Morgan Bullock of Monmouth 1768.

In the name of God Amen this is the last will of me Morgan Bullock of the Town of Monmouth in the County of Monmouth Clerk made this sixteenth May in the eighth year of the Reign of our Sovereign Lord George the third by the Grace of God of Great Britain France and Ireland King defender of the faith and so forth and in the year of our Lord one thousand seven hundred and sixty eight. First my will and desire is that my dear wife Pleasant Bullock may be permitted to have hold and enjoy all that messuage or tenement wherein I now do dwell together with the buildings gardens orchards and appurtenances thereunto belonging in as large and ample a manner as I am now possessed of the same together with the use of all the furniture plate household goods and linen which shall be therein or belonging there unto at the time of my decease for and during the term of her natural life and from and after her decease my further will is that the sd furniture plate household goods and linnen shall be left and remain in the said house and be considered and deemed as appurtenant there unto for the use and benefit of the several persons intitled to the said premisses under and by virtue of a settlement made on the marriage of Richard Bellamy of the said Town of Monmouth Clerk with my niece Frances his present wife and to every of them successively and in remainder but in case the said Richard Bellamy or such other person or persons who shall claim or be intitled to the said messuage and premisses by virtue of the said settlement shall interrupt my said wife in the quiet possession and enjoyment of all or any part of the premisses aforesaid that then I give and devise unto my said wife all those my several messuages or tenements with the buildings gardens outletts and appurt’s there unto belonging scituate in a certain street in the said Town of Monmouth called Saint Mary Street and now or late in the several tenures or occupations of William Marrett James Jenkins Luke Phillips Mary Evans widow Catherine Durham widow and Hezekiah Fleming to my hold? to my said wife for and during the term of her natural life for and in lieu of the messuage and premisses first mentioned and by me intended for her as aforesaid and from and after the determination of the estate and interest of my said wife of and in the said last mentioned premisses in St Mary Street as aforesaid (either by the --? and uninterrupted possession and enjoyment of the messuage with its appurt’s wherein I dwell or by the death of my said wife which shall first happen then I give and devise the said messuages with there appurt’s before mentioned to scituate in Saint Mary Street to the use of the said Richard Bellamy and his assigns for and during the term of his natural life and from and after the determination of that estate there? to the use and behoof of William Cadell of Powlton Mill in the parish of Westbury and County of Gloucester Gentleman and Sybil Penry of the Town of Monmouth aforesaid spinster and their heirs during the natural life of the said Richard Bellamy upon trust to preserve the contingent remainders herein after limitted or devised from being defeated or destroyed and for that purpose to make entries and bring actions as the case shall be and require yet nevertheless to permit and suffer the said Richard Bellamy to have receive and take the rents issues and profits thereof for and during the term of his natural life and from and after the decease of the said Richard Bellamy to the use and behoof of the first son of the said Richard Bellamy on the body of the said Frances his wife lawfully begotten or to be begotten and to the heirs male of the body of such first son lawfully issuing and in default of such issue to the use and behoof of the second third fourth fifth and all and every other son and sons of the said Richard Bellamy on the body of the said Frances his wife lawfully begotten or to be begotten severally successively and in remainder one after another as they and every of them shall be in seniority of age and priority of birth and the several heirs male of the body and bodys of all and every such son and sons respectively issuing the elder of such son and sons and the heirs male of his body lawfully issuing being always to be preferred and to take place before the younger of them and the heirs male of his body lawfully issuing and in default of such issue to the use and behoof of the heirs of the body of the said Frances by the said Richard Bellamy lawfully begotten or to be begotten and for want of such issue to the use and behoof of my nephew Thomas Bullock for and during the term of his natural life and from and after his decease to the use and behoof of the said William Cadell and Sybil Penry and their heirs in trust to preserve the contingent remainders herein after mentioned with remainder to the first son of the body of my said nephew Thomas Bullock lawfully to be begotten and the heirs male of the body of such first son lawfully issuing and in default of such issue to the use and behoof of the second third fourth fifth and all and every other son and sons of the body of the said Thomas Bullock lawfully to be begotten severally successively and in remainder one after another as they and every of them shall be in seniority of age and priority of birth and the several heirs male of the body and body of all and every such son and sons respectively issuing the elder of such son and sons and the heirs male of his body lawfully issuing being always to be preferred and to take place before the younger of them and the heirs male of his body lawfully issuing and in default of such issue to the use and behoof of my nephew Charles Penry Bullock brother of the said Thomas Bullock and his heirs and assigns for ever. Item I give and devise unto my said wife Pleasant Bullock all those messuages tenements farms and lands called Villindre and Little London now in the occupation of Thomas Watkins and his under tenant or tenants situate lying and being in the parish of Saint Weonards in the County of Hereford and also all that barn and buildings with the