This is the last Will and Testament of me Robert Sale of Lympsfield in the County of Surry Yeoman
First I give and devise to my son Robert Sale his heirs and assigns for ever all that my Freehold Messuage or Tenement and Farm called Greenhurst together with the buildings lands and premises thereto belonging situate lying and being in the parish of Oxted in the County of Surry

Also I give and devise unto my two kinsmen William Thompson of Sundrish in the County of Kent and Nathaniel Palmer of Oxted aforesaid and Samuel Love of Shoreham in the said County of Kent three of my executors hereinafter named and appointed the sum of ten guineas each

Also I give devise and bequeath to my wife Elizabeth Sale and my said two kinsmen William Thompson and Nathaniel Palmer and the said Samuel Love and the survivors and survivor of them and the heirs and assignes of the survivor of them all other my Messuages Lands Tenements hereditaments and real estate whatsoever and wheresoever together with my leasehold farms lands and premises and all and singular my corn cattle live and dead stock ready money securities for money and all the rest and residue of my personal estate and effects whatsoever and wheresoever upon this special trust and confidence that they shall and do as soon as conveniently may be after my decease either de... and let or absolutely sell and dispose of all and singular or any of my said messuages lands tenements and hereditaments so given and devised to them as aforesaid together with my said leasehold farms lands and premises or in the best way and manner that they can use and occupy the same and the stock and affects bequeathed to them as aforesaid or sell and convert the said stock and affects or any part thereof into money at their discretion as freely and absolutely in all respects whatsoever to the intents and purposes hereinafter mentioned as I myself might or could do if living and buy and sell renew and dispose of and receive and take the rents issues produce and profits of the said estates and effects so given devised and bequeathed to them as aforesaid and pay expend and apply the same and the monies arising by the sale and disposal of my said real and personal estates or any part and parcel thereof at their discretion to and for the joint use and benefit of my said wife and all my children for their support and maintenance in the best and most suitable manner that the same so used and applied will admit of until my said children shall respectively attain the age of twenty one years

and as and when they shall respectively attain the said age then to pay to each of them respectively from and out of the principal or whole of the estates and property so given devised and bequeathed In Trust as aforesaid and the monies thereby arising the sum of five hundred pounds apiece of lawful money of Great Britain
And in case any or either of my said children shall die under the said age then to pay and divide the said legacy of him her or them so dying unto and amongst the survivors or survivor of them in equal shares

And I do hereby direct and declare that it shall and may be lawful to and for the said William Thompson Nathaniel Palmer and Samuel Love and the survivors and survivor of them from time to time to take and retain to their respective use and benefit from and out of the Trust monies coming to their hands all their reasonable costs charges damages and expences in and concerning the due execution and performance of this my will and the Trusts hereby in them reposed

And when the youngest of my children shall have attained the age of twenty one years then I give and bequeath to my said wife the sum of fifty pounds to be paid out of the said Trust monies

And as to all that shall remain of my estate and property after the youngest of my children shall have attained the age of twenty one years and (after payment of all my just debts funeral expences the charges of proving this my will and all other costs and charges concerning the same the application of the Trust monies hereinbefore bequeathed) I direct that from and out of the same a sufficient sum shall be taken and put out by the said Willian Thompson Nathaniel Palmer and Samuel Love or the survivors or survivor of them on land security or laid out in the purchase of stock in one of the publick Funds of the Bank of England in their name subject to this my will and upon Trust to pay with the yearly interest dividends or produce thereof unto my said wife Elizabeth Sale one annuity or yearly sum of fifty pounds by two equal half yearly payments for her support and maintenance for and during the term of her natural life if she shall so long remain a widow

But in case she shall marry again after my decease then and from thenceforth to pay her out of the said yearly interest and proceeds one annuity or yearly sum of twenty five pounds only in two equal half yearly payments for and during her natural life And subject to the disposal of my said real and personal estates hereinbefore mentioned expressed and contained and to the said annuity or yearly sum of fifty or twenty five pounds so to be paid to my said wife as aforesaid I give devise and bequeath all the rest and residue thereof unto and amongst all and every of my daughters if they shall be all then living

But in case any or either of my said daughters shall then be deceased and shall have left lawful issue of their bodies then I give and bequeath the said residue unto and amongst all and every of my children both sons and daughters who shall be then living and the respective lawful issue of such of my said children as shall then be deceased equally to be divided between them share and share alike such issue to take his her or their deceased parents share in equal portions

And I do make constitute and appoint my said wife Elizabeth Sale and the said William Thompson Nathaniel Palmer and Samuel Love Executors of this my last Will and do hereby revoke and make void all other wills by me at any time heretofore made In Witness whereof I the said Robert Sale the testator have hereunto set my hand and seal the thirtieth day of July in the year of our Lord one thousand eight hundred – Rob’t Sale – Signed sealed published and declared by the said Robert Sale the Testator as and for his last Will and Testament in the presence of us who in his presence and at his request and in the presence of each other have hereunto subscribed our names as witnesses

This will was proved at London the twenty sixth day of May in the year of our Lord one thousand eight hundred and three before the Worshipful Samuel Pearce Parson Doctor of Laws Surrogate of the Right Worshipful Sir William Wynne Knight also Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the oaths of Elizabeth Sale widow the Relict of the deceased Nathaniel Palmer and Samuel Love the surviving Executors named in the said will to whom administration of all and singular the Goods Chattels and Credits of the deceased was granted having been first sworn duly to administer.
