James Daugherty

 

One tradition holds that Lt. James Daugherty was born circa 1750 in Charlotte Co VA and died before 24 Dec 1812 in Mercer Co KY.  He married Rebecca Cunningham (date unknown), possibly in Charlotte Co VA.

 

According to a 1969 researcher, Mrs. John Monk, of Washington D.C., James Daugherty was born in Ireland circa 1737, married a Rebecca Cunningham, lived in Virginia, established Daugherty Station in Mercer Co KY in the late 1700's and died there in 1812.  Mrs. Monk estimated that Rebecca died between 1805 - 1812.

 

According to the 1810 census (in which she does not appear in the household), Rebecca (Cunningham) Daugherty died in Mercer Co. sometime before 1810.

 

Based on information in the article "The Doughertys of Kentucky", a James Daugherty first appears in Charlotte Co VA records on Aug 11 1769 when he is recorded as purchasing property on Turnip Creek, site of the first recorded purchase of land by Thomas Dougherty.  Thomas was perhaps the son of a James Dougherty Sr who first appeared in the county records as early as 1752.  On the same day the Turnip Creek deed was recorded (5 Feb 1770), James Dougherty, Margaret Harwood and John Sneed and wife Mary sold land on Louse Creek, which also is near Cub Creek.  It is suggested that Margaret and Mary were sisters of James Daugherty and that they were disposing of the land of their father James Sr.  Based on this circumstantial evidence, it suggests that our James Dougherty Jr. was born about 1750.

 

According to DAR records, James assisted in the American Revolution in Charlottes Co VA  “in the capacity of Patriot”.  He was reimbursed 21 pound sterling for 42 days wagonage, team and driver.

 

His service in the American Revolution is listed in VA Revolutionary Publik Claims Vol I, page 236, Jarrice L. Abercrombie and Richard Slatter.

 

Chronology of Charlotte Co VA Daugherty Records

5 Feb 1770 Deed: James Dougherty, Margaret Harwood and John Sneed and wife Mary sold land on Louse Creek, which also is near Cub Creek…suggesting that Margaret and Mary were sisters of James Daugherty and that they were disposing of the land of their father James Sr.

 

12 Sep 1770 Conveyence/POA: Andrew McConnell of Cumberland Co., PA appointed his "trusty friend, James Dougherty of Charlotte Co to convey title to land owned by McConnell and to receive the money therefor".

 

2 Jan 1771 Deed: William Cunningham deeded land to his son-in-law, James Dougherty, a wheelright.  James had married William's daughter, Rebecca Cunningham.  James also served as the executor of his father-in-law's estate in 1780.

 

Chronology of Mercer Co KY Daugherty Records

Sometime between 1780 and 1785 the family removed to KY, settling in the old Lincoln Co KY area that is Mercer Co KY today.  The first Mercer Co KY county records mentioning James Daughtery comes from the old court order's book of this county:

 

27 Jan 1790, page 457: James and William Dougherty were ordered, among many others, to help keep the road in repair from Salt River to Danville. 

 

23 Mar 1791, page 156: James Daugherty recorded at court his stock mark, a crop, slit and under nick in the left ear, and an underkeel in the right ear.

 

24 May 1791, page 181: James Daugherty set on the jury in the case of Hananiah Lincoln vs. Christopher Bryant.

 

25 Oct 1791, page 274: James Dougherty produced a license permitting him to practice as an attorney at law and took the oaths.

 

23 Jan 1793, page 458: Several men were named to view a way for a road from Harrodsburg to James Dougherty's on the head of Salt River.

 

9 Apr 1794-Clark's Mercer KY Tax List: Lists James Daughterty with this taxable property: 14 blacks, horses and mares &c., 12 - 41; 422 acres of land in Mercer Co. located on the Salt River. White males listed in household; 1 over 21, 3 over 16 and under 21.

 

According to Daugherty researcher Jackie Kimberlin Higdon (who provided much of the information here), James Daugherty's land location would lay just east of the present day town of Danville in Boyle Co.  James also owned 85 acres of land in Washington Co., KY, which was located on the Beach (Beech) Fork.

Lists heirs: (a) sons William and Samuel Daugherty; (b) son-in-law John Walhup (sic) (husband of daughter Sarah); (c) Thomas Gash's children by his first wife (Martha Daugherty); (d) Rebecca Gray; (e) Ames Spencer (relationship unknown); (f) Samuel Latimore (Latimer, husband of daughter Mary 'Polly' Daugherty); (g) Hugh McGill (husband of daughter Peggy Daugherty); and (h) John Caldwell (son of daughter, Rebecca Daugherty Gray).  Executors were his son William Daugherty and John Walkup.  Witnessed by William McGraw and Anderson Vannoy.

