Will of Richard Gillbee

In the Name of god Amen I Richard Gillbee of Saint Thomas Street in the parish of Saint John Southwark in the County of Surry Gentleman being of sound and disposing mind and memory Do make my last Will and Testament in manner following that is to say First I order and direct that all my just Debts be fully paid and satisfied and after ;and subject to the payment thereof and of my funeral and Testamentary Expenses I dispose of my Estate and Effects as follows viz

I give and devise all that my freehold messuage or tenement with the Appurtenance situate in Love Land in the parish of Saint Mary Rotherhithe in the County of Surry unto my wife Mary Gillbe and her assigns for and during the term of her natural life and from and immediately after her decease I give and devise the said messuage or tenement with the appurtenances unto my Nephew Thomas Gunston and his heirs and assigns for ever

Item I give devise and bequeath my leasehold messuage or Tenement with the appurtenances situate in Thomas Street aforesaid wherein I now dwell to my said wife Mary Gillbee and her assigns from and after my decease for and during so my of the term then to rent? In the lease thereof as shall run out and expire during her natural life subject to the payment of the Rent and Performances of the Covenants in the said Lease contained from thereforth to be paid and performed and from and after the decease of my said wife I give and devise the same leasehold messuage or Tenement and premises together with the lease thereof and all benefit and advantage to arise or be made thereby for and during all the residue of the term thereof to come and unexpired unto my said Nephew John Gunston his Executors administrator and assigns to and for his and their own use and benefit.

Item I give and bequeath the Interest or Dividends of the several and respective stocks or sums of money following viz the interest or dividends of eight hundred pounds three per cent reduced Bank annuities in the Interest and dividends of six hundred pounds and four hundred pounds three per cent consolidated Bank Annuities The Interest and dividends of six hundred pounds and two hundred pounds three per cent reduced Bank annuities and also the Interest and dividends of three hundred and two hundred and fifty pounds four per cent consolidated Bank annuities unto my said wife Mary Gillbe and her assigns for the during the term of her natural life and from and after her decease I give and bequeath unto my Nephew Richard Gillbee incase he shall survive my said wife the Interest and dividends of the said sum of Eight hundred pounds three per cent reduced Bank Annuities for and during his natural life (and from and after the decease of the survivor of them my said wife Mary Gillbee and Nephew Richard Gillbee) I give and bequeath the said principal sum of eight hundred pounds three per cent reduced Bank Annuities and all dividends and Interest thereof unto Humphry Gillbee son of my said Nephew Richard Gillbe in case he shall be living at the death of such survivor then I give and bequeath the said eight hundred pounds three per cent reduced Bank Annuities unto my said nephew John Gunston his executors administrators and Assigns.

Item I give and bequeath to my Nephew Nicholas Gillbe the said principal sum of six hundred pounds three per cent consolidated sum of six hundred pounds three per cent consolidated Bank Annuities and also the said principal sum of two hundred pounds three per cent reduced Bank Annuities provided always that if the said Nicholas Gillbe and Mary Gillbe or either of them shall happen to die in the lifetime of my wife Mary Gillbe then I give and devise the said principal stocks or securities so given to him her or them so dying unto my said Nephew John Gunston his Executors administrator and Assigns

Item from and after the decease of my said wife I give and bequeath unto my Neice Sarah Cook and her assigns int Interest and dividends of the said six hundred pounds three per cent reduced Bank Annuities and also the dividends and interest of the said principal sum of three hundred pounds four per cent consolidated bank annuities for and during the term of her natural life and from and after he decease I give and bequeath the said six hundred pounds and three hundred pounds Bank annuities unto my said Nephews Thomas Gunston and John Gunston equally to be divided between them share and share alike and to their respective Exor and Admons and assigns

Item from and after the decease of my said wife I give and bequeath unto my Brother in Law John Gunston the Elder the Dividends and Interest of the said principal sum of two hundred and fifty pounds four per cent consolidated Bank Annuities for and during the term of his natural life and from and after his decease I give and bequeath the said principal sum of two hundred and fifty pounds unto my said Nephews Thomas Gunston and John Gunston and my neice Ann Gunston equally to be divided between them share and share alike and to their respective Executors Administrator and Assigns.

