Will of Stedman Shrubsole

This is the last Will and Testament of me Stedman Shrubsole of Chatham in the County of Kent Victualler
First I direct that all my just Debts Funeral and Testamentary expences shall be paid as soon as may be after my decease and after payment thereof I give and bequeath all and singular the personal Estate and Effects of which I may be possessed at the time of my decease whether the same shall consist of monies in the public Funds or shares in any public Company Stock Trade book and other Debts of what nature soever Household furniture Plate Linen China or of any other kind of Personalty unto Thomas Lunt and Elizabeth Mary Shrubsole my Executor and Executrix hereinafter named and the survivor of them his or her Executors or admors Upon the Trusts hereinafter mentioned

and as concerning the Messuages Lands Heredits and Premises whatsoever and wheresoever of which I am seized or possessed of I give and devise the same unto Thomas Lunt and Elizabeth Mary Shrubsole my Executor and Executrix hereinafter named their heirs and assigns for Ever Nevertheless upon the Trusts hereinafter declared and contained of and concerning the same

and I hereby declare that the bequest of my said Personal Estate and Effects and the devise of my said Messuages Lands Heredits and Premises is made to them the said Thomas Lunt and Elizabeth Mary Shrubsole their heirs Executors and admors respectively upon Trust as to my said Personal Estate and Effects that they shall collect and get in the same as soon as may be after my decease and divide it into five equal parts or shares such division to be made by a Sale of the said Estate or by an allotment thereof into five equal parts as the majority of the parties who may be entitled thereto may determine

and pay and apply one fifth part thereof to the said Thomas Lunt or Sarah his Wife
one fifth part to the said Ann Shrubsole
one fifth part thereof to my Son William Shrubsole
one fifth part thereof to my Daughter Elizabeth Mary Shrubsole
and the remaining fifth part thereof to my Daughter Charlotte Shrubsole

and I direct that in case any of my said Children shall not have attained twenty one years of age that each of those who have attained that age shall from time to time lodge and clothe those under age until they attain twenty one receiving Interest on the amount of their share or shares of such monies for so doing and if any of these my said Children who may be of age shall refuse to comply with this direction Then I revoke the bequest and devise herein made in their favor

and as to my said Real Estate Heredits and Premises I direct that my said Executors and Executrix shall sell and dispose of the same by public auction or private Contract as they may think fit to any person or persons who may be willing to purchase the same and I declare that his or her receipts shall be sufficient discharges to the purchasers for the monies who shall not be bound or liable to see to the application thereof after payment of all costs charges and expences attending such Sale I give and devise the clear monies arising from such Sale unto the same parties and in the same proportions as I have hereinbefore given and bequeathed to them my Personal Estate and Effects

Provided always and I hereby direct that if the persons entitled to the produce of my said Estates can agree in making an equal division of my said Estates amongst themselves without any Sale that then my said Executor and Executrix shall not be bound to sell the same but shall convey and transfer the same Estates to them in equal proportions accordingly

and I hereby direct that my said Executor and Executrix shall not be liable for any loss which may happen otherwise than through their wilful neglect or default nor shall the one of them be answerable to the acts and deeds of the other of them but each for his and her own acts and deeds only and that they and each of them may retain and reimburse themselves himself or herself all such costs charges and expences as they may respectively incur in the execution of the Trusts hereby reposed in them

and I hereby nominate the said Thomas Lunt of Gravesend in the said County of Kent Broker and the said Elizabeth Mary Shrubsole Executor and Executrix of this my last Will and Testament and revoking all former Wills declare this only to be my last Will and Testament

In Witness whereof I the said Stedman Shrubsole the Testator have to this my said Will contained in two sheets of paper set my hand and seal that is to say to the first sheet thereof my hand and to the last sheet thereof my hand and seal this 23rd day of October 1824 Stedman Shrubsole
