I Edward England of Burrow within the parish of Kingsbury Episcopi in the County of Somerset, Gentleman, do make my last will and testament in manner and form following that is to say. First I give and devise unto my wife all my estate and interest in my messuage and tenements with the appurtenances thereto belonging situate within and parcel of the Manor of East Lambrook in the parish of Kingsbury Episcopi aforesaid And it is my wish but not my direction that she should give her interest in the premises from her death to my son Edward England. Also I give unto my said son Edward his exor’s administrators and assigns all my estate in my tenement called Robbard’s tenement situate. lying and being in Burrow aforesaid subject nevertheless to the payment of one annuity or yearly rent charge of ten shillings clear of all deductions whatsoever unto my son Robert. his exor’s admin’s or assigns during the continuance of the said estate arid also the clear annuity or yearly rent charge of ten shillings unto my son Henry, his exor’s, admin’s or assigns during such continuance and in case of non payment within fifteen days after demand I hereby empower the said Robert and Henry. their executors administrators and assigns {margin note. DW} respectively to dist--? for any arrears of the said respective amount in the usual and common way for rent also I give unto my daughter Ann? England her executors, administrators and assigns all my estate and interest in my leasehold estate commonly called Rooks situate, lying and being in the parish of Kingsbury aforesaid And also in my tenement called William James? lying at Lower Burrow in the same parish, also I give and devise unto my said daughter Ann her heirs and assigns for ever all my freehold lands in the parish of Aller in the said County with the hereditaments thereunto --? which lands I purchased of John Parker and others. Also I give and devise unto my son Thomas England. his exor’s. admin’s and assigns my two tenements called Humphrey’s and Layer’s in Burrow aforesaid with their respective appurtenances. Also I give and devise unto my said son Thomas England all my estates and interest in my copyhold estate in the parish of Kingsbury in the said County at a place there called Barry woods? and containing about six acres of ground. Also I give unto my said son Thomas, his heirs and assigns for ever that close of land called Maish or Marsh in Kingsbury aforesaid which I lately purchased of Mr Thomas Pittard subject nevertheless to the payment of one annuity or yearly rent charge of fifteen shillings clear of all deductions whatsoever unto my son Robert. his heirs and assigns for ever and another clear annuity or yearly rent charge of fifteen shillings unto my son Henry, his heirs and assigns for ever and in case of non payment within fifteen days after my decease and I hereby empower the said Robert and Henry their heirs and assigns respectively to distrain for any arrears of such respective annuities in the usual and common way for rent. I also give and devise unto my said son Thomas, his heirs and assigns for ever my close of land at Netherfield in the parish of South Petherton in the said County also I give and devise unto my son Robert England. his heirs and assigns for ever my farm called Burrow Farm with all and singular the messuages. closes, lands. heritaments and appurtenances thereunto belonging in the parish? of Kingsbury aforesaid. Also I give unto my said son Robert. his heirs, executors or administrators all my estate and interest in my close of pasture ground called Burrow Hill and in the close of pasture ground thereto belonging called the four acres with the cottages and gardens thereunto belonging in Kingsbury aforesaid also I give and devise unto my said son Robed, his heirs, executors or administrators my messuage and tenement situate, lying and being in Lower Burrow aforesaid in Kingsbury aforesaid with the lands and appurtenances thereunto belonging which I lately purchased of one Mr Sharpe. Also I give and devise my messuage, tenement and farm in Middleney in the parish of Drayton in the said County, which I purchased of Mrs Harrard? and her brother Edmund Cleeves with the appurtenances thereto belonging to the use of my two daughters Joan England and Mary England, their heirs and assigns for ever to take as tenants in common and not as joint tenants also I give unto my said son Robert his heirs and assigns for ever all that messuage or dwelling house, barn. barton and orchard in Stembridge with two large beast leazes in Kingsbury

Episcopi and one beast leaze in Shaldermead which I purchased of one John Willy in trust nevertheless in the first place for the separate and peculiar use and benefit of my daughter Elizabeth now the wife of Benjamin Brown for and during the term of her natural life and so as the same shall not be subject or liable to the debts encumbrances or control of her husband and that her receipt and acceptances from time to time for the clear rents and issues of the said premises shall be a sufficient and the only discharge for the same and from and after the death of the said Elizabeth Brown to the use of all and every the children of my said daughter Elizabeth and their respective heirs to take as tenants in common and not as joint tenants if more than one and if but one then to such only child his or her heirs and assigns for ever but in case my said daughter shall leave no lawful issues of her body then from and after her death to the use of my own right heirs for ever. Also I give and devise unto my son Stephen England, his executors, administrators and assigns all my estate and interest in my two leasehold tenements at West Lambrook within the said parish of Kingsbury Episcopi one of which is called Lavours? and the other Ducks? which tenements I lately purcharsed of the said Thomas Pittard subject nevertheless to the payment of one annuity or yearly rent charge of fifteen shillings clear of all deduction whatsoever unto my son Robert, his exuc’s, admin’s or assigns during the continuance of the said estate and another clear annuity or yearly rent charge of fifteen shillings unto my son Henry, his executors. admin’s or assigns {margin note which may fit here - ‘during