This is the last will and testament of me William Herbert of Castle Vale in the town of Usk in the County of Monmouth. I appoint my sons Thomas Herbert and Richard Herbert executors and trustees of this will and give to each of them the said Thomas Herbert and Richard Herbert the sum of forty pounds. And I direct that all my funeral and testamentary expenses and debts be paid and duly satisfied by my said executors and trustees as conveniently may be after my decease. I give devise and bequeath all my real and personal estate of what nature or kind soever the same may be and wheresoever situate unto my said executors and trustees Thomas Herbert and Richard Herbert upon trust to hold for the sole benefit of my wife Israel Herbert for her life. And I direct that all income arising from the said real and personal estate be paid by my said executors and trustees half yearly to my said wife Israel Herbert. And from and after the decease of my said wife my said executors and trustees for the time being shall proceed at once or as soon as conveniently may be to sell and convert into money the whole of my real estate of what kind soever or wheresoever situate the proceeds of such sale or conversion to be applied as part of my personal estate hereinafter bequeathed also from and after the decease of my said wife I give and bequeath all the residue of my personal estate with the exception of my shares in the business and concern known by the title and designation of Partridge Jones & Co Limited and which shall be apportioned as hereinafter directed and including the proceeds of the sale and conversion of my said real estate into five equal parts or shares in manner following I bequeath four equal parts or shares thereof unto and equally between my four sons James Herbert, Charles Herbert, Thomas Herbert and Richard Herbert their heirs or assigns for their own absolute use and benefit and the fifth part or share thereof unto and equally between my three grandchildren Charlotte Elizabeth Herbert, Clarice Herbert and Osmond Arthur Herbert or their heirs also from and after the decease of my said wife I give and bequeath my shares in the concern known as Partridge Jones & Co Limited hereinbefore mentioned into five equal parts unto and equally between my sons James Herbert, Charles Herbert, Thomas Herbert and Richard Herbert and my grandson Osmond Arthur Herbert their heirs or assigns. And I further direct that all benefits to any female under this my will shall be for her sole and separate use and free from all marital control. And I direct that my trustees for the time being do and shall apply the whole of my real and personal estate in manner hereinbefore directed and declare that their receipts shall be sufficient discharges for all monies or effects paid to or delivered to them and revoking all former wills & testaments made by me I declare this to be my last will and testament. Be it known that at the date hereunder written the last will and testament of William Herbert formerly of Castle Vale, Usk in the County of Monmouth but late of Whitchurch near Ross in the County of Hereford retired farmer deceased, who died on the 4th day of June 1890 at Whitchurch aforesaid was proved and registered in the Principal Probate Registry of Her Majestys High Court of Justice, and that administration of the personal estate of the said deceased was granted by the aforesaid Court to Thomas Herbert of Llanerthill Farm in the parish of Llandenny in the said County of Monmouth farmer and Richard Herbert of Garndiffaith in the parish of Trevethin in the said County of Monmouth provision merchant, the sons the executors named in the said will they having been first sworn well and faithfully to administer the same.
