This is the last Will and Testament of me John Green of Maidstone in the County of Kent Gentleman
First I will order and direct that all my just debts my Funeral expences the costs of proving this my will and other incidental charges shall be paid and satisfied with all convenient speed after my decease
Also I do hereby make nominate constitute and appoint my dear daughter Ann Hollingworth the wife of Finch Hollingworth of Boxley in the said County of Kent paper maker to be sole Executrix of this my last will

Also I give and devise unto my said daughter the said Ann Hollingworth all that messuage tenement or dwelling house wherein I now reside situate standing lying and being in Stone Street in Maidstone aforesaid with the out buildings yard garden and hereditaments therein to belonging and therwith? used with the appurtenances and also all other my Messuages or tenements Lands hereditaments and real estate and parts and shares of messuages or tenements lands herit’s and real estate whatsoever and wheresoever and of what nature kind or quality soever and every part and parcel thereof to hold the same and every part thereof with the appurtenances unto my said daughter Ann Hollingworth to the sole & only proper use and behoof of my said daughter Ann Hollingworth her heirs and assigns for ever

Also I give and bequeath unto my said daughter the said Ann Hollingworth the principal sum of Two thousand pounds of lawful money of the Untied Kingdom of Great Britain and Ireland as current in England upon trust with all convenient speed after my decease to lay out and invest the said sum of two thousand pounds in her name in some or one of the public stocks or funds in this Kingdom or on Government or real Security or securities and do and shall stand possessed thereof upon trust to pay transfer or assign the said stocks funds and securities and the monies therein invested unto my Grandchildren Robert Hollingworth Dennis Hollingworth and Mary Hollingworth the three children of my late daughter Mary Hollingworth deceased by Thomas Robert Hollingworth of Boxley aforesaid paper maker when and so soon as the youngest of my said grandchildren shall attain the age of twenty one years in equal parts shares & proportions with benefit of survivorship in equal parts shares and proportions if any of my said Grandchildren shall happen to die under the age of twenty one years and without issue but if any of such grand children shall happen to die under the age of twenty one years leaving issue lawfully begotten then as to the part or share parts or shares which he she or they respectively so dying whithout issue would have been intitled to by virtue of and under this my will if he she or they respectively had lived to attain the said age of twenty one years upon trust for such issue if there shall be more than one with benefit of survivorship in equal shares if more than one to and amongst such issue respectively if any of them shall die under the said age of twenty one years and without issue and if but one of my said Grand Children shall live to attain the said age of twenty one years or shall die under the said age leaving issue lawfully begotten then upon trust to pay assign or transfer the said Stocks Funds and Securities and the monies invested unto such only child at his or her age of twenty one years or to the issue of such only Child in equal shares and proportions if there shall be more than one when and as he she or they shall attain his her or their age or respective ages of twenty one years with benefit of survivorship equally to and amongst such issue if any of them there being more than one shall happen to die under the said age of twenty one years and without issue

And upon trust I do hereby direct that the whole of the Interest Dividends and annual proceeds of the said stocks funds and securities shall in the mean time and until the said principal sum of two thousand pounds so to be invested as aforesaid shall become payable as aforesaid be suffered to accumulate and be applied to the most advantage for the benefit of my said Grand children or their issue respectively as aforesaid and shall not be paid or payable until the said principal sum of two thousand pounds shall become payable and divisable as aforesaid
And in case none of my said Grand children nor any children of them or any or either of them lawfully begotten shall be living at the time of my decease or if my said grand children or the issue of them or any or either of them shall happen to die under the said age of twenty one years and without issue then I direct that the said trust monies Stocks Funds and securities shall sink into and become part of the residue of my personal estate hereinafter given and bequeathed

