In the Name of God Amen = I Thomas Leonard of the Town of Abergavenny in the County of Monmouth Butcher Do make this my last Will and Testament in manner following, that is to say First I subject and charge all and Singular my real and personal Estates to and with the payment of my just Debts. Item I Give and devise unto my Brother in Law William Lewis of the Brooks Farm in the parish of Abergavenny aforesaid farmer and my friend John Williams of the said Town of Aberganenny Chandler All and singular my Freehold Messuage Tenements Lands and Hereditaments whatsoever situate in the Town and Parish of Abergavenny or elsewhere in the said County of Monmouth To have and to hold all and singular the same Messuages Tenements Lands and Hereditaments with the Appurtenances unto the said William Lewis and John Williams their Heirs and Assigns To the use of them the said William Lewis and John Williams their Heirs and Assigns for ever But nevertheless upon the Trusts and for the Intents and purposes herein After expressed declared and contained of and concerning the same, that is to say, Upon Trust that they the said William Lewis and John Williams and the survivor of them and the Heirs and Assigns of such survivor do and shall from and immediately after my death enter into possession of my said Messuages Tenements Lands and Hereditaments and have receive and take the Yearly Rents Issues and profits thereof and of every part thereof and pay apply and dispose of the same to and for the uses ~ intents and purposes herein After mentioned expressed and declared of and concerning the same rents Issues and profits Item I Give and bequeath unto the said William Lewis and John Williams their Executors ~ Administrators and Assigns All my Household Goods and Furniture plate Linen and Implements of Household Also all my stock of Horses, Cattle, Sheep, Swine and Hay and all my Money and Secuities for Money and Debts which shall be due and owing to me at the time of my death And also all other my personal Estate and Effects whatsoever and whersoever In Trust for the purposes herein after mentioned And it is my Will and meaning and I do hereby order and direct my said Trustees William Lewis and John Williams and the survivor of them his Executors or Administrators immediately after my death to call in all such Debts Sum and Sums of Money as shall be then due and owing to me And also to sell and dispose of by Public Auction or private Contract all my Household Goods, Furniture Plate, Linen and Implements of Household Stock, of Horses Cattle Sheep Swine and other Effects and therewith and thereout in the first place to pay and discharge all my just Debts (Except such as shall be due and owing from me and secured by Mortgage of my aforesaid Messuages Tenements Lands and Hereditaments) Funeral Expences and the Costs of proving this my Will And in the next place to place out at Interest as well all Money which shall be due and owing to me as aforesaid, as also the Money to arise by sale of my said Goods and Effects after such payments made as ~ aforesaid upon Government or real security or Securities in England and to call in and place out the same again at Interest or such Securities as occasion shall require and pay and apply as well the Interest dividends and yearly proceed thereof as also the yearly rents Issues and profits of my said Messuages, Tenements, Lands and Hereditaments for and towards the Maintenance Education and support of my eight youngest Children, namely Mary John, William, Michael, Martha, Margaret James and Charles, in such parts shares and proportions as my said Trustees or the Survivor of them his heirs Executors or Administrators shall in their or his discretion think fit and proper until all of them my said Eight youngest Children or the survivors or survivor of them (in case one or more of them shall happen to die under the Age of Twenty Years) shall attain the Age of Twenty one Years And it is my express Will and meaning and I do hereby, order and direct my (said) Trustees William Lewis and John Williams and the Survivor of them his heirs or Assigns With all convenient speed after the youngest or youngest surviving of my said above named Eight Children shall attain the Age of Twenty one Years to Sell convey and Assure the Freehold and Inheritance in fee simple of and in the said Messuages Tenements Lands and Hereditaments with their and every of their rights members and Appurtenances either together or in parcels and either by public Auction or private Contract to such person or persons as shall be willing to purchase the same or any part or parts thereof for the best price or prices that can be reasonably had or gotten and shall and do pay apply and dispose of the Money to arise be had and received by such Sale and Sales to for and upon the several uses trusts intents and purposes herein after mentioned expressed declared and contained of and concerning the same Money Provided always nevertherless and my Will is that for the promoting and facilitating such sale and sales as ~ aforesaid that the receipt and receipts of the