In
the name of God Amen I William Wysome of Tregare in the County of
Monmouth yeoman being of perfect mind memory and understanding but weak in body
and mindful of my mortality do make publish and declare this my last Will and
Testament in manner and form following that is to say. Whereas I am seized in fee of a certain farm
called or known by the name of Kevenygligoed situate in the said parish of
Tregare containing by estimation one hundred and forty one acres of land more
or less and now in the occupation of my brother John Wysome as tenant
thereof and whereas I have contracted to sell a certain portion of the said
farm and lands containing by estimation twenty two acres more or less to
General Sir Thomas Valiant, Knight and whereas I have also contracted to
sell another portion of the said farm and lands containing by estimation forty
acres more or less to [BLANK] Hutchins Esquire now I do by this
Will give and devise unto my father John Wysome and my three
brothers John Wysome, Thomas Wysome and Robert Wysome all
that the aforesaid farm and lands called Kevenygligoed containing by estimation
one hundred and forty one acres more or less situate in Tregare aforesaid and
now in the occupation of my said brother John Wysome together with all and
singular the rights members and appurtenances thereunto belonging to hold the
same and every part thereof unto my father John Wysome and my said
brothers John Wysome, Thomas Wysome and Robert Wysome
their heirs and assigns for ever upon trust and confidence to the intent and
purpose that they do and shall immediately after my decease convey to the said
Sir Thomas Valiant and his heirs all that portion of the said estate
called Kevenygligoed which I have contracted to sell to him as aforesaid. And upon further trust that they do and
shall convey to the said Hutchins and his heirs all that portion of the
estate called Kevenygligoed which I have contracted to sell to him as
aforesaid. And upon such trust that
they do and shall with all convenient speed after my decease but at their own
discretion sell and dispose of all the rest and residue of the said farm and
lands called Kevenygligoed either by public auction or private contract as they
shall see expedient for the best price or prices that can or may be reasonably obtained
for the same. And upon further trust
that they do and shall with and out of the monies to arise and come to their
hands by the means aforesaid pay and satisfy the debts due and owing by me on
mortgage of the said estate. And in the
next place do and shall pay all my just debts and funeral and testamentary
expences and the charges they may incur in executing the trusts of this my
Will. And in the next place do and
shall lay out and invest the clear residue of the monies to arise and come to
their hands by the means aforesaid on real security or in the purchase of
parliamentary funds in Great Britain and do and shall pay the interest
dividends and annual produce thereof unto my father the said John Wysome
and my mother for and during their joint lives and the life of the longest
liver of them and from and after the decease of the survivor of them my said
father and mother then upon trust to pay to Thomas the son of my sister Mary
Ann Thomas the sum of nineteen pounds and nineteen shillings and do and shall
pay and divide the residue of the said stocks funds and securities unto between
and amongst my said sister Mary Ann Thomas and them my said
brothers John Wysome, Thomas Wysome and Robert Wysome
their executors adm’ors and assigns to be divided between them share and share
alike. And I do direct that until the
sale of my said estate my said father and mother shall be entitles for their
lives as aforesaid to the surplus rent of the said estate after payment of the
interest of my aforesaid mortgage debts.
And as to all the rest residue and remainder of my real estate and also
all my personal estate I give devise and bequeath the same unto my said father
his heirs executors administrators and assigns. And as to all estates vested in me upon trust or by way of a
mortgage I give devise and bequeath the same unto my said brother John
Wysome his heirs and assigns for ever subject to the several equities
affecting the same. And I do declare my
will is that the receipt or receipts of my said father and three brothers or
the survivors or survivor of them and the heirs and assigns of such survivor
shall be good and sufficient discharges for any purchase money or monies to any
purchaser or purchasers of my said estate called Kevenygligoed nor shall such
purchaser or purchasers be compelled or required to enquire as to the
expediency of such sale nor to see to the application of their respective
purchase monies and I do authorise my said father and three brothers to retain
and pay themselves all costs charges and expences which they shall sustain or
incur in executing the trusts of this my will and that they shall neither of
them be answerable or accountable for any loss which may happen in executing
the trusts of this my will unless the same happen by or through their wilful
neglect or default. In witness whereof
I the said William Wysome the testator have to this my last Will and Testament
contained in three sheet of paper set my hand and seal (to wit) my hand to the
first two sheets and my hand and seal to this third and last sheet dated this
nineteenth day of December one thousand eight hundred and forty four. W Wysome.

Testament in the presence of us who in his presence at his request and in the

Proved at London 12th
March 1852 before the Judge by the oath of John Wysome the brother one
of the surviving executors according to the tenor to whom administration was
granted having been first sworn by Commission duly to administer power reserved
of making the like grant to Thomas Wysome and Robert Wysome
the or others also the other surviving executors according to the tenor when
they shall apply for the same.
