In the name of my ??? Lord and Saviour I Micajah Lindsey
being of sound mind and memory take my pen in hand to make this
my last will and testament as follows.
First of all I will and bequeath my body to the literal
grave and my love to that God that first and is to me and
Secondly I will and bequeath to my beloved wife Elizabeth
Lindsey one third of my personal estate her lifetime and then each
heir to have their proportionable part of that third part of my Estate
and
Thirdly I will and bequeath to my loving and obediant
children the other two thirds of my estate namely James Lindsey,
Jane Davis, Mary Franklin, B.L. Lindsey, Holland Lindsey, William C
Lindsey and Elizabeth Jowell [?) all an equal and proportionable part
except B. L. Lindsey and Holland Lindsey and Elizabeth Jowell.
I will and Bequeath unto B L Lindsey and Holland Lindsey
ten dollars each the remainder of then proportionable part I will
and bequeath unto their lawful heirs to be p??? to the said B L Lindsey
and Holland Lindsey.
Lands to be equally divided and handed over as they severally
become of age. I will and bequeath unto Elizabeth Jowell all of her
proportionable part except one hundred dollars that John Jowell her
husband got[?] at Pontotoc to enter the Land he now lives on and Elizabeth
Jowell part be kept by James Lindsey and to handed to her as need requires
to her and her children does come to ??? and if James Lindsey or her husband
John Jowell death or either of them death to be handed to the said Elizabeth
Jowell to use at pleasure and Jane Davis and Mary Franklin to have one
half of their part handed to them to dispose of at their own discretion
and
I appoint James Lindsey and Holland Lindsey to supervise
the business and to have a reasonable compensation for their trouble
and ??? recommend a private sale to ??? I want all my worldly
debts paid and if any thing should arise against me either before
or after the date of this will I want it paid out of the estate before
the division. February fifteenth AD 1845.

"Two of the very first white settlers around here were
Micajah C. Lindsey (1775-1845) and his wife, Elizabeth McClurkin
Lindsey. They lived, reportedly, in the vicinity of the present Lindsey
Cemetery among the hunting Chickasaws before the indian Removal. After
the land office opened at Pontotoc, Micajah entered in excessof 3,000
acres of land in a matter of a few years. In March 1840, he sold seven
various quarter sections of land to William Carroll Lindsey, his son,
for $2,500. Micajah Lindsey died in 1845, probably the first person buried
in the present Lindsey Cemetery between Belmont and Dennis.
...Daughters of Micajah and Elizabeth Lindsey were Jane
(Mrs. Matthew Davis), Mary (Mrs.David Franklin), and Elizabeth (Mrs.
John Joel). James Lindsey, Holland Lindsey, Bazzle L. Lindsey were
also sons of Micajah."

inhabitants. We have James, Basel, Holland and possibly William Carrol
as boys under 21, and Jane and Mary as girls under 21 at that time.
So we're missing a boy.
The names just above and below Micajah's on this census
are: Caleb, James and Martin Fryly, Andrew Pucket, John Wood, Joseph
Thompson, Zach Taylor, James Barnes, Duncan Johnson.

An Act to alter and extend the bounds of Jefferson county and for other
purposes.
Section 1. BE it enacted by the Senate and House of Representatives of the
State of Alabama in General Assembly convened, That all that part of St. Clair
county lying within the following bounds, viz: beginning where the line dividing
the county of St. Clair and Shelby leave Jefferson county thence along said
line to the Cahawba river, thence up said river to the mouth of a creek commonly
called Grimnuts fork, thence up said creek to its extreme head, thence north
to the line dividing townships fourteen and fifteen, thence along said line
to Hartgroves, at the head of Jones' Valley, be and the same is hereby constituted
and made a part of the county of Jefferson.
Sec. 2. And be it further enacted, That in addition to the election precincts
heretofore established in Jefferson county, there shall be one at the house
of Micajah Lindsey, Esquire.
Sec. 3. And be it further enacted, That this act shall be in force from
and after the first day of April next.
[Approved, December 20, 1820.]
Then, enacted on 3 Dec 1821,

AN ACT
To establish additional Election precincts in certain counties therein named,
and for other purposes.

Sec. 15. And be it further enacted, That there be an additional election
precinct, at a place called the Old town in Jefferson County.
Sec. 16. And be it further enacted, That the third section of an Act, to
repeal the second section of an Act passed the twentieth December one thousand
eight hundred and twenty to establish certain election precincts therein mentioned,
and for other purposes be, and the same is hereby repealed.
Sec. 17. And be it further enacted, That the election precinct formerly
held at Squire Lindsey's be discontinued, and in future held at Squire Saunders.

According to a manuscript by Lois Meyers, as found in the Family History
Library in Salt Lake City, Micajah was a Justice of the Peace in Jefferson
Co. in 1820, which would possibly explain the title "Esquire".

There is some question as to whether Richard McClurkin
or James McClurkin was Elizabeth's father and the husband of Jane
Dunwoody.
Marriage Notes for MICAJAH LINDSEY and ELIZABETH MCCLURKIN:
Probably Elizabeth and Micajah were married in South
Carolina, in the Spartanburg area, as Micajah and some of the McClurkin's
had land dealings in the 1790's in that area. However, Rutherford
County NC is a possibility, since they had land dealings there, also.
