This is the last will and testament of me James Williams of the parish of Penalt in the County of Monmouth, carpenter. I give, devise and bequeath all my cottage, garden and parcel of land comprising two acres and a half more or less situate in the parishes of Penalt and Llandaga in the County afore said and now in the occupation of my sons John and Herbert to be sold by my executors hereinafter named as soon as conveniently may be after my decease and to be equally divided among my children to wit, John, Arthur, Herbert, Robert, Mary, Esther, Jane? and Catherine share and share alike. I also bequeath that sum of twenty pounds left to me by my late father and payable after the decease of my mother to be equally divided among my children above named. I also desire that all my house hold furniture be likewise equally divided by my executors among my children above named. I also appoint as executors and trustees of this my last will and testament Samuel Thomas, shoemaker and William Rosser both of the parish of Penalt giving them full power and authority to sell and dispose of all my real property wheresoever the same may be, the proceeds thereof to be divided among my children above named.
Given under my hand this tenth day of April one thousand eight hundred and forty nine. James Williams.
Signed by the said testator in the presence of us present at the same time who at his request in his presence and in presence of each other have hereto subscribed our names as witnesses William Oakeley, Curate of Penalt; the mark of Thomas Morrice;
31st day of December 1851. Samuel Thomas one of the executors in this will named was duly sworn as such and that the goods, chattels and credits of the deceased are under the value of twenty pounds. Power being first reserved for making the like grant to William Rosser the other executor named in the said will whenever he shall apply for the same. Richd Prichard, Surrogate
Diocese of Llandaff, In the Consistory Court, In the goods of James Williams deceased Appeared personally Samuel Thomas of Penalt in the County of Monmouth, shoemaker one of the executors named in the last will and testament of the said James Williams late of the parish of Penalt in the said County carpenter deceased who died in the month of August in the year of our Lord one thousand eight hundred and fifty and made oath that the estate and effects of the said deceased for and in respect of which a probate of the said will is to be granted exclusive of what the said deceased may have been possessed of or entitled to as a trustee for any other person or persons and not beneficially and without deducting any thing on account of the debts due and owing from the said deceased are under the value of twenty pounds to the best of this deponents knowledge, information and belief. And he lastly made oath that the said deceased did not die possessed of any leasehold estate or estates for years either absolute or determinable on a life or lives to the best of this deponents knowledge, information and belief.