farm and lands thereto belonging in the parish of Monmouth now in the occupation of John Tibbs innholder and a piece of ground in the same parish lying in an estate called the New Anchor Hill in the occupation of John Ambrose also all those two stables with the coach house buildings garden and land there unto adjoining and belonging late in the tenure of Sr Onesephorus? Paul or his under tenants and now of George Catchmayd and his under tenants and also all that messuage farm and lands situate at Wysham in the parish of Dixton and County of Monmouth now or late in the tenure of William Godwin together with all other the messuages and lands whatsoever and wheresoever of me the said Morgan Bullock and not comprized and mentioned in the deed of settlement made on the marriage of the said Richard Bellamy with Frances his wife aforesaid to hold to my said wife Pleasant Bullock for and during the term of her natural life subject to the payment of the annuitys herein after mentioned and from and after her decease to the use and behoof of the said Richard Bellamy for and during the term of his natural life and from and after his decease then to the use and behoof of the said Sybil Penry and William Cadell and their heirs during the natural lives of the said Pleasant Bullock and Richard Bellamy in trust to preserve the contingent remainders herein after limited from being defeated or destroyed and for this purpose to make entrys and bring actions as the case shall require but nevertheless to permit and suffer my said wife and the said Richard Bellamy to receive and take the rents issues and profits thereof during the term of their respective natural lives and from and after their deceases and the decease of the survivor of them then to the use and behoof of the first son of the said Richard Bellamy on the body of the said Frances his wife lawfully begotten or to be begotten and the heirs male of the body of such first son lawfully issuing and in default of such issue to the use and behoof of the second third fourth fifth and all and every other son and sons of the said Richard Bellamy on the body of the said Frances his wife lawfully begotten or to be begotten severally successively and in remainder one after another as they and every of them shall be in seniority of age and priority of birth and the several heirs male of the body and bodys of all and every such son and sons respectively issuing the elder of such son and sons and the heirs male of his body lawfully issuing being always to be preferred and to take before the younger of them and the heirs male of his body lawfully issuing and in default of such issue to the use and behoof of the heirs of the body of the said Frances by the said Richard Bellamy lawfully begotten or to be begotten and for want of such issue to the use and behoof of the said Thomas Bullock for and during the term of his natural life and from and after the determination of that estate to the use and behoof of the said Sybil Penry and William Cadell and their heirs for ever during the natural life of the said Thomas Bullock in trust to preserve the contingent remainders herein after mentioned with remainder to the first son of the body of the said Thomas Bullock lawfully to be begotten and the heirs male of the body of such first son lawfully issuing and in default of such issue to the use and behoof of the second third fourth fifth and all and every other son and sons of the body of the said Thomas Bullock lawfully to be begotten severally successively and in remainder one after another as they and every of them shall be in seniority of age and priority of birth and the several heirs male of the body and bodys of all and every such son and sons respectively issuing the elder of such son and sons and the heirs male of his body lawfully issuing being always to be preferred and to take place before the younger of them and the heirs male of his body lawfully issuing and in default of such issue to the use and behoof of my said nephew Charles Penry Bullock his heirs and assigns forever provided always and I do hereby declare it to be my will that it shall and may be lawfull to and for the first or such other of the sons of the said Richard Bellamy by the said Frances his wife as shall from time to time be intitled to the inheritance of the premisses so limitted to him as aforesaid under and by virtue of this my will by any deed or writing by him duly executed to grant and convey all and singular the premisses so limitted as aforesaid or any part thereof and not comprized in the settlement made on the marriage of the said Richard Bellamy with the said Frances his wife to and to the use of any woman with whom he shall think proper to intermarry for and during the term of her natural life only by way of jointure so? as such settlement be not made dispunishable of waste or to take place till the death of the said Pleasant Bullock and Richard Bellamy and provided such wife shall bring or be intitled to a fortune of one thousand pounds and upwards but not otherwise and whereas there is reserved to me a power in and by the before mentioned settlement made on the marriage of the said Richard Bellamy with the said Frances his wife to give and dispose of all and singular the messuages lands and premisses therein comprized to such persons and for such uses as I should by my last will and testament think proper in case the said Richard Bellamy should leave no issue of his body lawfully begotten at the time of his decease now in pursuance and by virtue of such power I do hereby give and devise all such messuages and lands so mentioned and contained in the said settlement and the reversion and reversions remainder and remainders thereof and all the right and interest reserved to me therein from and immediately after the death of the said Richard Bellamy without issue as aforesaid to the use and behoof of the said Thomas Bullock for and during the term of his natural life and from and after his decease to the said trustees and their heirs to preserve contingent remainders with remainder to the first and other sons of the said Thomas Bullock