In the name of God Amen the fifth day of December in the year of our Lord God one thousand seven hundred and thirty two I Gilbert Gastrell of Tetbury in the County of Gloucester Gent being in a tolerable state of health in body and of sound and disposing mind and memory (thanks be to God therefore) do make and publish this my last will and testament in manner and form following, that is to say. Imprimis I give unto my grandson Gilbert Gastrell and to his two sisters Jane and Mary one hundred pounds apeice to be paid at their respective ages of one and twenty years And I do hereby charge all my lands and tenements in the parish of Tetbury aforesaid (except my dwelling house and the several closes herein after mentioned called Oldhams Grounds) with the payment thereof it being my mind that the same legacyes shall not be raysed or paid out of my personal estate. Item I give unto my grandson Nathaniel Body and to his brother Giles and his sister Anne the sum of two hundred pounds apeice And it is my will that the three last mentioned legacyes amounting together to six hundred pounds shall be paid out of my personal estate at the end of one year next after my decease unto my son in law Giles Body, Gent, Richard Gastrell, Gent and Francis Savage, Gent In trust to be by them set at interest to and for the benefit and advantage of my said grandson Nathaniel Body and his said brother Giles and sister Anne And that their several legacyes of two hundred pounds each and the interest thereof shall be respectively paid unto them at their several ages of one and twenty years And that if any or either of them shall happen to dye before his her or their legacyes shall become due and payable That then the legacy or legacyes of him her or them so dying shall go and be paid to the survivors or survivor of them But if my said grandson Nathaniel Body and his said brother and sister shall all of them dye before either of them shall attain the age of one and twenty years that then their whole legacyes of six hundred pounds and the increase thereof shall go and be paid unto and be equally divided between my son Mr James Gastrell and my daughter Mrs Mary Body if they shall be both living or if one of them shall be then dead then the same six hundred pounds and the increase thereof to be paid to the survivor of them. Item I give and devise unto my said daughter Mary Body all those my five closes or grounds lying and being in the parish of Tetbury aforesaid and commonly called Oldhams Grounds and now let to the Widow Oldham for four and twenty pounds per annum or thereabouts To hold to my said daughter Mary Body and her assigns for and during the term of her natural life. Item I give to my wife a bond of fifty pounds due to me from Mr Isaac Wells and the interest thereof and also fifty pounds more which she has in her own hands and custody but it is my mind and will that the same shall be in full satisfaction and payment of a legacy given unto her by the will of her late mother Mrs Mary Shiptan deceased. Item I give unto my said wife all such household goods as I had with her in marriage and I also give unto her the reasonable use of all my other household goods furniture plate and implements of household during her life and after her decease I give the same unto my said son James Gastrell for his own use. Item I give to my said wife during her life all that my messuage or tenement with its appurtenances situate in Tetbury aforesaid and now in my possession. Item I give and devise unto my nephew Christopher Quie? during his life one annuity or yearly rent of five pounds of lawfull money of Great Britain to be issuing and going out of all my lands and tenements in the parish of Tetbury aforesaid (excepting my said dwelling house and the said closes called Oldhams Grounds) and to be paid at the feast days of the Annunciation of the Blessed Virgin Mary and Saint Michael the Archangell by equal portions the first payment thereof to begin on such of the said feast days as shall next happen after my decease and for non payment thereof it is my mind and will that the said Christopher Quie? may enter and distreyn upon the premisses for the said annuity and the arrears thereof But nevertheless it is my mind and will and I do hereby declare that if the said Christopher Quie? shall alienate transfer grant assign or dispose of the said annuity or any part thereof or any wise incumber the same that then and from such alienation transferring grant assignment or disposition of the said annuity or any part thereof or his any wise incumbering the same The said annuity shall cease and not be paid any thing herein contained to the contrary thereof notwithstanding. Item I give to my said son in law Mr Body twenty pounds to buy him mourning and to the said Mr Richard Gastrell and Mr Francis Savage I give twenty pounds apeice for their pains and trouble in executing the trust hereby reposed in them. Item I give to my servant maid ten pounds. Item I give to the Vicar of Tetbury and his successors for the time being (after my wifes decease) ten shillings yearly for ever for preaching a sermon on such day of the month yearly as it shall please God to take me out of this world and I give twenty shillings more yearly to be laid out in six penny loaves and distributed to forty poor persons of Tetbury aforesaid imediately after every such sermon ended And I do hereby charge my said dwelling house in Tetbury aforesaid with the payment of the said two last mentioned sums. Item all the rest residue and remainder of my goods chattells creditts and personal estate of what nature or kind soever not herein before otherwise disposed of I give and bequeath unto my said wife and my said son James Gastrell and my said daughter Mary Body to be equally divided between them And I do hereby constitute and appoint my said wife and my said son James Gastrell and my said daughter Mary Body executors of this my last will and testament.