Also I give and bequeath unto my daughter the said Ann Hollingworth the principal sum of one thousand pounds of like lawful money upon trust with all convenient speed after my decease to lay out and invest the said sum of one thousand pounds in her name in some or one of the public stocks or funds of this Kingdom or on Government or real Security or securities and do and shall stand possessed thereof upon trust to pay transfer and assign the said stocks funds and securities and the monies therein invested unto my Grandson Thomas Pope the son of my late daughter Elizabeth Pope deceased by Thomas Blissett Pope of Maidstone aforesaid Gentleman when and so soon as my Grandson Thomas Pope shall attain the age of twenty one years and I direct that the whole of the interest dividends and annual proceeds of the said Stocks Funds and Securities shall in the mean time and until the said principal sum of one thousand pounds so to be invested as aforesaid shall become due and payable be suffered to accumulate and be applied to the most advantage for the benefit of my said Grandson Thomas Pope and shall not be paid or payable until the said principal sum of one thousand pounds shall become due and payable as aforesaid
and if it shall happen that my said Grandson Thomas Pope shall die under the said age of twenty one years without issue lawfully begotten then upon trust to pay transfer or assign the said stocks funds or securities wherein the said principal sum of one thousand pounds shall be laid out and invested as afore’d unto my said Grandchildren the said Robert Hollingworth Dennis Hollingworth Mary Hollingworth the three children of my late daughter Mary Hollingworth deceased in equal parts shares and proportions to be paid and payable to them in like manner and subject to the like contingencies benefit of survivorship restrictions limitations and conditions as hereinbefore mentioned expressed and declared concerning the said principal sum of two thousand pounds and the stocks Funds and securities of and belonging to the same herein before given and bequeathed to and for their use and benefit as hereinbefore expressed
and if all my said grandchildren shall happen to die under the said age of twenty one years and without lawful issue then I direct that the said sum of one thousand pounds and the stocks Funds and securities in or upon which the same shall be laid out or invested and all the dividends interest and proceeds thereof shall sink into and become part of the residue of my personal estate

Also I give and bequeath the sum of one hundred pounds three per cent Reduced? Bank Annuities part of the sum of two hundred pounds … Red’d Bank Ann’s now standing in my name in the books of the Governor and Company of the Bank of England unto the Trustees of the Charity Schools called the Blue Coat Schools of and belonging to the Parish of Maidstone aforesaid for the instruction of children according to the principles of the established Church of England to be paid and applied by them and the person or persons having the direction and management of the Funds for supporting the said Charity Schools in and for the use benefit and advantage of the same

Also I give and bequeath the like sum of one hundred pounds three per cent reduced Bank Annuities being the remainder of the said sum of Two hundred pounds three per cent reduced Bank Annuities unto the Trustees of Charity Schools called the Sunday Schools of and belonging to the said parish of Maidstone for the instruction of Children according to the said principles of the Established Church of England to be paid and applied by them and the person or persons having the direction and management of the funds for supporting the said Sunday Schools in and for the use benefit and advantage of the same

And as to all the rest residue and remainder of my monies and securities for money Goods Chattels Effects and personal estate whatsoever & wheresoever I give and bequeath the same and every part thereof unto and to the use of my said daughter Ann Hollingworth her Executors Admo’rs & assigns absolutely and for ever provided always and I do hereby order and direct that it shall and may be lawful to and for my said daughter Ann Hollingworth her Executors & admo’rs from time to time and at all times to deduct and retain to herself and themselves respectively out of the monies which shall come to her or their hands by virtue of this my will all such loss costs charges damages and expences as she or they shall or may pay bear sustain or be put unto for or by reason or means of the Trusts herein contained or the execution thereof or any wise relating thereto and that she or they shall not be answerable or accountable for any more monies than she or they shall actually receive nor with or for any loss or losses which shall or may happen in or to the said Trust monies and premises unless the same shall be or happen by or thro her or their wilful neglect or default And lastly I do hereby revoke all former wills by me made and declare this only to be my last Will and Testament In Witness whereof the said John Green the Testator have to this my last will and testament contained in five sheets of paper to each sheet thereof set my hand and to this last affixed my seal this twenty fourth day of August in the year of Our Lord one thousand eight hundred and seven – John Green – Signed sealed published and declared by the said John Green the Testator as and for his last will and testament in the presence of us who in his presence at his request and in the presence of each other have hereunto subscribed our names as witnesses –

This is a Codicil to and to be taken as part of the last Will & Testament of me John Green of Maidstone in the County of Kent Gentleman whereas I have in and by my said will which bears date on or about the twenty fourth day of August now last past after giving devising and bequeathing as therein particularly expressed given and bequeathed unto my daughter Ann Hollingworth hereinbefore named the principal Sum of one thousand pounds of lawful money of the United Kingdom of Great Britain and Ireland as current in England upon trust with all convenient speed after my decease to lay out and invest the said sum of one thousand pounds in her name or in some or one of the public stocks or Funds of this Kingdom or in Government or real Security or Securities and to stand possessed thereof upon trust to transfer and assign the said stocks Funds and Securities and the monies therein invested unto my Grandson Thomas Pope the son of my late daughter Elizabeth Pope deceased by Thomas Blissett Pope of Maidstone aforesaid Gentleman when and so soon as my said Grandson Thomas Pope should attain the age of twenty one years and I have thereby directed that the whole of the Interest dividends and annual proceeds of the said Stocks Funds and Securities should in the mean time and until the said principal sum of one thousand pounds so to be invested as aforesaid shall become due and payable be suffered to accumulate and be applied to the most advantage for the benefit of my said Grandson Thomas Pope and should not be paid or payable until the said principal sum of one thousand pounds should become due and payable as aforesaid and if it should happen that my said Grandson Thomas Pope should die under the said age of twenty one years without issue lawfully begotten then upon trust to pay transfer and assign the said Stocks Funds and Securities wherein the said principal sum of one thousand pounds shall be laid and invested as aforesaid unto my Grand Children Robert Hollingworth Dennis Hollingworth and Mary Hollingworth deceased herein before named in equal parts shares and proportions to be paid and payable to them as therein particularly expressed

