Edward Howell. Trelleck Grange. - Mon WILL Proved 2 March 1860

 

In the name of God Amen, I Edward Howell of the parish of Trelleck Grange and County of Monmouth being in perfect health of body and of perfect mind and memory thanks be given unto God calling into mind the mortality of my body and knowing that it is appointed for all men once to die, do make and ordain this my last will and testament (that is to say) principally and first of all I give and recommend my soul into the hand of Almighty God that gave it and my body I recommend to the earth to be buried in decent Christian burial at the discretion of my executors nothing doubting but at the general resurrection I shall receive the same again by the mighty power of God and as touching such worldly estate wherewith it hath pleased God to bless me in this life I give, devise and dispose of the same in the following manner and form and I consitute make and ordain my son William Howell and my son David Howell to be my executor of this my last will and testament and I direct that my executors shall receive all such money as I may have in my possession at the time of decease and all my book debts and all the money that may be due to me from my tennants and all such money that may stand in my name in Chepstow Savings Bank and that my executors shall cause all my good and chattles to be sold by auction an all my moveable effects except such things as I shall otherwise dispose of in this my will and I direct that all my just debts funeral expenses the expece of proving this my will and all incidental charges be fully paid and discharged by my executors. To my beloved daughter Mary Ann Waite,, wife of William Waite,, currier, I give and bequeath the sum of seventy five pounds of lawfull money of this realm together with one sett of gigg harness to my daughter Susannah Constance wife of Cartwright Constance, yeoman I gieve and bequath the sum of ninety nine pounds of like money together with one eight day clock and case and one arm chaire the above legacies to be paid within twelve months after my decease by my executors but if the money receive by my executors be found insufficient to pay the legacies then I charge my whole estate with the payment thereof (that is to say) my executors shall receive the rents and proceeds of my whole estate until sufficient be received by then to pay the same with lawful interest and as soon as the above legacies be fully paid and discharge. I dispose of my real estate in the following manner and form. To my son Charles Howell I give and bequeath all my freehold house, garden and premises thereunto belonging situate in the parish of Tidenham and County of Gloucester for and during the term of his natural life and at his decease to the survivors of his lawfully born children share and share alike. To my two executors herein named I give all my freehold and leasehold houses and land situate in the several parishes of Treleck, Trelecks Grange, Chappel hill and Newchurch the same being allotted out into two allotments called by the name of the Upper and lower allotments to have and to hold as by me now held and I direct that the rent of the Leasehold be paid in equal proportion that is to say the one half to be paid by the one executor an the other half to be paid by the other executor and I do hereby revoke revoke disannul and make void all former wills at any time by me made and do declare this and no other to be my las will and testament in witness whereof I have set my hand and seal this 27th day of March in the year of our Lord one thousand and eight hundred fifty in three in the presence of the under signed witnesses. In the goods of Edward Howell deceased, I James Coles late of Trellecks Grange in the County of Monmouth but now of Kings Brompton in the County of Somerset, Minister of the Gospel make oath and say that I am one of the subscribing witnesses to the last will and testament of the said Edward Howell of the parish of Trellecks Grange aforesaid deceased the said will being now hereunto annexed bearing date the twenty seventh day of March in the year of our Lord one thousand eight hundred and fifty three and that the said testator executed the said will on the day of the date thereof by signing his name at the foot or end thereof as the same now appears thereon in the presence of me and of Joseph Highley and Elizabeth Highley the other subscribed witnesses thereto all of us being present at the same time and we thereupon attested and subscribed the said will in the presence of the said testator and of each other. Sworn at Bardon in the parish of Saint Decumans in the County of Somerset on the sixth day of February 1860 before me Jas Warden a Commissioner to administer oaths in Chancery in England

On the 2nd day of March 1860 the will of Edward Howell late of the parish of Trelleck Grange in the County of Monmouth, plasterer deceased was proved by the oath of William Howell, plasterer, the son of the said deceased and one of the executors named in the said will be having been first sworn duly to administer (power being reserved of making the like to David Howell the son of the said deceased and the other executor named in the said will whenever he shall apply for the same.
