Will of Aaron Martin Cramp

This is the Last Will and Testament of me Aaron Martin Cramp of Bromstone in the Parish of Saint Peter the Apostle in the Isle of Thanet in the County of Kent Gentleman
First I desire that my remains be interred in the parish of Littlebourn in the said County of Kent in the same grave with my late dear wife

I give and bequeath to my Brother Peter Cramp and his assigns during the term of his natural life an annuity or clear yearly sum of two hundred pounds of lawful money of Great Britain
and from and after his decease in case Sarah Cramp his present wife shall happen to survive him then give a bequeath to the said Sarah Cramp and her assigns during the then residue of her natural life a like annuity or clear yearly sum of two hundred pounds of like money

I give and bequeath to my brother Richard Cramp and his assigns during the term of his natural life an annuity or clear yearly sum of one hundred pounds of like money

To Mrs Elizabeth Hodgman wife of Mr Thomas Hodgman now my housekeeper and her assigns during the term of her natural life for her sole and separate use independent of her said husband a like annuity or clear yearly sum of one hundred pounds of like money
and from and after her decease in case the said Thomas Hodgman her husband shall happen to survive her then I give and bequeath to the said Thomas Hodgman and his assigns during the then residue of his natural life an annuity or clear yearly sum of fifty pounds of like money

To Mrs Mary Franklyn my late housekeeper and her assigns during the term of her natural life an annuity or clear yearly sum of forty pounds of like money
To the Rev. George Townsend of Ramsgate and his assigns during the term of his natural life an annuity or clear yearly sum of twenty pounds of like money

and to Abraham Austen my bailiff in consideration of his long and faithful services and his assigns during the term of his natural life a like annuity or clear yearly sum of twenty pounds of like lawful money over and above any sum which may be due to him for wages at the time of my decease

all which several annuities I will and direct shall be paid to the annuitants thereof respectively by equal half yearly payments the first half yearly payment thereof respectively except the said annuities to the said Sarah Cramp and Thomas Hodgman in case they or either of them shall become payable to begin and be made on either the fifth day of January the fifth day of April the fifth day of July or the tenth day of October which ever shall first happen next after my decease and the first half yearly payment of the said annuities to the said Sarah Cramp and Thomas Hodgman respectively in case they or either of them shall become payable to begin and be made on such of the before mentioned days as shall first happen next after the several deceases of the said Peter Cramp and Elizabeth Hodgman respectively

and I do hereby subject and charge all that my Messuage Farm and Lands at or near Haine in the said Isle of Thanet now in the occupation of Philpott and my Messuages Buildings and Land at Fair Street in the said parish of Saint Peter the Apostle purchased of Thomas Wilcocks to and with the payment of the said annuities to the said Peter Cramp and Sarah his wife respectively with power for them respectively in case the annuity hereby bequeathed to them respectively shall be in arrear or unpaid by the space of thirty days next after any half yearly payment thereof to enter upon the said Messuages Farm and Lands and to distrain for all arrears of same annuities respectively in the same manner as in cases of distress for Rent in arrear

and I do direct that my Executors hereinafter named shall set apart and appropriate and lay out and invest in the Public Funds or on Real Securities or continue upon such securities with power to alter vary and transpose such funds or securities from time to time as occasion shall require such part of my personal Estate as shall be sufficient from the dividends and interest thereof to satisfy and discharge as well such portion of the said annuities to the said Peter Cramp and Sarah his wife respectively as the said Messuages Farm and Lands so charged therewith shall not extend to satisfy and discharge as also all the several other annuities hereinbefore by me given and bequeathed during the continuance of the same respectively

I give and devise all those my Messuages or Tenements with the Land and appurtenances belonging thereto situate at Cladingbolds in the said parish of Saint Peter the Apostle late of the Estate of Thomas Quested unto and to the use of the said Thomas Hodgman and Elizabeth his wife during their joint natural lives and to the survivor of them during his or her life
and after the decease of such survivor I give and devise the same unto and to the use of Thomas Hodgman son of the said Thomas Hodgson [sic] and Elizabeth his wife and his assigns for and during the term of his natural life
and from and after his decease I give and devise the same unto and to the use of all and every the child and children as well male as female of the said Thomas Hodgman the son equally to be divided between them if more than one as Tenants in Common and not as joint Tenants and if but one then to such only one and to the heirs and assigns of such child or children respectively for ever
and in default of issue of the said Thomas Hodgman the son I give and devise the same Messuages or Tenements Land and premises in such manner as I have hereinafter given and devised the Residue of my Real Estate

I give and bequeath to Martin Cramp Tolputt Grandson of my said late brother Martin in token of remembrance the sum of one hundred pounds of lawful money of Great Britain
and to Edward Dering of Margate Gentleman in acknowledgement of his friendly services and attention on my behalf at different times and on various occasions the like sum of one hundred pounds of like money

and to my nephews Thomas Cramp Son of my said late brother Martin and John Cramp of Garlinge and the said Edward Dering my Executors hereinafter named in consideration of the trouble they may respectively have in the trusts and execution of this my will the sum of fifty pounds apiece of like lawful money

nevertheless my will and desire is that such several legacies to the said Edward Dering shall not be considered as excluding him from such reasonable professional charges as he may be entitled to make against my Estate subsequent to my decease all which several before mentioned legacies I will and direct shall be paid to the Legatees thereof respectively within six calendar months next after my decease

