Will of Sarah Beale

of Tenterden, Kent

This is the last will and testament of me Sarah BEALE of Tenterden in the county of Kent, spinster made and published the twenty first day of September in the year of our Lord one thousand eight hundred and twenty seven.

First I appoint my three brothers-in-law, Thomas WILDISH, Jacob KINGSNORTH and William WESTON executors of this my will and I direct them in the first place to pay and satisfy all my debts, funeral, testamentary and other incidental charges and expenses.

I desire to be buried in the church yard of the parish of Appledore in the said county of Kent and such grave to be well drained and that a thick, board be placed upon the (?) (?) (?) of my coffin and that my coffin be made of heart of oak, and that at stone be placed over my grave with the head and foot stones and a suitable inscription to my memory.

I give and bequeath my picture of my late Uncle Richard BEALE with my Brother Seaman BEALE for the term of his natural life and after his decease I give the same unto my sisters, Mary WILDISH, Harriett KINGSNORTH and Louisa WESTON respectively in succession for the terms of their respective natural lives. And after the death of the survivor of my said brother and sisters, I give the same unto my brother Richard BEALE absolutely if then living, but if he shall be then dead, unto his oldest son absolutely.

(Marginal Note: April 2nd 1836. These six lines respecting my uncle's picture, I revoke and give the said picture to Jacob KINGSNORTH and his heirs forever. Sarah BEALE.)

I give and bequeath unto the said Mary WILDISH one table spoon marked with my family crest and two table spoons marked with my family crest and a pair of stone carvings and the profile of my late cousin Ann WILMOTT.

Also I give unto the said Harriett KINGSNORTH my gold mourning ring and mahogany stand and my dressing table chest of drawers.
Also I give unto the said Louisa WESTON my gold ring set with pearls.

And I give unto my nephew Jacob KINGSNORTH my gold watch with the chain and seals and gold key and my gold pearl brooch together with my prayer book and book of sermons and sacrament book and Dinarbas a Tale. *

Also I give unto my niece Ann KINGSNORTH my bracelets and earrings and six tea spoons marked with the letters SB and my large Bible and small prayer book.
And I give and bequeath all the rest of my books unto my nephews Edward DAVIS and William DAVIS to be equally divided between them.

Also I give unto Sarah Ann BEALE, daughter of my nephew Richard BEALE a pair of tea tongs.
And unto my niece Miriam WESTON the half dozen tea spoons my brother and sister Weston gave me marked SB.

I give unto my friend Elizabeth ADAMS, sister of Thomas ADAMS of Appledore, Gentleman, the use of my writing desk during her natural life and all the letters that may be found therein which letters I direct her to destroy.
And after her decease I give the said writing desk unto my Godson Edwin Stace ADAMS, son of the said Thomas ADAMS.
And I also give unto the said Elizabeth ADAMS a mourning ring.
Also I give to God daughter, Elizabeth ADAMS, my handle work box.

Also I give and bequeath unto my said three sisters, Mary WILDISH, Harriett KINGSNORTH, and Louisa WESTON to be equally divided among them all my wearing apparel and also my household goods and furniture and implements of household, plate, linen and china (not hereinbefore otherwise disposed of) and I direct that the same shall not be sold by my Executors but equally divided between my said three sisters within six months after my decease and if any difference shall happen to arise between them upon such division such differences shall be referred to some respectable arbitrator to be agreed upon previous to such division whose decision shall be conclusive between them.

And as to all the rest residue and remainder of my goods, chattels, money, securities for money, estate and effects whatsoever and wheresoever which I shall be possessed or entitled unto at the time of my decease I give and bequeath the same unto my said Executors upon trust to place out and invest or continue to the same at interest in such manner as they shall think proper (and to alter and charge such securities as often as they shall deem necessary).

And I direct that my said Executors shall stand possessed of the said trust funds and securities upon trust as to one equal fourth paid thereof to pay and apply the dividends, interest and income thereof with my brother Seaman BEALE for the term of his natural life.
And from and immediately after the decease of my said brother, upon trust to pay, assign and transfer the principal of the said fourth part of the said trust monies unto between and among all and every the child and children of my late sister, Ann DAVIS who shall be living at the time of my death in equal shares and proportions to be paid and payable as and when they respectively attain the age of twenty one years.

And as to one other equal fourth part of the said trust funds and securities upon trust to pay and apply the dividends, interest and income thereof unto my said sister, Mary WILDISH for and during the term of her natural life for her own sole and peculiar use.
And after her decease upon trust to pay assign and transfer the principal of the last mentioned fourth part of the said trust monies unto between and among all and every the child and children of the said Mary WILDISH in equal shares and proportion to be paid and payable as and when the respectively attain the age of twenty one years.
but in case the said Mary WILDISH shall not leave any child or children, then I give the said last mentioned fourth part unto my two sisters Harriett KINGSNORTH and Louisa WESTON in equal shares and proportions absolutely for ever.

And as to the one other fourth part of the said trust funds and securities upon trust to pay and apply the dividends, interest and income thereof unto my said sister, Harriett KINGSNORTH for and during the term of her natural life for her sole and peculiar use.
And after her decease upon trust to pay her assigns and transfer the principal of the last mentioned fourth part of the said trust monies unto between and among all and every the child and children of the said Harriett KINGSNORTH in equal shares proportions to be payable and paid as and when they shall respectively attain the age of twenty one years.