now therefore the said John Green the Testator do by this Codicil to my said last will and testament revoke annul and make void the said legacy or bequest of one thousand pounds in and by my said last will and testament given and bequeathed unto or upon trust for the use and benefit of my said Grandson Thomas Pope and also in the event of his dying under the age of twenty one years without issue lawfully begotten as hereinbefore mentioned by my said will given and bequeathed unto or upon trust for my said (grand) children Robert Hollingworth Dennis Hollingworth and Mary Hollingworth the three children of my said late daughter Mary Hollingworth deceased to all intents constructions and purposes whatsoever and declare the same to be null invalid and of no effect

And I do hereby give and bequeath unto the said Thomas Blissett Pope the Father of my said Grand Son Thomas Pope the sum of one thousand pounds of lawful money of the United Kingdom of Great Britain and Ireland current in England being the same sum of one thousand pounds now due and owing from the said Thomas Blissett Pope to me and to which he pays me Interest upon trust that the said Thomas Blissett Pope his Executors or Administrators shall and do pay and apply the dividends interest and annual proceeds thereof unto and for the maintenance education and benefit of my said Grandson Thomas Pope until he shall attain the age of twenty one years and when and so soon as my said Grandson Thomas Pope shall have attained his said age of twenty one years then upon trust to pay transfer or assign the said principal Sum of one thousand pounds unto my said Grandson Thomas Pope his Executors Admo’rs or assigns

but if it shall happen that my said Grandson Thomas Pope shall die under the age of twenty one years and without issue lawfully begotten then in that case I give the principal sum of five hundred pounds part of the said sum of one thousand pounds now in the hands of the said Thomas Blissett Pope for which he pays me Interest and by me given and bequeathed to him for the use and benefit of my said Grandson Thomas Pope as aforesaid unto the said Thomas Blissett Pope as and for his own proper monies absolutely and for ever

and the other or remaining principal sum of five hundred pounds being the residue of the said sum of one thousand pounds I give and bequeath unto and for the use and benefit of my said Grandchildren the said Robert Hollingworth Dennis Hollingworth and Mary Hollingworth the three children of my said late daughter Mary Hollingworth deceased in equal parts shares and proportions to be paid & payable to them in like manner and subject to the like contingencies benefit of survivorship restrictions limitations and conditions as are mentioned expressed and declared concerning the principal sum of two thousand pounds and the Stocks Funds and Securities of and belonging to the same which I have given and bequeathed to and for their use and benefit in and by my aid last Will and Testament

And I do hereby in all other parts and respects ratify and confirm my said last Will and Testament In Witness whereof I the said John Green the Testator have to this Codicil to my last Will and testament contained in three sheets of paper to each sheet thereof set my hand and to the last sheet affixed my seal this ninth day of January in the forty eighth year of the Reign of our Sovereign lord George the third by the Grace of God of the United Kingdom of Great Britain and Ireland King Defender of the Faith and in the year of our Lord one thousand eight hundred and eight – John Green – Signed sealed published and declared by the said John Green the Testator as and for a codicil to and to be taken as part and parcel of his last will and testament in the presence of us who in his presence at his request and in the presence of each other have subscribed our names as witnesses

This will was proved at London with a Codicil the second day of November in the year of our Lord one thousand eight hundred and eight before the Worshipful John Stoddart Doctor of Laws and Surrogate of the Right Honorable Sir William Wynne Knight also Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the oath of Ann Hollingworth wife of Finch Hollingworth Esquire the daughter of the deceased and the sole Executrix named in the said will to whom Admon was granted of all and singular the Goods Chattels and Credits of the said deceased having been first sworn duly to administer.

On the 22nd day of Dec. 1817 Admon (with the Will and Codicil annexed) of the Goods Chattels & Credits of John Green late of Maidstone in the County of Kent Esq’r dec’d left unad’d by Ann Hollingworth dec’d whilst living … sole Ex’x and Residuary Legatee named in the said Will was granted to Finch Hollingworth Esq’r the Husband and Adm’or of the Goods of the said Ann Hollingworth dec’d having been first sworn by Com’on duly to adm’r. The said ex’x dying Intestate.
