Will of Thomas Cooper

This is the last and only Will of me THOMAS COOPER of Bramling Court of Ickham in the County of Kent Farmer.

I appoint my dear wife ANN COOPER and my sons JOHN COOPER and WILLIAM COOPER to be Executors and Trustees of my Will.

I give to my grandson HENRY THOMAS HESTER the son of my deceased daughter MARGARET ELIZABTH HESTER if he gain his majority one hundred pounds.
And if he shall attain the age of twenty one years during the lifetime of my said wife the same shall be paid to him within six calendar months after her decease.
And I direct that until my said grandson shall attain the age of twenty one years the Trustees or Trustee for the time being of my Will shall not be called upon or required to set apart out of my Chattels and Effects any part thereof to satisfy said presumptive legacy or be required to invest the same.

I give and bequeath all my monies securities for money household goods and furniture plate linen books china and other household effects whatsoever horses saddles harnesses and other accoutrements and also all my other implements of husbandry crops of corn and grain and live and dead stock whatsoever which shall be my property and in or about the Messuage Farm and Hereditaments which I shall occupy at my death unto my said wife and the said JOHN COOPER and WILLIAM COOPER their Executors Administrators and Assigns subject to the payment of all my just debts funeral and testamentary expenses and to the said presumptive legacy of one hundred pounds Upon Trust.
That they or the survivors or survivor of them or other the Trustees or Trustee for the time being of this my Will will during the lifetime of my said wife carry on the business of my said farm with the full power to cultivate and manage the same in manner as the said Trustees or Trustee shall think fit. And to sell or dispose of all or any part of the stock and produce of the said farm. And to purchase cattle and other articles to supply the place if the cattle or other articles which shall be sold from time to time as aforesaid or which shall be necessary to carry on the business of my said farm. And with the power to increase or diminish the stock thereof and to employ such Bailiffs and other servants and labourers as my said Trustee or Trustees for the time being shall see occasion and at such salaries or wages and with such powers and authorities and confidence or trust to be reposed in him her or them respectively as shall be deemed advisable or expedient.

And I direct that my said wife shall enjoy for her natural life all my household furniture and other household effects that shall be in and about the house in which I may happen to reside at the time of my decease.

And I direct that the profit that shall arise from my said farm during the time the same shall be so carried on as aforesaid (after paying the cash of repair and improvements and of insuring against fire the payments of the sum of twenty five pounds per annum to each of my said sons WILLIAM COOPER and JOHN COOPER for their trouble on the said business and their expenses of their board and lodging so long as they shall so carry on and manage the said farm and other the charges and expenses to be incurred in the execution of the aforesaid Trusts).

And the Interest Dividends and annual produce to arise from my monies and Securities for money shall be paid to or retained by my said wife during her life for her absolute use and benefit.

And subject and without prejudice to the Trusts hereunto before explained I direct that my said Trustees or Trustee for the time being shall stand possessed of all the monies securities for money household furniture effects and premises herein before bequeathed to them and also of all such crops live and dead stock and effects as shall be purchased from time to time in lieu or to supply the place of the stock or effects which shall be sold or otherwise disposed of In Trust for such child or children of mine as shall survive me and attain the age of twenty one years or leave issue or being a daughter or daughters shall attain that age or marriage.
And such child or children of any child or children of mine dying before me as shall survive me and attain the age of twenty one years or leave issue or being a girl or girls attain that age or marriage or marry in equal shares but so that the child or children collectively of any deceased child of mine shall take only the share which such deceased would have taken if living.

And I hereby expressly except out of this present Trust and disposition of my said personal and Testamentary Estate my grandson HENRY THOMAS HESTER.

I devise all the Real Estates vested in me mortgagee or Trustee to my said Trustees their heirs and assigns subject to the Trusts and equities affecting the same respectively.
I declare that the receipts of the Trustees or Trustee for the time being of my Will shall effectually exonerate mortgages and others paying monies to such Trustees or Trustee from all liability in respect of the application thereof I empower the Trustees or Trustee for the time being of my Will to nominate in writing any person or persons to supply the place of any Trustees or Trustee of my Will who shall die disclaim or become unwilling or unable to act when and so often as a vacancy or vacancies shall occur. And on every such appointment the necessary assurances shall be executed for vesting my Trust Estate in the New and Old Trustees. And I absolve the Trustees and Trustee for the time being of my Will from responsibility for the receipts and defaults of each other and for involuntary losses and also authorise such Trustees and Trustee to retain and allow to each other all expenses incurred in or about the execution of the Trusts of my Will.
