Notes

Aka: Arthur O'Neale. "Henry1 Neale (***my note: married to Ann Lewger Tattershall, widow of William Tattershall) left an infant son named Henry2 Neale and one born posthumously named Arthur2 Neale. The first son seems to have left no heirs but his will fortunately sheds light on the second son of Henry1 Neale.

The effect of this will is to identify the other child mentioned in the administration of the estate of Henry1 Neale as being Arthur2 Neale. This name was sometimes entered O'Neale by clerks of the court in both St. Mary's and Prince George's Counties.

Charles NEALE

Marriage 3 Deborah UNKNOWN (named in Arthur's estate)

Arthur2 Neale married Mrs. Sarah Baylons at some time by or before 1695 in which year testamentary proceedings in St. Mary's County reveal the marriage. William Baylons is described as being late of St. Mary's county. This date establishes the approximate year in which Arthur2 Neale removed to Prince George's County. A general exodus into this area was in process probably dictated by a desire for new lands to plant.

Maryland Magazine Volume 18, p. 200 refers to Captain Arthur2 Neale to whom tobacco was paid from the account of Dr. Charles Carroll, Physician and Merchant in the year 1717. This matter takes on added interest in connection with the will of Elizabeth Daniel recorded 1725 in Prince George's Record Book 19, p. 69. By the terms of her will "Mr. Arthur2 Neale of Prince George's County "together with his wife, Ann Neale, his daughters Ann3 Neale, and Susannah3 Neale and his son, Charles3 Neale are named as beneficiaries and it seems that the amounts to be received were substantial. She also made bequests to John Carroll, Richard Croxall, Mrs. Joanna Croxall and Mary Croxall. Richard Croxall and John Carroll were made executors. (Prince George's County Records, Book 19, p. 69.)

The connection between this Elizabeth Daniel and the Neale Family or the Carroll family is not clear but surely did exist. Prince George's County records do show that the maiden name of Joanna Croxall was Joanna Carroll. These facts in combination would seem to suggest that there was some connection between the family of Captain Arthur2 Neale and the Carroll Family of Maryland. This will also serves to show that by 1725 Sarah Neale, whom Arthur2 married ca. 1695 was dead before 1725 and that Arthur2 Neale had married as his second wife, Ann.

Accounts Book 18, page 137-8, Prince George's County contains the following entry:

November 28, 1740. Then Mrs. Deborah O'Neale, Administratrix of Arthur2 O'Neale & made oath on the Holy Evangelist of Almighty God that the foregoing account is just and true in which after due examination by virtue of a special commission to me directed is passed by, Peter Dent, Deputy Clerk of Prince Georges County.

From the above document it is made clear that Arthur2 O'Neale was dead by and before November 28, 1740, and that his third wife was Deborah. His children were probably, named in order: Charles3, James3, a daughter who married Joseph Selby, a daughter named Margaret3 O'Neale, a daughter who married William Finch, and a son Richard3 O'Neale. In addition, daughters, Ann3 and Susannah3 were named in the will of Elizabeth Daniel.

Prince George's County Deeds EE 1746-49 p. 633 shows that in 1749 Joseph and Sarah3 Selby sold a parcel of land called Seath Cont to John Orme. In the same year they sold a tract being part of Mr. Calvert Manor to John Selby. Ibid. page 645. These sales reveal the given name of the daughter who married Joseph Selby as Sarah3.

On July 10, 1713 Arthur2 Neale of Prince George's County purchased from John Summers and his wife Mary for L 45 sterling money of England, 120 acres, being part of a greater tract called Pitchcraft situated on the west side of Patuxent River in the dividing line between Prince George's County and Ann Arundel County. It seems that it was here that Arthur2 Neale and his family were seated. (Prince George's County Deeds G, folio 185.)

This purchase serves to dissipate any suspicion the reader may have held regarding the identification here made of Arthur2 Neale and Arthur2 O'Neale being one and the same person. After the death of Arthur2 O'Neale, as his name was entered by a clerk in county records, his widow and third wife, Deborah, engaged in litigation over the estate of the deceased Arthur2. In the course of that litigation Charles3 Neale took pains to show that he and Deborah were not related--she was his step-mother. We now have a Charles3 Neale clearly established in a suit with his step-mother who was the widow of Arthur2 O'Neale. Here we have the father's name being spelled with the O' and the son's name dropping the prefix.

Still another fact which identifies Charles3 Neale as the son of Arthur2 Neale or O'Neale concerns the land purchase of July 10, 1713 on Patuxet River by Arthur2 Neale. On July 6, 1740 Charles3 Neale and his wife Sarah, sold to William Cox for 16, 000 pounds of tobacco a portion of the land on the Patuxet River called Pitchcroft excepting the third part of Deborah Neale during her natural life. (Prince George's Deeds 1735-43 p. 190.) What had happened? It appears that Charles2, being the oldest son of Arthur2 had, according to the English law of promogeniture, inherited his father's lands, in the absence of a will and was now selling subject to the dower rights of his step-mother whom he names. The conclusion is inescapable that Arthur2 Neale and Arthur2 O'Neale were one and the same person.

Charles3 Neale, the oldest son of Arthur2 may have continued to reside in St. Mary's County after his father bought in Prince George's County. As a young man, probably in his early twenties, he administered the estate of Charles Cecil of St. Mary's County. (St. Mary's County Administration Bk. 2-278.) In this same year, 1718, he had the administration of the estate of John Brown. (Ibid-315)"
