James Rich of Cardiff 1910.

This is the last will and testament of me James Rich of No 79 Deburgh? St in the City of Cardiff, contractor.

  1. I hereby revoke all former wills made by me and appoint my wife Josephine Rich and my nephews Edward Rich of Ewenny Road, Bridgend, builder, and Thomas Rich Williams of No 11 Heath Street, Cardiff, contractor executors and trustees of this my will
  2. I give to the said Edward Rich twenty pounds
  3. I give to my said wife absolutely all my household furniture, books, plate, pictures, china, glass, linen and wearing apparel
  4. I give and bequeath unto my said trustees the following properties namely Nos 2, 4, 6, 8, 10, 12, 14, 16, 18, 20, 22, 24, 26 and 28 Pentrebane Street, Lower Grangetown, Cardiff, South Side, Nos 17 and 19 Pentrebane Street aforesaid North Side and Nos 2 (with stable) 4, 6, 8, 10, 12 Saint Fagans Street, Lower Grangetown, Cardiff. Nos 15 & 8 Mansfield Street, Canton, Cardiff, the house in which I now live viz. No 79 Deburgh Street aforesaid and also Nos 87 and 77 Deburgh Street aforesaid upon trust to allow my said wife to receive and enjoy the rents and profits thereof for her life or so long as she shall continue my widow, she paying all outgoings in respect thereof and keeping the same in good repair and condition.
  5. It is my express wish and desire that my nephew the said Thomas Rich Williams shall collect the rents of the properties mentioned in paragraph 4 of this my will and manage the same as if he were the owner thereof for my said wife so long as she wishes him to do so and without making any charge whatever for doing so.
  6. From and after the decease or second marriage of my said wife which ever event shall first happen I direct my trustees to sell the whole of the properties mentioned in paragraph 4 hereof and out of the net proceeds of the sale to pay one hundred pounds to the trustees of the Peoples Hall (Wesleyan) Louden Square, Cardiff, fifty pounds to the trustees of the Wesleyan Chapel situate in Ludlow Street, Grangetown, Cardiff, fifty pounds to the trustees of the Wesleyan Chapel, Clare Gardens, Cardiff (such last mentioned legacies of one hundred pounds, fifty pounds and fifty pounds to be applied in aid of the funds of the said Hall and Chapels and the receipts of the respective treasurers or secretaries to be a sufficient discharge to my trustees for the legacies), one hundred pounds to my nephew John Williams and one hundred pounds to my nephew the aforesaid Edward Rich and to divide the remainder of the proceeds of the sale equally between the following of my nephews and nieces, the said Edward Rich, John Rich of Merthyr Tydfil, James Lewis of Grangetown, Cardiff, Susannah Williams of Cowbridge Road, Cardiff and Harriet Ford of Grange Gardens, Cardiff.
  7. I direct should either of my said nephews and nieces Edward Rich, John Rich, James Lewis, Susannah Williams and Harriet Ford be dead at the death or remarriage of my said wife that the share to which such nephew or niece would be entitled if alive shall be equally divided between the children (if any) of such deceased nephew or niece living at the death or remarriage of my said wife but should there be no child or children of any or either of my aforesaid nephews and nieces (who may have died as aforesaid) living at the death or remarriage of my said wife then the share of the proceeds of the said sale to which any deceased nephew or niece would have been entitled if alive shall be equally divided between the survivor or survivors of my said nephews and nieces named in this clause.
  8. I give, devise and bequeath unto my said trustees the following properties namely Nos 23, 25, 27 and 29 with stable and yard at back situate in Lewis Street, Canton, Cardiff, No 21A Lewis Street, Canton, Cardiff aforesaid and Nos 9 and 11 with stable and yard at back situate in Heath Street, Canton aforesaid upon trust to allow my nephew Thomas Rich Williams to receive and enjoy the rents and profits thereof during the term of his natural life, he paying all outgoings in respect of the properties and keeping the same in good repair and condition and also paying to my said wife (during her life or widowhood) the sum of fourteen pounds a year being the amount of the ground rent formerly paid by me in respect of the properties mentioned in this clause (I having some time ago purchased the ground rents thereof) and also carrying out my wish and desire as contained in paragraph 5 of this my will and from and after the decease of the said Thomas Rich Williams or on his failing or refusing to comply with my said wish and desire my trustees are to sell the properties mentioned in this paragraph (subject to the said annual charge of fourteen pounds in favour of my wife if then alive and my widow) and divide the net proceeds of the sale equally between all the children of the said Thomas Rich Williams who shall survive him and the issue living at his death of any child of his who may have died in his lifetime such child or children taking equally between them if more than one the share to which his or her deceased parent would have taken if alive.
  9. I give and bequeath unto my said trustees my two houses Nos 15 and 17 Seven Oaks Street, Lower Grangetown, Cardiff aforesaid upon trust to allow my nephew the aforesaid James Lewis to receive and enjoy the rents and profits thereof for and during the term of his natural life he paying all outgoings in respect thereof and keeping the same in good repair and condition and from and after his decease my trustees are to permit Lavinia Lewis his wife should she survive him to receive and enjoy the rents and profits of Nos 15 and 17 Seven Oaks Street aforesaid for and during her natural life or so long as she shall continue the widow of the said James Lewis she paying all outgoings in respect of the said property and keeping the same in good repair and condition and from and after the decease of the survivor of the said James Lewis and the said Lavinia Lewis his wife or at the remarriage of the said Lavinia Lewis if she should survive her husband the said James Lewis I direct that the said property Nos 15 and 17 Seven Oaks Street shall be sold and the net proceeds of such sale equally divided between all my nephews and nieces mentioned in clause 6 of this my will who shall be alive at the death of the said James Lewis the share of any nephew or niece of mine who may be then dead to be equally divided between his or her children then living.
  10. And I hereby direct and declare that if any or either of the persons entitled to a life interest in property under this my will shall alienate or dispose of or attempt to alienate or dispose of the same or any part thereof the interest of such person or persons in such property shall immediately cease any my trustees are to deal with the property as if the person or persons so alienating the same or any part thereof or attempting to do so were dead.
  11. All the rest of my estate real and personal I give devise and bequeath absolutely to my said wife Josephine Rich.
