Will of Edmund Barham

I Edmund Barham late of the Town and Port of Dover in the County of Kent but now of Patrixbourne in the said County Esquire Make publish and declare my last Will and Testament in manner following (that is to say)

I give unto my good Friend Peter Fector of Dover aforesaid Esquire one hundred and forty pounds Long Annuities In Trust that he his Executors and Administrators pay one hundred pounds Per Annum part thereof to my Daughter Sarah the Wife of Mr Waddington for her sole and separate use by half Yearly Payments during her Life taking her own Receipt for the same which shall be a sufficient discharge it being my Will and meaning that this Legacy shall in no respect be Subject to the Debts or Engagements of her present or any other Husband and the first payment to be made on the Receipt of the first Dividend payable after my death

I give devise and bequeath unto my Grandson John Dell his Heirs and Assigns my Freehold Estate and Hereditaments at Painchurch or elsewhere in the County of Essex

I also give unto the said Peter Fector his Executors and Administrators my Freehold house and Estate in Dover aforesaid In Trust to sell the same together or in parcels as soon as may be after my death and after discharging all Principal and Interest due on Mortgage thereof I declare that what shall remain shall be deemed part of the Residuum of my Estate and Effects and that the Receipt the said Peter Fector his Executors and Administrators shall be a sufficient discharge to the Purchaser or Purchasers who shall not be liable or accountable for any Misapplication or Nonapplication of the Purchase Money or any Part thereof

I also direct the said Peter Fector to pay assign and transfer Forty Pounds the remainder of my said Long Annuities to my said Grandson John Dell for his Own use to whom I give the same absolutely

Also I give to Mrs Ann Hall of Hindon in Middlesex Widow ten Pounds per Annum during her Life the first payment to be made at the end of six Months after my decease

Also I give to Captain George Thompson and my Granddaughter Jane Sarah his Wife ten Guineas each for Mourning And to my said Grand Daughter my Gold Repeating Watch

Also I give to my said Grandson John Dell my other Gold Watch together with all my Household furniture Plate Linen China Books Pictures and my Wearing Apparel

Also I give unto my Friends the said Peter Fector Anthony Todd Charles Jackson John Walcot and Thomas Bateman Lane Esquire each a Ring
Also I give unto all the Servants who shall be living with me and my said Grandson John Dell at the time of my death Five Guineas each for Mourning
and to my Servant Henry Cooper if living with me at my death one Years Wages over and above the five Guineas for Mourning

All the Residue of my Personal Estate whatsoever Subject to the payment of one hundred Long Annuities and the said Ten Pounds Per Annum as aforesaid I give devise and bequeath unto the said Peter Fector his Executors and Administrators In Trust that as soon as may be after my death and after deducting thereout every Charge and Expence he may be put to or sustain in the Execution of this my Will he or they may be put to or sustain in the Execution of this my Will he or they divide the same into three equal parts and pay assign and transfer
one third part thereof unto Grandson Robert Dell his Heirs Executors Administrators and Assigns
One other third part thereof unto my Grandson George Dell his Heirs Executors Administrators and Assigns within six Months after my Death
And the Remaining third part thereof unto Grandson Edmund Dell his Heirs Executors Administrators and Assigns at his Age of Twenty one Years and that the Dividends and Interest of such last mentioned third shall in the meantime be paid and applied by the said Peter Fector his Executors or Administrators towards his Education and Maintenance
But in case he die before that Age without Issue that the same be transferred and paid to all his Brothers and his Sister the said Jane Sarah the Wife of the said Captain George Thompson and such other Children as my said Daughter may hereafter have their Heirs Executors Administrators and Assigns respectively in equal Shares and Proportions and the Issue of such of them as shall be then dead the Issues to take no more than their Parent would if living

And after the death of my Daughter Sarah Waddington and the said Ann Hall I give the said one hundred pounds Long Annuities (to be paid to my said Daughter for life as aforesaid) And such part of my Personal Estate as the said Peter Fector his Executors or Administrators may retain for Payment of the said ten Pounds per Annum to the said Ann Hall for life as aforesaid and to all my said Grandchildren and such other Children as my said Daughter may hereafter have by any Husband their Heirs Executors Administrators and Assigns in equal shares at their respective Ages of Twenty one Years and if any of them die before twenty one leaving Issue to their Issues respectively (they taking no more than what would have been the share of their deceased Parent)

And I nominate and appoint the said Peter Fector sole Executor of this my Will (revoking all former Wills by me made) In witness whereof I have hereunto set my Hand and Seal this eleventh day of August in the Year of Our Lord one thousand seven hundred and eighty seven Edm: Barham