such continuance and in case of non payment within fifteen days after demanded I hereby empower the said Robert and Henry their executors, administrators and assigns’ DW} respectively to disdain for any arrears of the said respective annuities in the usual and common way for rent. Also I give and devise unto my son Henry England, his heirs, executors or administrators my farm, lands and tenements called Wells? situate, lying and being in Burrow aforesaid with the hereditaments and appurtenances thereto belonging and my tenement called --? Burrow aforesaid lying in the tything of Lake? within the parish of Kingsbury aforesaid. Also I give unto my brother Henry England. Stephen and Henry his sons, Thomas Willy: of Middle Lambrook, Ambrose his son. George Gifford and James Gifford, sons of William Gifford the sum of one hundred and forty pounds to be paid them by my executors herein after named in six months next after my decease in trust nevertheless that the said trustees and the survivors and survivor of them, his executors, administrators or assigns or the major part of them or the survivors of them the said trustees do and shall from time to time and at all times after the receipt of the said sum of one hundred and forty pounds put and place out the said money at interest to such person or persons and on such security or securities either in the public --? or otherwise as they my said trustees or the survivors or survivor of them, his executors, administrators or assigns or the major part of them or of the survivors of them my said trustees shall think fit and convenient and do and shall from time to time and at all times yearly and once in every year and oftener if conveniently may --? clear interest and products thereof unto such person or persons as shall be minister or ministers of or for the society? of persons under the --? of --? or Protestant dissenters usually assembling for the worship of God at Middle Lambrook Meeting House in the County of Somerset his or their better and more comfortable subsistence. Maintenance and support and m will further is that when the said trustees hereby appointed? shall be by death reduced to th-? that then such three trustees or the major part of them shall and I do hereby empower and direct them to grant, assign and transfer the said sum of one hundred and forty pounds and the said securities or security of and for the same unto such seven or more other persons as such three trustees or the major part of them shall think fit and convenient upon the trusts and for the -? and intacts? and with a like power of removing? the trustees as in this my will mentioned and so from time to time and at all times in like manner and order for ever and it is my will and I hereby direct that in case I should happen to die within the space of two years next after the date hereof then the executors of this my last will shall and take the yearly rents, issues and profits of all and singular the aforesaid freehold, leasehold and copyhold estates except the tenement which I purchased of John Willy to and for their own use in order the better to enable them speedily to discharge my debts paying also out of such rents unto my four children Ann, Thomas, Joan and Mary the clear yearly sum often pounds each by quarterly payments which I hereby give them for and towards their maintenance until the end of two years to be computed from the day of the date hereof and no longer any thing in this will contained to the contrary notwithstanding and I direct that the annuities above charged on the respective estates hereby given or disposed to my sons Thomas, Stephen and Edward respectively shall not grow? such or be payable while the profits of such estates shall be received by my sons Robert and Henry. Also! give my household goods and furniture and my cyder wrings and mills and all my cyder casks and vessels unto my three Sons Robert, Henry and Thomas equally to be divided between them share alike. Also I give unto the children of my late brother Richard England --? ten pounds a piece to be paid them respectively upon their respective attaining the age of twenty one years. All the rest, residue and remainder of my chattels, stocks, funds, monies, mortgages and securities for money and all other my personal estate whatsoever and wheresoever and of what nature, kind or quality soever the same may be subject to the payment of my debts and funeral expences and the aforesaid sum of one hundred and forty pounds which can and may be raised out of such residuum? I hereby give unto my two sons Robert and Henry equally to be divided between them share and share alike. And all the rest, residue and remainder of my freehold lands, tenements and hereditaments I give and devise unto my said two sons Robert and Henry and their heirs as tenants in common and not as joint tenants subject to the payment of my debts and I hereby nominate and appoint my said sons Robert and Henry to be executors of this my last will and testament. In witness whereof I the said Edward England the testator have to this my last will and testament contained in this and the four preceding sheets of paper set my hand and seal (to wit) my hand at the bottom of each of the said four preceding sheets and my hand and seal to this last sheet of paper the twenty first of November in the year of our Lord one thousand seven hundred and eighty two. The writing contained in this and the four preceding sheets of paper was signed and sealed by the above named Edward England the testator and by him published and declared as and for his last will and testament in the presence of us who have hereunto subscribed our names as witnesses thereto in his presence at his request and in the presence of each other. This will was proved at London the thirty first day of August in the year of our Lord one thousand seven hundred and eighty four before the Right Worshipful Peter Culvert, Doctor of Laws. Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the oath of Robert English and Henry English, the sons and the executors of the said will to whom administration was granted of all and singular the goods, chattels and credits of the said deceased they having been first sworn by commission duly to administer.
