Will of William Sales

of Downe, Kent

This is the last Will and Testament of me William Sales of Down in the County of Kent Carpenter First I order and direct that all my just debts and my funeral and testamentary expences be paid and satisfied as soon as may be after my decease
I give forgive and relinquish any claim to debts monies and securities for money due and owing from any person or persons to me at the time of my decease (funded property only excepted)

I give and bequeath unto my son Timothy Sales one hundred and fifty pounds stock or annuities called and being three per cent reduced Bank Annuities being part of certain stck now standing in my name in the Books of the Governor and Company of the Bank of England and belonging to me
I give and bequeath unto my son Benjamin Sales other four hundred pounds of like stock or annuities
and to my son George Sales other three hundred and fifty pounds stock or annuities

I give and bequeath unto my daughter Amey the wife of Samuel Lettington three hundred and fifty pounds stock or annuities commonly called three per cent Consolidated Bank Annuities being part of certain Annuities now standing in my name in the Books kept for that stock at the Bank of England and belonging to me
I give and bequeath unto my daughter Mary the wife of Thomas Bath of Hayes in the County of Kent tailor other four hundred pounds of the last mentioned stock
Also I give and bequeath unto my daughter Ann the wife of William Town of Down in the County of Kent blacksmith other five hundred pounds of the last mentioned stock

Also I give and bequeath unto my Executor hereinafter named other one hundred and fifty pounds of the last mentioned stock Upon Trust that they my said Executors and the survivor of them and the Executors Administrators and assigns of such survivor do set the same apart and stand and be possessed of the same in their names in the parliamentary stocks or public funds of Great Britain and do and shall from time to time alter vary and transfer the same and the interest and dividends and all accumulations thereof for or into other stocks or funds

And my will is that until my grandson Charles Sawyer shall attain the age of twenty one years they my said Executors or the survivor of them or the executors adm’ors or assigns of such survivor shall receive the yearly dividends and interest of the said one hundred and fifty pounds stock and accumulate the same in the nature of compound interest And I do hereby direct that when my said grandson Charles Sawyer shall attain the age of twenty one years then my said Executors or the survivor of them or the ex’ors or adm’ors of such survivor shall stand and be possessed of the said one hundred and fifty pounds stock and the interest and dividends thereof and the accumulations of the same In Trust for and to and for the use and benefit of my said grandson Charles Sawyer to be held or transferred as my said grandson may direct

And in case of the death of my said grandson under the age of twenty one years I direct that the said one hundred and fifty pounds stock and all interest dividends and accumulations thereof shall fall unto and form part of the residue of my personal Estate
I give and bequeath unto my son William Sales the legacy or sum of ten pounds
The said several legacies I direct to be transferred and paid within three calendar months next after my decease

And all the rest and residue of my money and securities for money stock in the public funds household goods and furniture chattels and effects and personal estate whatsoever and wheresoever after payment of my just debts and the costs and charges of executing this my Will I give and bequeath unto such of my now children as shall be living at the time of my decease equally share and share alike

I nominate constitute and appoint the said Thomas Bath and the said William Town Executors of this my Will And I do hereby order and direct that my said executors and trustees or either of them shall not be charged or chargeable with or accountable for any more of the monies or estate than he or they shall actually receive nor be liable to answer or make good any loss or losses that may happen of the aforesaid monies or estate or any part thereof so as that such loss happen without their willful default nor the one of them for the other of them nor for the acts deeds or receipts neglects or defaults the one for the other of them but each of them for his own acts and deeds only and also that it shall and may be lawful for them my said Executors and each of them their and each of their executors and adm’ors in the first place by and out of the … monies and premises respectively to retain to and reimburse himself and themselves respectively all such costs charges and expences as they or either of them shall or may bear pay sustain or be put unto in the Execution of this my will the trusts hereby in them reposed

And hereby revoking all other and former wills by me made I declare this only to be my last Will and Testament In Witness whereof I the said William Sales the Testator have to this my last Will and Testament contained in two sheets of paper to the first sheet thereof set my hand and to the second sheet thereof set my hand and affixed my seal the ninth day of April in the year of Our Lord one thousand eight hundred and thirty one – William Sales – Signed sealed published and declared by the said William Sales the Testator as and for his last will and Testament in the presence of us who in his presence and in the presence of each other and at his request have hereunto subscribed our names as witnesses thereto the word ‘carpenter’ in the second line of the first sheet having been first written on erasure

Proved at London the 19th August 1836 before Worshipful John Danberry Doctor of Laws and Surrogate by the oaths of Thomas Bath and William Town the Ex’ors to whom Admon was granted having been first sworn duly to administer
