certificate states that he married Mary, the daughter of Ambrose Brydon of Bury St. Edmunds in the county of Suffolk, and by her had four sons and five daughters. The four sons are given as Sir James Ware, Kgt., who married Elizabeth the daughter of Jacob Newman, John Ware, who married Elizabeth, the daughter of Henry Pierce, Joseph Ware, a Clerk in Holy Orders, who married Mary, the daughter of Gilbert Dunville, and Arthur Ware, a Master of Arts of Trinity College of Trinity College Dublin.


The Armorial Bearings established in favor of the elder Sir James Ware may be blazoned as:--
Gold two lions passant azure a bordure
also azure charged with nine escallops gold.
No chest was allowed.


You will note the absence of any reference to a son Robert Ware who might be identified with an American emigrant of that time. This absence would seem to indicate that W. M. Wilder was incorrect in his assertion that Sir James Ware had a son Robert.


This fact is further borne out by the funeral certificate of Dame Mary Ware, the widow of Sir James Ware who died 3rd December 1632. This certificate again lists her children and this listing is identical with the details given at the funeral of her husband earlier in the same year.


There are later funeral certificates relating to the younger Sir James Ware, who died 27th November and was buried 3rd December 1666 at St. Werburghs and for his wife Elizabeth, the daughter of Jacob Newman, who died 11th June 1651 and was buried at the same place. Again there is no reference to any emigration to America.


The above Irish Wares would seem to have been connected with a Kentish family of that surname. This is borne out by the similarity of Armorial Bearings. In the Visitation of the county of Essex carried out by the Heralds in 1634, Armorial Bearings were officially confirmed in favour of Anthony Ware of Raleigh in that county. These same Armorial Bearings may be blazoned as:--
Gold two lions passant azure a bordure
gules charged with eight escallops gold;


And for the Crest:- A dragon's head couped gold pierced
through the neck with a stake proper.


A pedigree entered at the time of the 1634 Visitation is headed by John Ware of Greenwich, in the county of Kent, who was the father of the above mentioned Anthony Ware. There is no reference to any American emigration. (SEE MY NOTE #1 BELOW)


In the Visitation of the county of Devon, carried out by the Heralds in 1620, a three generation pedigree was officially entered. This pedigree is headed by Edmond Weare of Halberton in the county of Devon, he being the father of Thomas Weare of Cliste Hornington in the same county. This Thomas had four sons, namely Richard Weare, Edmund Weare of Cliste Hornington, Roger Weare and Gilbert Weare. No Armorial Bearings were allowed to this family. Although Devonshire is a likely county for an American emigrant, there is again no trace that any member of this family crossed the Atlantic.


A further West Country family entered its pedigree at the 1565 Visitation of Wiltshire and Dorset. This pedigree is headed by Robert Weare, otherwise Browne, of Marlborough in the county of Wilts. The grandfather of this Robert Weare was one Clement Weare, living in 1565, and who appears on a later pedigree entered at the Visitation of the county of Berkshire carried out by the Heralds in 1623. Clement Weare was the father of Richard Weare the father of Alexander Weare, otherwise Browne, of Denford in Berkshire, who was aged 17 in 1623. Again, I have to report no trace of American emigration in this family.


The above completes the entries here relating to 17th centuries families of Ware or variants thereof.


However, I have extended my searches beyond the official records in an endeavour to shed further light on the problem. In this respect, I find an interesting reference to the will of one Thomas Weare, yeoman, of Charfield in the county of Gloucester. The will of Thomas Weare was proved in the Perogative Court of Cantebury in 1685. I find a note to the effect that Thomas Weare appointed as Executor his eldest brother Peter Weare, who is described as being "in the territory of New England." (SEE MY NOTE #2 BELOW)


The surnames Ware and Weare are phonetically the same and since the spelling of surnames in the early 17th century did not have the rigidity which is found today, the will of 1685 may well be of important relevance with the Peter Ware of 1675, this suggests that the family may have a Gloucestershire provenance.


Under the circumstances, there would seem to be two possible leads. Firstly there is the 1685 will of Thomas Weare and secondly there is the will Johan Foote of Tedbourne St. Mary in the county of Devon. In the absence of any reference to any Peter Ware or any American emigrant in the official records of the College of Arms, it may be possible to undertake further searches among local and national archives in an endeavour to establish the exact origin of the family in this country. In this respect, I am wondering whether either of the Peter Wares mentioned by you left a will and whether these might be forthcoming. Similarly, it would be most interesting to see a copy of the will of Johan Foote. The indications are that there may be more than one family of Ware settling in America during the 17th century and using the Christian name of Peter. The above wills may well assist in clarifying this point and provide a lead back to either Devonshire or Gloucestershire.


Thereafter, it may then be possible to institute the above mentioned programme of research among local and national archives in an endeavour to prove the Cross-Atlantic link. Such a process is never easy and I would have to ask for something in the region of $400 in order to make such a programme of research worthwhile. Further, I would be in a better position to advise you on this point if you are able to provide me with copies of the Wills in question.

IN THE PAST, I BELIEVED THESE TWO FAMILIES WERE CLOSELY RELATED DUE TO JACOB WARE SERVING AS MINISTER OF ST. PETER'S PARISH AND LATER HENRICO CO., THE SAME PARISHES ATTENDED BY OUR WARES. IT MAY BE POSSIBLE BOTH FAMILIES ORIGINATED FROM JOHN WARE OF GREENWICH IN COM. KENT BORN BEFORE 1570. ONE OTHER TIE LINKING THIS FAMILY TOGETHER IS THE SIMILARITY OF THEIR ARMORIAL BEARINGS AS NOTED IN DOCUMENT #2.