And as to the remaining fourth part of the said trust funds and securities upon trust there (?) in the first place to pay the sum of one hundred pounds unto my nephew and niece, Jacob William and Ann KINGSNORTH in equal shares as and when they respectively shall attain the age of twenty one years.
And subject thereto upon trust to pay and apply the dividends, interest and income of the said last mentioned fourth part unto my said sister Louisa WESTON for and during the term of her natural life for her sole and peculiar use and after her decease upon trust (half a line of script obliterated) the residue of the principal of the said last mentioned fourth part unto between and among all and every the child and children of the said Louisa WESTON in equal shares and proportions to be payable and paid as and when they shall respectively attain the age of twenty one years.

And I direct and declare that my said Executors and Trustees shall not be answerable the one for the other or others of them or for the acts, deeds, receipts or defaults of the other or others of them or for the signing of receipts for sale of conformity for any involuntary loss.
And that it shall be lawful for them to reimburse themselves respectively and allow to each other all the costs and expenses to be incurred by them in executing this my will.

And lastly I do hereby revoke all former wills and testaments by me at any time heretofore made.
In witness whereof I the said Sarah BEALE have to this my last will and testament contained in this and the preceding sheets of paper set my hand and seal to wit my hand to the bottom of the two preceding sheets and my hand and seal to this second and last sheet and my seal at the top of the said sheets where all the said sheets are fixed together the day and year in the first sheet first written

This is a Codicil to the last will and testament of me Sarah BEALE, spinster, hereunto annexed. Whereas since the date and execution of my will, Mary VENTRISS? (late Mary DAVIS) one of the children of my late sister Ann DAVIS and such legatee under my said will hath departed this life leaving issue and it may happen that some of the other pecuniary legatees or persons entitled to a share of residue absolutely under my said will may depart this life leaving lawful issue,

Now my will is that the issue of the said Mary? and of every such other legatee under my said will so dying shall have and be entitled to the legacy a share of residue which his, her or their parent or respective parents would have had as been absolutely entitled to by virtue of my said will if living at my decease, the issue of every such legatee taking their parents share equally amongst them, if more than one child.

And I do hereby ratify and confirm my said will in all other respects.
In witness whereof I the said Sarah BEALE have to this codicil set my hand and seal this eighth day of January one thousand eight hundred and thirty.

Whereas I, Sarah BEALE, have by my will hereto amended directed the sum of one hundred pounds to be paid to my nephew and niece Jacob William and Ann KINGSNORTH on attaining the age of twenty one years out of the last there mentioned fourth part of residue of my estate,
Now I do hereby revoke the said legacy of one hundred pounds so given or dividends to be paid and my will is that the same shall go remain and be upon the same trusts as are declared of the rest of such fourth part.

In witness whereof I have to this codicil to my will set my hand and seal this thirteenth day of October one thousand eight hundred and thirty.

1831 Nov. 20th I give and bequeath to Robert CURTEIS, Son of Robert CURTEIS of Tenterden, Gent. the sum of five pounds.
I also give to Mr. Joseph MUNN, Solicitor of Tenterden, twenty pounds.
And I also give to Jacob KINGSNORTH the sum of thirty pounds to be paid to each out of the fifty pounds which my nephews KINGSNORTH holds by a note of hand and which I have in my possession and which note of hand is dated Oct. 11th 1834.

1835 March 8th. I revoke the five pounds given at the top of these lines to Robert CURTEIS of Ashenden, Tenterden.

April 2nd 1836. I refer to the fifth part of my will and testament wherein I leave to my sister Louisa WESTON by her wish and desire the sum of five hundred pounds to be given to her for her whole and sole use at my death independent of her husband William WESTON and her children.

But I give and bequeath the said before mentioned picture to my nephew Jacob KINGSNORTH and his heirs forever.

Appeared personally, John Vennall CAISTER of Tenterden in the county of Kent, gentleman and Charlotte FOWLE of Appledore in the said county, spinster, and made oath that they know and were acquainted with Sarah BEALE, late of Tenterden in the county of Kent, spinster, deceased, and also with her manner and character of handwriting and subscription from having frequently seen her write and write and subscribe her name to writings and having now carefully viewed and inspected the paper writings hereunto annexed purporting to be the last will and testament with several codicils of the said deceased and more particularly the codicils hereinafter mentioned to wit, the codicil written in the margin of the first sheet of the said will of the (?) following "April 2nd 1836. These six lines respecting my uncle's picture, I revoke and give the said picture to Jacob KINGSNORTH and his heirs forever. Sarah BEALE." and the codicil written on the back of the third and last sheet of the said will and being in the words and figures following "1830 Jan 8th. They these deponents say that they verify and in their consciences believe the whole body, lines and contents of the said recited codicils with the name or signature "Sarah BEALE" respectively subscribe thereto as aforesaid to be all of the proper handwriting and subscription of the Said Sarah BEALE, the testatrix, deceased.

The before registered will with several codicils annexed of Sarah BEALE, spinster, deceased, was proved this eighteenth day of August 1837 before the Reverend John Perbey FRANCIS, Clerk Surrogate to the Worshipful Sherman Beaumont BURNABY, Doctor of Laws, Official General to the Reverend the Archdeacon of Canterbury lawfully constituted by the oaths of Thomas WILDISH and Jacob KINGSNORTH the surviving Executors named in the said will, they being fist sworn duly to perform the same.
