This is the last will and testament of me Thomas Dumayne of the parish of Nash in the county of Monmouth, Gentleman, made whilst of sound and disposing mind, memory and understanding, in manner and form following (that is to say) In the first place I give unto my my friend John Cobb of Spring Court near Castletown in the County of Monmouth, Gentleman, all those my leasehold farms, lands and premises granted me for three lives of which but one is now unexpired situate and being in the parish of Bassaleg in the said County of Monmouth now in the occupation of Michael Smith and Edward Leonard to hold to him the said John Cobb, his heirs and assigns for and during the natural life of Mary Lewis of Bassaleg, spinster, (being the only surviving life of the said three lives), in trust to receive and take the rents and profits thereof in order in the first place to liquidate the debt or sum of one hundred and seventy five pounds and interest due from me to the heirs of Anna Maria Powell late of the Town of Newport deceased and after such payment so made shall and will yearly and every year during the said life of the said Mary Lewis receive the rents, issues and profits thereof and apply the same to and amongst my children share and share alike or as he, my said executor hereinafter named shall see fit. Whereas there is now due and owing to William Brewer of the Town of Newport aforesaid, shopkeeper, for interest money due by mortgage on the messuage and premises I now reside in in the parish of Nash aforesaid the full and just sum of two hundred and forty pounds. Now I do hereby will and direct that my said executor do with all speed after my decease by and out of the monies arising by sale of all or any part of my personal property as he shall see fit to dispose of, pay off and discharge the said sum of two hundred and forty pounds and all other my just debts, funeral expences and the costs and charges of proving this my will and other incidental expences, attending the same and after such payments well and truly made as aforesaid shall and will pay and apply the overplus of such monies (if any) and all the rest and residue of my personal property and effects whatsoever unto and amongst all and every of my said children to be equally divided between them share and share alike, he my said executor first reimbursing himself all such costs & charges as he shall be put to in and about the execution of the trusts here by in him reposed. And I do hereby nominate, constitute and appoint the said John Cobb sole executor of this my last will and testament hereby revoking all former wills by me at any time heretofore made and do publish and declare this only to be my last. November 15th 1803 David Jones (Psh Xchurch), principal creditor of the said deceased (John Cobb the executor in the forgoing? will named having first renounced?) was sworn to the truth of the said will annexed to the admon & to the faithfull performance of the same to exhibit an inventory &c to render a --? and that the goods, chattels and credits of the said deced do not amount in value to ye sum of £100 before me. Know all men by these presents that we David Jones of the parish of Nash in the County of Monmouth, farmer, John Cob of the parish of in the said County, Gentleman and Llewellin Thomas of Landaff? --? are held and firmly bound unto the Right Reverend Father in God Richard by Divine permission Lord Bishop of Landaff in two hundred pounds of good and lawfull money of the United Kingdom of Great Britain and --? to be paid to the said Lord Bishop or his certain attorney, executors, administrators or assigns for the faithfull payment whereof we bind ourselves and each and every of us firmly --? for the whole and --? part thereof --? and --? executors and administrators of us and each and every of us firmly by these presents Sealed with our seal dated the fifteenth day of November in the year of our Lord one thousand eight hundred and three.
The condion of the above aligation is such that if the above bounden David Jones a creditor of Thomas Dumayne late of the parish of Nash in the County of Monmouth and Diocese of Landaff widower, deceased, and adminstrator --? will annexed? of all and singular the goods, chattels and credits of the said deceased do make or cause to be made a true and perfect inventory of all and singular the goods, chattels and credits of the said deceased which have or shall come to his hands, possession or knowledge or into the hands or possession of any other person or persons for him? And the same so made do exhibit or cause to be exhibited into the registry of the said Consistory Court of Landaff on or before the fifteenth day of February next ensuing --? Same goods, chattels and credits and all other the goods the goods, chattels and credits of the said deceased do well and truly administer according to law (that is to say) to pay the debts of the said deceased which at the time of his death did owe then the legacies in the said will annexed mentioned as far as the goods, chattels and credits of the said deceased will thereunto extend and the law require and the rest, residue and remainder of the said goods, chattels and credits of the said deceased which shall be found remaining on the said administrators account and not otherwise disposed of in the said will annexed to the said Letter of Administration the same having been first examined and allowed by the judge of the said court for the time being shall distribute? and pay unto such person or judge. And lastly shall save harmless the said Lord Bishop and all his officers whatsoever against all persons whatsoever having or pretending to have any right or interest to the said goods, chattels and credits. Know all men by these presents that we Thomas Dumayne, John Dumayne, Sarah Dumayne, George Dumayne and Mary Dumayne the natural and lawful children of Thomas Dumayne late of the parish of Nash in the County of Monmouth, Esquire, deceased, being in our minority (to wit) of the several ages of twenty, nineteen, seventeen, fifteen and thirteen years but under the age of twenty one years and therefore incapable of either acting in our own names, or of taking upon ourselves or either of us the execution of renouncing the Letters of Administration with the will annexed, of all and singular the goods, chattels and credits of our late father, deceased, have and do by these presents make choice of our uncle John Cobb of the parish of Marshfield in the said County of Monmouth, Gentleman, to be our curator or guardian for us, and in our name, to renounce the Letters of Administration of the goods, chattels and credits of the said deceased, and to the end that this our election of a guardian may have its due effect in law. We do hereby nominate and appoint David Jones of Drainllwyn in the County of Monmouth aforesaid, Gentleman, to appear for us, and in our name, before the Worshipful Benjamin Hall, DD, Vicar General and Official Principal of the Right Reverend Lord Bishop of Landaff or his Surrogate or some other competent Judge in this behalf to exhibit this our election and pray the same to be admitted and enacted and the said John Cobb to be our guardian for the purpose of renouncing for us and in our name the Letters of Administration with the will annexed of all and singular the goods, chattels and effects of the said deceased. On the 15th day of November 1803 at Landaff, Letters of Admon with this will annexed were granted and commutted? to David Jones a principal creditor, John Cobb the sole exor having first renounced as well for him self as for the children of the said deceased for which purpose he was appointed their guardian by the Chancellor
