Isaac Herbert. Penallt. Mon. Will Proved 31 July 1869

 

 

On the 31st day of July 1869 the Will of Isaac Herbert late of the Parish of Penalt in the County of Monmouth, yeoman deceased, who died on the 31st day of May 1869 at Penalt aforesaid was proved in the Principal Registry of Her Majesty’s Court of Probate, by the oath of William Herbert of Penalt aforesaid. yeoman, the son of the said deceased, the sole executor named in the said Will, he having been first sworn duly to administer. Effects under £100.

This is the last will and testament of me Isaack Herbert of the parish of Penalt in the County of Monmouth yeoman. I give and devise all my real and personal estate of what nature or kind soever unto my wife Mary Herbert for the term of her natural life and after her decease I give and devise all that freehold and copy hold house, garden and land called the Upper Glyn containing about seven acres situate in the said parish of Penalt and now in my own occupation unto my son William Herbert, his heirs and assigns for ever subject nevertheless to and charged and chargeable with the payment of the following legacies namely the sum of five pounds to each of his brothers and sisters namely Elizabeth the wife of Philip Herbert, Ann the wife of Edward Herbert. Eliza the wife of Peter Brown, Mary the wife of John Beard, the wife of Edwin Prosser, John Herbert and Isaac Herbert all which said several legacies I direct to be paid within twelve months after the decease of my said wife I give and devise (subject to my said wifes life state? therein) all those two pieces of arable land called Gwern? Gain? Gelled? containing three acres (more or less) and also all that piece of free hold pasture and rough ground containing six acres, one rood and thirty perches (more or less) situate in the said parish of Penalt now in my own occupation unto my son William Herbert. his heirs and assigns upon trust to sell the same within twelve months after the decease of my said wife either by public auction or private contract with full power to give receipts to the purchasers and to divide the proceeds of such sale equally between all my children share and share alike. I give and bequeath unto my son William Herbert all and singular my household furniture, goods, chattels, live stock, implements of husbandry and other effects absolutely for his own use and benefit. I give and bequeath all the residue of my real and personal estate to my son William Herbert absolutely subject to the payments of all my debts and funeral and testamentary expences and it is my will and meaning that in case my said son William Herbert should happen to depart this life unmarried and without issue then his share to be equally divided between his surviving brothers and sisters share and share alike. And lastly I appoint my said son William Herbert sole executor and Trustee of this my will. In witness whereof I have hereunto set my hand this first day of September in the year of our Lord one thousand eight hundred and sixty eight. Isaac Herbert. Signed, sealed, published and declared by the said testator as his last will and testament in the presence of us who at his request in his presenceand in the presence of each other have subscribed our names as witness hereto. Proved at London 31st July 1869 by the oath of William Herbert the son, the sole executor to whom Admon? was granted