Item I give and bequeath my one fourth and one sixteenth parts of and in the Britannia Sloop trading to Dunkirk and of all things belonging thereto unto my said wife Mary Gillbe and her assigns for and during the term of her natural life and form and after her decease I give and bequeath my said One fourth and one sixteenth parts of and in the said Sloop unto John Stainbank of the parish of St Mary Magdalen Bermondsey in the county of Surry mariner

Item I give and bequeath in my one third part or share of and in the Eagle Sloop trading to Calais and my two seventh parts or shares of and in the Calais Packet trading to Calais aforesaid and of all things belonging thereto respectively unto my said wife Mary Gillbee and he assigns for and during the term of her natural life and from and after her decease I give and bequeath the said one third part of share of and in the said Sloop called the Eagle Sloop and my said two seventh parts of shares of and in the said packet called the Calais Packet and all things belonging thereto respectively unto my said Nephew Richard Gillbe his Executors Administrators and Assigns to and for his and their own use and benefit

and all the rest residue and remainder of my monies securities for money in the public funds household goods furniture plate china and lines estate and effects of what nature kind so ever the same may be I give and bequeath the same unto my said wife Mary Gillbe he executors and Admons to and for her and their own use and benefit and I make and appoint my said wife Mary Gillbe my said Nephew John Gunston and Thomas Dandy of the parish of St Mary Magdalen Bermondsey in the said County of Surry Victualler Executrix and Executors of this my will and I hereby order and direct that my said Executrix and Executors shall not be answerable or accountable for any Involuntarily loss that may happen to my Estate of Effects and that they shall not be answerable for the ? deed of default of the other or others of them but each for her and his own deed and default only and that it shall be lawful for them to reimburse satisfy and pay themselves respectively and his her or their Executors or Executors all own costs charges damages and expenses he she or they shall respectively be put into for or by reason or means of the said executorship or any thing relating thereto

hereby revoking all former wills by me made I declare this to be my last will and Testament In witness whereof I have to the first two sheets? of this my will the whole contained in three sheets of paper set my hand and to the last sheet thereof set my hand and seal this tenth day of June One thousand seven hundred and seventy-four. Richd Gillbe signed sealed published ad declared by the said Testator as and for his last will and Testament in the presence of us who at his request and in the present of each other have subscribed our names as witnesses to the ? execution hereof the three lines in the first sheet being first obliterated.

I Richard Gillbee the Testator named in my will hereunto annexed do make this present writing a codicil to and part and parcel of my said last will and Testament that is to say Whereas I had in my said will after the decease of my wife Mary Gillbe given and devised my leasehold messuage or Tenement with the appurtenances situate in Thomas Street in the parish of St John in Southwark where in I now dwell unto my Nephew John Gunston his Exors Administrators and assigns Now I do hereby revoke and make void the devise of the said Messuage or Tenement and premises unto my said Nephew John Gunston after my said wife’s death and I do from and after the decease of my said wife Mary Gillbe hereby give and devise my said leasehold messuage or tenement and premises together with the lease thereof and all benefit and advantage to arise or be made thereby for and during all the residue of the term thereof then to come and unexpired unto my sister Susannah Gillbe wife of Thomas Gillbe of Dover in the County of Kent Salesman her exors and administrators and assigns any thing in my said will contained to the contrary thereof in any wise notwithstanding

and whereas I had in my said will appointed Thomas Dandy of the parish of St Mary Magdalen Bermondsey in the County of Surry victualler to be one of the executors thereof I now exclude and debar the said Thomas Dandy from being an Executor thereto and in the room and stead of the said Thomas Dandy I do hereby nominate and appoint my cousin Mr William Gillbee of Walworth in the said County of Surry Gentleman to be an Executor of my said last Will and Testament jointly with my said wife Mary Gillbee and my Nephew John Gunston any thing in my said will contained to the contrary notwithstanding and I ratify and confirm my will hereunto annexed in all other respects

In witness whereof I the said Richard Gillbe the testator have hereunto set my hand and seal the sixth day of September in the year of Our lord One thousand seven hundred and seventy four Richard Gillbe signed sealed published and declared by the said Richard Gillbe the Tesator for and as part and parcel for his last Will and Testament n the presence of us

This will was proved at London with a codicil the 30th day of September 1774

On the 27th Oct 1807 John Gunston replaced by Thomas Gunston his administrator, John Gunston the surviving exor dying intestate.
