John Rich of Merthyr Tydfil, Glam. 1911.

This is the last will and testament of me John Rich of Bridge Street, Merthyr Tydfil in the County of Glamorgan aerated water manufacturer.

  1. I revoke all former wills and testamentary dispositions made by me and declare this to be my last will and testament.
  2. I appoint my friends Thomas Powell, saddler, Merthyr Tydfil aforesaid, and John Davies, solicitor, Merthyr Tydfil aforesaid hereinafter called my trustees to be the trustees and executors of this my will
  3. I give devise and bequeath all my property both real and personal (subject to the payment of my funeral and testamentary expenses and debts) unto my trustees upon the trusts and subject to the powers hereinafter declared of and concerning the same, that is to say.
    1. Upon trust to receive the rents profits and income of my estate and to pay thereout the rents reserved by the leases of such parts thereof as may consist of leaseholds and the expenses of performing and observing the covenants contained in the said leases and all outgoings in respect of my said estate.
    2. And upon further trust to pay the net rents profits and income of my estate to my wife during her life or widowhood and after her decease or second marriage whichever shall first happen.
    3. Upon further trust to sell call in and convert into money such parts of my estate as shall not consist of money and to invest the monies to arise from such sale calling in and conversion in any of investments for the time being authorized by law for the investment of trust monies and to stand possessed and to hold such investment and the income thereof in trust for all or any of my children or child who being a son or sons attain the age of twenty one years or being a daughter or daughters attain that age or marry under that age if more than one in equal shares
  4. I declare that my trustees may with the consent of my wife and after her death or second marriage at their discretion --? any part or parts not exceeding one half of the vested or presumptive share of any of my said children or child and apply the same for his or her preferment or benefit as my trustees may think fit.
  5. I also declare that my trustees may postpone the sale calling in and conversion of the whole or any part of my said estate during such period as they shall think fit and that all the net rents profits and income arising from my said estate after the decease or second marriage of my said wife shall until such calling in or conversion to be applied as if the same were income arising from proceeds of the sale calling in or conversion thereof or the investments of such proceeds.
  6. The said John Davies being a Solicitor shall be entitled to charge for his services (whether professional or not) as such trustee as aforesaid as he would have been entitled to charge had he not been an executor or trustee.
  7. I hereby appoint my trustees to be the trustees of this my will for the purposes of the Settled Land Act 1882

Signed by the said testator as and for his last will in the presence of us both being present at the same time who at his request in his presence and in the presence of each other have hereunto subscribed our names as witnesses

On the 19th day of December 1911 administration (with Will) was granted at Llandaff to Catherine Jane Rich widow, the residuary legatee for life or widowhood
