Will of Bartholomew Spaine

In the name of God Amen Tenth day of February Anno Dm' 1697 I Bartholomew Spaine the older of Littlebourne in the County of Kent Yeoman being weake in body but of good and p'er'fect mind and memory God be praised do make and ordaine this my last Will and Testament in manner and form following First I commend my soul into the hands of Almighty God my gracious and mercyfull creator hopeing that the meritts of my Lord and Saviour Jesus Christ to receive full pardon for all my sins And my body I committ to the Earth from whence it was taken to be buried by my Executors hereinafter named in Christian and Decent manner in the Church or Churchyard of the parish of the Wootton in the said County of Kent att the discretion of my Executors
Imp's I doe make and ordain my loving son Richard Spaine my sole Executor of this my last Will and Testament

Item I give and bequeath to my said Son Richard Spaine all my Farme house and Lands with all thereunto belonging in Selsted in the P'ar'ish of Wootton and alsoe one other house and Lands with all thereunto belonging in the said p'ar'ish of Wootton, now in the occupation of Daniel Coller, for & during his natural life
And from and after his Decease I give and bequeath the said Farm house and Lands in Selsted aforesaid to his Son Bartholomew Spaine and to his heirs forever and the aforesaid house and Lands now in the tenure or occupation of the said Daniel Coller that I freely give and bequeath unto his son Richard Spaine and to his Heirs for ever
And further my will is that if he the said Bartholomew Spaine my Grandchild aforesaid shall or will pay unto his aforesaid brother Richard Spaine the Sume of fourscore pounds of Lawfull money of England att the end of two years after his father's decease my will is that the said Bartholomew Spaine shall enjoy the whole estate given hereunto their father aforesaid

Item I give and bequeath also unto my Loving son Bartholomew Spaine of Littlebourne all those Lands of mine lyeing and being within P'ar'ish of Burmarsh in Rumney Marsh within said County of Kent To have and to hold to the said to the said Bartholomew Spaine my son for and during the terme of his natural life and from and after his decease I give and bequeath these Lands in Burmarsh aforesaid unto my Grandchild Bartholomew Spaine his son and to his heirs forever But in case my said Grandchild shall happen to dye without heirs before that he attaine to the said age of one and twenty years then I give and bequeath the said Lands in Burmarsh aforesaid unto my Grandchild Augustine Spaine to him and his heirs forever

Item I give and bequeath unto my Son Bartholomew Spaine one tenement and the lands thereunto belonging lyeing and being in Giddinge in the P'ar'ish of Wootton aforesaid for and during the terme of his natural life and after his decease I give and bequeath the said tenement and Lands to his son Augustine Spaine my Grandchild to him and his heirs for ever in case the said son Augustine Spaine shall happen to die without heirs before he attain to the age of one and twenty years then I give and bequeath the same unto his son John Spaine my Grandchild to him and his heirs forever

Item I give and bequeath also unto my said son Bartholomew Spaine one other tenement and Lands hereunto belonging lyeing and being in Wootton Street in the P'ar'ish of Wootton aforesaid for and during his natural life and after his decease I give and bequeath said tenement and Lands in Wootton Street unto his son John Spaine and to his heirs forever but if he the said son John Spaine shall happen to die before he attain to the age of one and twenty years then I give and bequeath the said tenement and Lands unto his son Richard Spaine my Grandchild and to his heirs forever

I give and bequeath unto my son Richard Spaine the rents of my lands at Selsted which will be due at my decease for his own use it being his own inheritance after my decease

Item I give and bequeath also unto my son Bartholomew Spaine all the money which will be for Rent att the time of my decease of my lands in Burmarsh, Giddinge and Wootton Street it being his free inheritance given by me after my decease And I doe also freely give and bequeath to my son Bartholomew Spaine all what monyes forever that I shall have with me or by me in Littlebourne at the time of decease And my moveable goods and linen and wearing apparrell that I shall have att my decease And the sume of which is to me due upon Bond from John Lamb of Beaksborne All this I freely give for the only use and command of said son Bartholomew Spaine and his heirs Executors and assignes for ever

And lastly I doe hereby revoke all wills by me heretofore made in writing or by word of mouth and this to be my Last Will and Testament In wittness whereof I have hereunto sett my hand and seal the day and yeare first above written Bartholomew Spaine the Testator his mark Signed Sealed Published and Declared by the said Bartholomew Spaine the Testator to be his last will & testament in the p're'sence of us who have also subscribed our names in the p're'sence of the said Testator
