Will of Humphrey Baldwin

In the name of God Amen the fourth day of April in the 21st year of the reign of our sovereign Lord George the Second by the grace of God of Great Britain France & Ireland Ling defender of the faith anno Dom 1748.
I Humphrey Baldwin the older of Ightham in the county of Kent husbandman being in health of body and sound and dispensing mind memory and understanding praised be God do make and ordain this my last will and testament in manner and form following (that is to say)
First and Principally I surrender up my soul into the hands of Almighty God my creator hoping to be saved by and through the only merits and satisfaction of Jesus Christ my saviour and redeemer and my body I commit to the earth to be decently interred and buryed by and at the discretion of my executrix hereafter named.

ITEM I give devise and bequeath all that my messuage tenement or cottage with the lands heredits and appurts thereunto belonging situate lying and being near Ivyhatch in Ightham aforesaid and now in occupation of my son Humphrey Baldwin unto my daughter Ester Baldwin her heirs and assigns for ever she paying thereout the sum of ten pounds unto my daughter Mary Baldwin and I do hereby charge my messuage and lands

I bequeath all those my two messuages tenements or cottages with the lands heredits and appurts and at Sheet Hill in Wrotham in the said county of Kent the estate at Ightham in my own occupation and the other in the occupation of John Joy unto my son Humphrey Baldwin his heirs and assigns for ever.

ITEM I give and bequeath unto my son Humphrey Baldwin the sum of 5
ITEM I give and bequeath unto my grandson Humphrey Baldwin the sum of 5
Which said several sums of 5 shall be retained and paid by my said son Humphrey Baldwin out of the principal and interest money which he shall owe me at the time of death on mortgage.
ITEM I give and bequeath unto my daughter Isabell Hodsoll widow 1/-

ITEM All the rest and residue of my ready money securities for money debts goods chattels and personal estate whatsoever and wheresoever and of what nature and kind soever my debts legacys and funeral expenses being first paid and satisfied I give and bequeath unto my loving wife Elizabeth and I hereby nominate and appoint my said wife Elizabeth guardian of my said daughters Ester & Mary and to have the care custody and education of them until they shall respectively attain their respective ages of 21 years or respective days of marriage which shall first happen (if she my said wife shall so long continue my widow sole and unmarried)
and from and immediately after my wifes death or second marriage which shall first happen I do make nominate appoint my friends George Paisley & William Stone both of Ivy Hatch aforesaid guardians of my said daughters and to have the care custody and education of them respectively during the then residue of the times aforesaid
and that during this? continuance of my wifes guardianship of my said daughters respectively she my said wife shall have receive and take the rents issues and profits of the messuagees lands and heredits hereby devised given and bequeathed to them respectively and therewith or with so much thereof as shall be necessary shall maintain educate and bring up my said daughters respectively as aforesaid and shall not be otherwise accountable for the same or the overpaid thereof
and from and after the termination of my wifes guardianship my will and mind is that the charge of my said daughters education and maintainence shall be born and paid out of the rents and profits of the several messuages lands and heredits hereby given and devised to them respectively and that my said trustees shall be accountable to my said daughters respectively for the surplus thereof

and I do hereby make nominate and appoint my said wife Elizabeth full and sole executrix of this my last will and testament hereby revoking and making void all former wills by me heretofore made.
In witness whereof the said Humphrey Baldwin the testator have to this my last will and testament set my hand and seal the day and year first above written.

Signed sealed and published and declared by the said Humphrey Baldwin the testator to be his last will and testament in the presence of us who in his presence and in the presence of each other have subscribed our names as witnesses hereto.
