Will of Thomas Sampson

In the Name of God Amen I Thomas Sampson of the Parish of Saint Peter the Apostle in the Isle of Thanet in the County of Kent yeoman being of sound and disposing mind and mindfull of my mortality do make and ordain this my last Will and Testament in writing in manner and form following (that is to say)

First I do give and Devise unto my wife Elizabeth Sampson and her assigns for and during the Term of the natural life of the said Elizabeth Sampson One Annuity or yearly sum of Twenty Pounds free and clear of all deduction for repairs Land Tax or on any other account whatsoever to be Issuing going and payable out of all and singular my Messuages Lands Tenements Hereditaments and real Estate whatsoever and wheresoever on this Condition
that if my said wife on my decease shall deliver or cause to be delivered up to my Executors hereinafter named to be cancelled and made void a certain Bond or writing entered into by me on my Marriage with my said wife for the leaving or paying at my Death unto my said wife the sum of Three hundred and fifty pounds or some such like sum of money or otherwise release and discharge all such her Right Title Interest claim and demand of in and to such money the said Annuity or yearly sum of Twenty Pounds to be paid on the Tenth day of October and the fifth day of April by even and equal portions half yearly to be paid

And that when and as often as the same or any part thereof shall be behind and unpaid for the space of Twenty one days next after either of the said days on which the same ought as aforesaid to be paid that then and so often and at any time or times then after it shall and may be lawfull to and for my said wife Elizabeth Sampson and her assigns into or upon the said Messuages Lands Tenements Hereditaments and premises or any either of them or any part thereof to enter and distrain and such distress and distresses to detain keep and dispose of as she or they shall think fit until she or they shall be fully satisfied and paid all such arrearges with the costs and charges in and about the making keeping and disposing thereof
But if my said wife Elizabeth Sampson on my decease shall refuse to deliver or cause to be delivered up to my Executor to be cancelled and made void the said Bond or writing for the leaving or paying at my Death unto my said wife the sum of Three Hundred and fifty Pounds or some such like sum of money or to release and discharge all such her Right Title Interest claim and demand of in and to such money aforesaid That then and in such case I do will that the said Annuity or yearly sum of Twenty Pounds shall cease determine and be void and not be paid to my said wife And I will and declare that the said Annuity or yearly sum of Twenty Pounds above devised to my said wife in manner aforesaid shall be in full satisfaction and bar of the Dower of my said wife Elizabeth Sampson which she may claim to have in my Lands Tenements or Hereditaments whereof or wherein I shall at any time during my life be seized of any Estate of Inheritance

Also I do Give and devise unto my five sons Nicholas Sampson Thomas Sampson William Sampson John Sampson and Isaac Sampson equally to be divided between them as Tenants in Common and to their respective heirs and assigns All and singular my Messuages Lands Tenements Hereditaments and real Estate whatsoever and wheresoever subject and lyable to the payment of the said Annuity or yearly sum of Twenty Pounds above devised to my said wife in manner aforesaid

And if either of my sons John Sampson and Isaac Sampson should happen to dye under the age of Twenty one years without issue then I devise the Part of the real Estate of him so dying unto the survivors or survivor of them the said Nicholas Sampson Thomas Sampson William Sampson John Sampson and Isaac Sampson equally to be divided between them as Tenants in Common and to the respective heirs or assigns of such survivors or survivor

Also I do give and bequeath unto my daughter Elizabeth Sampson the sum of Two Hundred Pounds of lawfull money of Great Britain to be paid to her within six months next after my decease

Also I do give and bequeath unto my daughter Sarah wife of William Goodson the sum of one hundred pounds of like lawfull money to be paid to her within six months next after my decease which with the sum of one hundred pounds I gave her in marriage with the said William Goodson makes the sum of Two Hundred Pounds

Also I do give and bequeath unto my youngest daughter Judith Sampson the sum of Two Hundred Pounds of like lawfull money to be paid to her at the age of Twenty one years with interest for the same in the meantime after the rate of four Pounds per Centum per Annum which Interest or any part thereof I do direct and appoint my Executors if they see fit to apply towards the maintenance and bringing up of my said daughter Judith Sampson during her minority

Also I do give and bequeath unto my said wife Elizabeth Sampson All the furniture of my best Chamber Three good pewter dishes and a dozen of good pewter plates

Also as to all and singular the rest and residue of my Goods Chattles Household furniture household stuff plate moneys implements of husbandry Cattle corn mortgages securities and all other my personal Estate whatsoever and wheresoever and of what kind nature degree or quality soever the same shall exist and be at the time of my decease (after my debts legacies and funeral expences are thereout paid satisfied and discharged) and not herein by me before disposed of I do give and bequeath the same and every part thereof unto my said five sons Nicholas Sampson Thomas Sampson William Sampson John Sampson and Isaac Sampson equally to be divided between them share and share alike and to their respective Executors Administrators and Assigns

And I do direct and appoint my Brother in law Elijah Mockett one of my Executors during the minority of my said sons John Sampson and Isaac Sampson shall take and receive in Trust for their use and benefit the rents and profits of their parts of the real Estate above devised to them and shall and may apply the same or any part thereof if he sees fit on their maintenance and bringing up
And I do further direct and appoint that my Executors shall and may during the minority of my said sons John Sampson and Isaac Sampson if they see fit likewise apply their parts of the personal Estate herein before bequeathed to them or any part thereof on their maintenance and bringing up

And as I intend my Eldest son Nicholas Sampson shall have my farming Business it is my desire will and pleasure my said son Nicholas Sampson shall have the use and occupation of my farm wherein I live with all the Lands thereunto belonging or therewith used or occupied so long as he likes not exceeding Twenty one years he my said son paying such a reasonable Rent for the same as shall be settled and adjusted by my said Brother in Law Elijah Mockett and some other person to be nominated and chosen for that purpose by me said son Nicholas Sampson and my said son Nicholas Sampson taking off purchasing and buying all the utensils and implements of husbandry cattle and stock of my said Farm with my Brewing vessels and utensils at a fair and just appraisment to be made thereof

And I do make and appoint my said son Nicholas Sampson and my said Brother in Law Elijah Mockett Joint Executors of this my last Will and Testament hereby revoking and making void all former Wills and Testaments by me at any time or times heretofore made and do publish and declare this and no other to be my last will and Testament In Witness whereof I the said Thomas Sampson the Testator have to each sheet of this my last Will and Testament contained in four sheets of paper set my hand and seal this ..teenth day of November in the year of our Lord one Thousand Seven hundred and Sixty Seven and in the eighth year of the Reign of our Sovereign Lord George the Third by the Grace of God of Great Britain France and Ireland King Defender of the Faith &c

This will was proved by the oath of Elijah Mockett one of the Ex’tors herein named to whom admon &c was granted.
