In the name of God Amen I Thomas Weare of the New House in the parish of Trellech in the County of Monmouth, farmer, being in sound mind and memory do make and ordain this my last will and testament: First I give, devise and bequeath to my daughter Margaret, her heirs and assigns for ever all that estate, my dwelling house called the New House, together with the out houses, garden and lands adjoining, situate in the parish of Trelleck aforesaid, and also all my farming stock, live and dead, implements of husbandry &c, and the true intent and meaning of this my last will with regard to the estate above mentioned is that in the event of my said daughter Margaret being hereafter married and having lawful issue that the before mentioned house, garden, out houses, lands &c be enjoyed by her, her heirs and assigns for ever. But in the event of my said daughter Margaret being married and not leaving lawful issue I will devise and bequeath all and every the estate and estates before mentioned which are herein before willed, devised and bequeathed unto my daughter Margaret aforesaid unto and to use of her lawful husband for and during the term of his natural life. And from and after the decease of my said daughter Margaret and the decease of her husband, and in the event of their not leaving lawful issue, I will, devise and bequeath the above mentioned New House, estate, out houses, garden, and lands to be equally divided between my six grand children following namely Thomas Stead the son of Philip Stead of Mitcheltroy, Thomas Gwynne son of James Gwynne of Trelleck, John Stead son of Philip Stead aforesaid, James Gwynne son of James Gwynne aforesaid, William Richards son of Thomas Richards of Cwmcarvan, and John Thomas son of John Thomas of Penalt. And as it is my desire that the said New House estate shall remain in the possession of some or other member or members of my family I will and desire that the first mentioned of my grandsons in this my will have the first chance and offer of purchasing the said estate and that the remaining grandchildren have their shares paid out of the purchase money. And if the first grandson before named decline to purchase, that the second named in this will have the offer to purchase. And if he decline then that the third named have the offer, and so on giving each in his turn the offer to purchase. In the event of the death of either or both of my grandsons Thomas Stead and John Stead, I will, desire and bequeath his or their share or shares in manner following viz, if one die that his share be given to his sister Elizabeth Stead, her heirs and assigns for ever. And if both of the brothers die, that the share of the second that shall die be given to his sister Ann Stead, her heirs and assigns for ever. In the event of the death of either or both of my grandsons Thomas Gwynne and James Gwynne, I will, devise and bequeath his or their shares in manner following viz, if one die, that his share be given to his sister Mary Gwynne, her heirs and assigns for ever. And if both brothers die that the share of the second that shall die be given to his sister Emma Gwynne, her heirs and assigns for ever. In the event of the death of my grandson William Richards before mentioned I give, devise and bequeath his share to his sister Eliza Richards, her heirs and assigns for ever. And in the event of the death of my grandson John Thomas I give, devise and bequeath his share to his sister Sarah Thomas, her heirs and assigns for ever. Also I give and bequeath the four following legacies to be paid by my daughter Margaret out of the New House estate. First I give and bequeath to my oldest son Thomas the sum of thirty pounds lawful money to be paid in twelve months after my decease. 2nd I give and bequeath to my daughter Mary the sum of thirty pounds lawful money to be paid in yearly instalments of five pounds each year beginning twelve months after my decease. 3rd I give and bequeath to my daughter Sarah the sum of forty pounds lawful money to be paid in twelve months after my decease. 4th and last I give and bequeath to to my daughter-in-law Mary Weare, the widow of my late son William the sum of five pounds lawful money to be paid in twelve months after my decease. These legacies making together the sum of one hundred and five pounds are chargeable on the before mentioned New House estate. I give and devise to my daughter Sarah before named the house and lands comprising about three acres more or less, known by the name of the Rock Cottage situate in the parish of Trelleck aforesaid. And I give and bequeath my household furniture in manner following, I give to my daughter Margaret the furniture of my best bed, my house clock and my mahogany round table. And the remainder of my household furniture I give and bequeath to be divided between my daughters Sarah and Margaret. And finally I constitute and appoint my daughter Margaret to be sole executrix of this my last will and testament. Appeared personally Margaret Lewis (the wife of Henry Lewis of the parish of Trelleck in the County of Monmouth) the soleexecutrix named in the last will and testament of the said Thomas Weare late of Trelleck aforesaid, farmer, deceased, who died on the seventh day of August last and made oath that the estate and effects of the said deceased, for and in respect of which a probate of the said will is to be granted, exclusive of what the said deceased may have been possessed of or entitled to as a trustee for any other person or persons, and not beneficially and without deducting any thing on account of the debts due and owing from the said deceased, are under the value of twenty pounds, to the best of this deponents knowledge, information and belief. And she lastly made oath that the said deceased did not die possessed of any leasehold estate or estates for years either absolute or determinable on a life or lives to the best of this deponents knowledge, information and belief.