in the same order manner and form as the other messuages and premisses are before devised by this my will with remainder to the said Charles Pinay Bullock his heirs and assigns forever. Item I give and devise unto Thomas Gabriel of the said Town of Monmouth gardiner all that messuage or tenement with its rights members and apput’s wherein the said Thomas Thomas Gabriel doth now inhabit and dwell and all my right title and interest therein or there unto to hold to the said Thomas Gabriel and his assigns for and during the term of his natural life and from and after his decease to the said William Cadell and Sybil Penry and their heirs during the life of the said Thomas Gabriel in trust to preserve the contingent remainders herein after limitted from being defeated and destroyed and for that purpose to make entries and bring actions as the case shall require but nevertheless to permit and suffer the sd Thomas Gabriel to receive and take the rents issues and profits thereof for and during the term of his natural life and after the decease of the said Thomas Gabriel to Elizabeth Evans grandaughter of the said Thomas Gabriel and one of the daughters of Edward Evans of the sd Town of Monmouth cooper by Martha his late wife deceased and the heirs of her body lawfully to be begotten and for want of such issue to the use and behoof of her sister Mary the other daughter of the said Edward Evans by the said Martha her heirs and assigns for ever. Item I give unto my brother William Bullock one annuity or yearly sum of five pounds for and during the term of his natural life and unto my brother Charles Bullock the like annuity or yearly sum of five pounds for and during the term of his natural life and unto my brother Robert Bullock the like annuity or yearly sum of five pounds for and during the term of his natural life which said several annuitys my will is shall be paid by my said wife out of the rents and profits of the premisses so given to her as aforesaid for so long time as she shall live and after her decease by my executor herein after named I also give and bequeath the sum of three hundred pounds to be paid unto William the son of my said brother Charles Bullock when he shall attain the age of twenty one years without interest for the same and unto all the rest of my brothers and sisters children the sum of twenty pounds a piece to be paid by my executor herein after named in manner following (that is to say) to such as shall be of the age of twenty one years at the time of my decease in twelve months after my death without interest and to such as shall not be of that age and to so many of them as shall be living then on their attaining the age of twenty one years with lawfull interest for their said legacys to commence from the time of my decease. Item I give and bequeath unto my sd wife all and singular her plate money securities for money together with the interest which might be due and in arrear thereon at the time of my death and all rent due and in arrear at my death from the tenants of the farms and lands at Llanvihangell which I hold in right of my said wife her household goods personal estate and effects whatsoever which she was possessed of or belonged to her before our intermarriage for her own sole and separate use and to be at her absolute disposal I also give to my said wife my single horse chaise with the harness thereto belonging and any one of the horses or mares which she shall think proper to make choice of and I shall be owner of at the time of my decease all my money securitys for money together with the rest and residue of my personal estate and effects of what nature or kind soever and not before disposed of I give and bequeath unto the said Richard Bellamy subject to the payment of the before mentioned legacys and my just debts and I do nominate and appoint him the said Richard Bellamy sole executor of this my will hereby revoking all other wills by me at any time heretofore made and do declare this only to be my last will and testament and if it should happen that my personal estate and effects should not be sufficient for the full payment of such legacys and debts then my will and desire is that my executor in consideration of the several devises before made to him shall and will supply and make up such deficiency out of and with his own private money and lastly it is my express will and meaning and I do hereby order and direct that if any person or persons to whom any legacy or legacys is or are given or to whom any benefit or advantage arises or is intended to arise from under or by reason of this my will shall at any time or times hereafter commence any suit or suits at law or in equity against my executor herein before named or any other person to whom I have given or bequeathed any thing in this my will or otherwise disturb or interrupt them or either of them in the due execution thereof or in the receiving quiet enjoying and possessing of what is by me therein given according to the intent and meaning of the same that then my will is that all and every legacy gift and bequest before given to such person or persons --? shall sue or disturb as aforesaid and all benefit and advantage accruing or intended to accrue to them or either of them from by or under this my will shall cease determine and be utterly void to all intents and purposes whatsoever any thing herein contained to the contrary thereof in any ways notwithstanding. In witness whereof I the said Morgan Bullock have to this my last will and testament contained in six sheets of paper to the five first sheets thereof subscribed my name and to this last thereof set my hand and seal the day and year before written. This will was proved at London on the twenty sixth day of September in the year of our Lord one thousand seven hundred and sixty eight before the Right Worshipfull George Hay, Doctor of Laws &c by the oath of the Reverend Richard Bellamy, Clerk, the sole executor named in the said will to whom administration was granted of all and singular the goods chattels and credits of the said deceased having been first sworn by Commission duly to administer