said William Lewis and John Williams or the Survivor of them his Executors Administrators or Assigns shall from time to time be good and effectual to all intents and purposes whatsoever to the purchaser or purchasers of the said Messuages Tenements Lands and Hereditaments and every part thereof with respect to the payment of so much and such part or parts of the purchase Money for the same as in such receipt or receipts shall be expressed to be received by the said William Lewis and John Williams or the survivor of them his Executors Administrators or Assigns and that the purchaser or purchasers so pay in his her or their purchase money as aforesaid shall in no sort be concerned to see to the application thereof or be in any wise answerable or accountable for the loss misapplication or nonapplication of such purchase Money or any part thereof Provided also and my Will and ~ meaning is that when the said Messuages Tenements Lands and Hereditaments so hereby devised unto and to the use of the said William Lewis and John Williams their Heirs and Assigns In Trust to be sold as aforesaid shall be actually sold and the purchase money received for the same they the said William Lewis and John Williams and the survivor of them his Executors Administrators or Assigns shall in the first place deduct and retain thereout their Costs charges and expences in and about the Execution of the Trust hereby in them reposed and in the next place pay off and discharge the Mortgage Monies with ~ which the said devised Hereditaments shall at the time of my death stand charged and the Interest then due for the same and from and after such deductions and payments my Will is that the said William Lewis and John Williams or the survivor of them his Executors Administrators and Assigns shall and do stand and be possessed of as well the rest residue and surplus of the money to arise and be produced by such Sale of Sales as aforesaid as also the surplus residue of all such Debts sum and Sums of Money as were due and owing to me at the time of my death and the money produced by the sale of my Goods Chattels and personal Estate In Trust and for the use and benefit of my Twelve Children namely Ann, Elizabeth Thomas, Alice and also the said Mary, John, William, Michael, Martha, Margaret, James and Charles equally to be divided between and among them share and share alike as Tenants in common and to be vested and transmissible Interests in them respectively on attaining the Age of Twenty one Years with benefit of ~ Survivorship among and between all my Children in case one or more of them shall happen to die without having attained such vested Interest as aforesaid Item my Will is that the said William Lewis and John Williams and the survivor of them his Executors Administrators or Assigns shall be charged or chargeable only for such Money as they or either of them shall respectively actually receive by virtue of the trusts hereby in them reposed and that the one of them shall not be answerable for the other of them or for the acts receipts neglects or defaults of the other of them but each of them only for his own Acts ~ receipts neglects or defaults and that they or either of them shall not be answerable or accountable for any Banker Broker Goldsmith or other person or persons with whom or in whose hands all or any part of the Trusts Monies shall or may be deposited or lodged for safe Custody nor for any falling of the Stocks funds or securities in which the same may be invested, nor for any loss or damage which may happen in the Execution of the aforesaid Trusts or in relation thereto except the same shall happen by or through their own wilful defaults ~ respectively And that they the said William Lewis and John Williams and the survivor of them his Heirs Executors Administrators and Assigns shall by and out of the Monies which shall come to their respective Hands by virtue of the Trusts hereby in them reposed retain to and reimburse themselves respectively And also shall out of such Monies pay and allow to his co Trustee all such charges and expences which they or either of them shall or may respectively sustain expend disburse be at or be put unto in and about the Execution of the Trusts hereby in them reposed or in any wise relating thereto Item I Give and bequeath unto my Son Thomas Leonard the benefit of the unexpired Term in a certain Lease granted to me by Mrs. Morgan of Tredegar of Lands situate in the Hamlet of Lloynder subject to his paying the yearly rent and performing the covenants and agreements therein contained Item I do hereby constitute and appoint the said William Lewis and John Williams Executors of this my last Will and Testament and do hereby revoke all former Will and Wills by me made and do declare this to be my last Will and Testament In Winess whereof I have to this my last Will and Testament contained in four sheets of Paper set my hand and Seal, that is to say to the three first Sheets my hand and to the last Sheet my hand and seal the fourteenth day of November in the Year of our Lord One thousand Eight hundred and five. –