 

On the 17th & 18th days of Dec 1812 James Daugherty's inventory was presented to the Mercer Co KY Court by his administrators, namely his son, William Daugherty, and John Walkup. Will Book 4, pages 313-315.  This inventory list totaled $2, 657.37 1/2, excluding land.

 

James and Rebecca had the following children:

 

1.       Mary 'Polly', married Samuel Latimer Jr 4 Feb 1802 Mercer Co KY, died before 1814, Mercer Co KY.  Samuel was the son of Samuel and Lydia Latimer.  Will written 2/1833 Mercer Co KY Will Book #9.

2.       Peggy 'Margaret', married Hugh McGill 30 Dec 1794 Mercer Co KY.

3.       Rebecca, married Archibald Gray 10 Apr 1809 Mercer Co KY.   Rebecca must have married twice as her father's will references a son of hers named John Caldwell.

4.       William Daugherty, born before 1775 (probably Charlotte Co VA), married Sarah 'Sally' ___?___ (possibly Brisco, daughter of John Brisco Sr), died before 20 Nov 1821 Mercer Co KY.

5.       Samuel, born circa 1770/1775 in either VA or KY.  Married Chloe/Chlore Latimire/Latimore of Maryland on 5 Oct 1795 in Mercer Co KY.  Samuel must have died prior to 1850 as Chlore and her son Samuel are listed in the 1850 Marion Co KY household of her daughter Sarah (Daugherty) Bracken.  Chloe/Chlore was the daughter of Samuel and Lydia Latimir/Latimore.

6.       Sarah, married John Waughup 17 Feb 1781 Mercer Co KY.

7.       Martha, married Thomas Gash 21 Jan 1785 Lincoln Co KY, died before 9/1806 Mercer Co KY.

 

 

Samuel Daugherty

 

Samuel born circa 1770/1775 in either VA or KY.  He married Chloe/Chlore Latimer/Latimore of Maryland on 5 Oct 1795 in Mercer Co, KY.  Samuel must have died prior to 1850 as Chlore and her son Samuel are listed in the 1850 Marion Co KY household of her daughter Sarah (Daugherty) Bracken.  Chlore was the daughter of Samuel and Lydia Latimer.

 

Chronology of Samuel Daugherty Records

5 Jun 1801: Samuel was living hear the head of the Salt River.  Slaughter's Straybook 1796-1802 Reference: David Knox Esquire returned that Samuel Daugherty has taken up a Bay Mare.

 

13 Jun 1818, Mercer Co. Deeds: Daugherty to Latimer Estate (Mortgage), Seller Lydia Latimer, as widow in the estate of Samuel Latimer.  Buyer Samuel Dougherty of Mercer Co.  Buyer mortgages his whole estate, including his interest in 18 acres where he lives, gray horse, correl mare and colt, 3 cows and calves, 2 heifers, cupboard, clothes press, kitchen furnishings, etc. until Debt is paid off.  Price $227.33 due 13 Jun 1819.  Witnesses: Joseph Caldwell and Samuel Latimer (Jr.?). Mercer Co KY Deed Book 12, page 252.

Note from Jackie Higdon: Chloe Latimer Daugherty's father, Samuel Latimer, died some time after 27 Jun 1814 when he wrote his will and before the above document was written.  His will was not proved at the Mercer Co. Court until Oct 1828?  Could this debt have been the reason he removed to the Marion Co. area?.  Source for Latimer data: Linda Henry.

 

Samuel and Chlore Latimore had the following children:

 

1.       Sarah, born 1805 in KY (twin of Samuel?), married Hugh Bracken of Virginia in circa 1830 (probably in KY), died circa 1863.  Please see the chapter entitled Bracken for more information on this union.

2.       Samuel, born 1805 in KY (twin of Sarah?).  In the 1850 census, he (listed as an “idiot”) and his mother Chloe/Chlore are listed in the household of Hugh and Sarah Bracken.

3.       John, born 1817 Marion Co KY, married Ruth A. _________, died on 26 July 1852 near Linchburg, Marion Co KY, of cholera.  At the time of his death John was listed as "35" and "married" and a "farmer" in the Marion Co KY Vital Statistics 1852-1862.  Ruth was born circa 1819 KY.