I also give and bequeath to such domestic and farm servant and labourer who shall be in my service at the time of my decease the sum of five pounds of lawful money of Great Britain to be paid to them respectively over and above any sum which may then be due to them for wages as soon as conveniently may be after my decease

and I further will and direct that the said Thomas Cramp John Cramp and Edward Dering my Executors hereinafter named shall and do within six calendar months next after my decease lay out and invest in some or one of the public stocks or funds of this Kingdom or good real securities such part of my personal Estate as will be sufficient by and out of the dividends and interest thereof to raise the clear yearly sum of thirty pounds of lawful money of Great Britain without deduction for legacy duty or any other charges or otherwise shall and do set apart and appropriate such portion of the real securities upon which my personal Estate may be at the time of my decease be invested as will be sufficient to produce such yearly sum

and my will is that my said Trustees and Executors ad the Survivors and Survivor of them and the Executors of Administrators of such Survivor and the trustees to be hereafter appointed pursuant to the power hereinafter contained shall stand possessed of such funds or securities with power nevertheless to alter vary and transpose the same from time to time as occasion shall require upon trust
as to two third parts of the dividends and interest yearly to arise grow due and be received in respect of the same funds or securities to pay apply and dispose of the same in aid and support of the meetinghouse or House of Divine Worship established by the said Thomas Cramp in the said parish of Saint Peter the Apostle
and as to the remaining one third part of such dividends and interest to pay apply and dispose of the same in aid and support of the Meeting house or house of Divine Worship established by Mr. Thomas Christophers at Broadstairs
either by way of stipend to the respective Ministers for the time being officiating at the said Meeting houses respectively on in such other manner as the said Thomas Cramp John Cramp Edward Dering or the trustees of trustee for the time being [next couple of lines struck out] of the said trust fund shall think proper yearly for ever provided the Gospel be continually preached in the same Meetinghouses respectively but in case the said Meetinghouses shall at any time hereafter cease to be used as and for places of Divine Worship then upon trust to pay apply assign and transfer the whole of the said trust funds or if only one of the said Meeting houses shall cease to be so used then such portion of the principal of the said trust funds in respect of which the proportion of the dividends and interest would be applicable for the support of the Meeting House so ceasing to be used as aforesaid to such person or persons as shall then be my next of kin

and in order more fully to give effect to my will in this respect and to insure a continuance of the same I do hereby order and direct that upon the death of any two of them the said Thomas Cramp John Cramp and Edward Dering the survivor of them his executors or administrators shall and do forthwith by writing under his hand and seal nominate and elect four other persons inhabitants of the said parish of Saint Peter the Apostle to be joined with him in the trust and shall thereupon transfer and assign the said trust funds into the names of such new trustees together with himself and who shall by the same deed or writing declare the trusts thereof conformably to this my will and particularly with power for the appointment of future new trustees whenever the number of new Trustees so to be first nominated and elected as before mentioned shall be reduced to two and also with power to the trustees for the time being acting in execution of the said trusts to deduct and claim out of the said dividends and interest all charges and expenses incident to the execution of the said trusts and subject to the several annuities to my said Brother Peter Cramp and Sarah his wife respectively

I give and devise all those my Messuages or Tenements farm Buildings and Lands at Haine and Fair Street respectively and subject to the several other annuities all other my Messuages Lands Tenements hereditaments and Real Estate whatsoever and wheresoever not hereinbefore by me otherwise disposed of unto and to the use of my said nephews the said Thomas Cramp Son of my said late Brother Martin and John Cramp and Thomas Cramp and George Cramp Sons of my said Brother Peter equally to be divided between them as Tenants in Common and not as joint Tenants and to their several and respective heirs and assigns for ever
and subject to the several annuities and legacies hereinbefore by me given and bequeathed and to the investment or application hereinbefore directed to be made

and also after and subject to the payment of all my just debts and funeral and Testamentary charges and expences I give and bequeath all my monies securities for money effects goods chattels and personal Estate whatsoever and wheresoever unto my said four nephews equally to be divided between them share and share alike and to their respective Executors administrators for their own absolute use and benefit

provided always nevertheless and my will and mind further is and I do hereby expressly declare and direct that in case any person entitled to any benefit under this my will shall call in question or dispute the direction hereinbefore given for the investment in support of the several Meetinghouses before mentioned or shall by any means prevent or hinder the execution of the trusts hereinbefore in that behalf declared such person shall be thereupon absolutely and wholly deprived of all and every benefit to which he would otherwise be entitled under this my will and thenceforth the share or interest of such person shall go and be applied in such manner as the same would have gone and been applied in such manner as the same would have gone and been applied if such person had not been named in this my Will

and I do nominate and appoint my said nephews Thomas Cramp Son of my said late Brother Martin and John Cramp and the said Edward Dering Executors of this my will
and I do hereby declare and direct that my said trustees and Executors respectively and their respective heirs Executors and Administrators shall not be answerable or accountable for any more monies than they shall respectively actually receive their joining in Receipts for conformity notwithstanding nor with or for any loss which shall happen of the said trust monies so as the same happen without their respective wilful neglect or default and that they may respectively deduct retain to and reimburse themselves respectively and also reimburse their respective co trustee all such costs charges damages and expenses as they shall respectively suffer sustain expend or be put unto in or about the Trusts and execution of this my will or in relation thereunto

and lastly I do hereby revoke all forrmer wills by me made
In Witness whereof I the said Aaron Martin Cramp the Testator have to each of the first four of these five sheets of paper which together contain my Will set my hand and to this fifth and last sheet thereof my hand and seal this twenty second day of January in the year of our Lord one thousand eight hundred and twenty six
