  Be it remembered that on this day of June in the year Eighteen Hundred and fifty nine personally appeared in open Court John M. Shank and Silas Hale of lawful age who being duly sworn according to law, depose and say;  that they are subscribing witnesses to the last will and testament of Austin Webb, late of Sugar Creek Township Greene County, Ohio now deceased; the paper here shown them marked " A "

is the said will; that they were present and saw the testator sign and heard him acknowledge the same as for his last will and testament; that at the time of signing and acknowledge the same, said testator was of sound and disposing mind and memory, over twenty one years of age, and that he signed and acknowledged the same freely, voluntarily, and without any restraint as they verily believe; that they sign the same as witness, in his presence, and in the presence of each other and at the request of said testator. Further they say not. Silas Hale/ John M. Shank. Sworn to and subscribes before me in open Court the day and year first above written.

  Preceedings in Probate Court before Honorable James W. Harper, Probate Judge within and for the County of Greene in the State of Ohio, at the Court House in Xenia in said County, on the fourth day of June, in the year of our lord one thousand eight hundred and fifty nine.

            The State of Ohio Greene County  ss.

 

  Be it remembered that on the same day and year last aforesaid, the last will and testament of Austin Webb late of said County deceased was produced in Court for probate; Silas Hale and John M. Shank the subscribing witnesses thereto appeared and in open Court testified to the due execution of said will. Which said testimony was reduced to writing, by said witnesses respectively subscribed filed with said will. And it appearing to the satisfaction of the Court from said testimony that the said will was duly attested and executed, and that the testator at the time of executing the same, was of full age of sound and disposing mind and memory, it is therefore ordered by the Court  that said will stand admitted to probate, and that the same together with the proof thereof be recorded.

  Where upon Allen Webb and Martin Webb the Executors in said will named and appointed appeared in Court, and signified their acceptance of the trust of executing said will. There upon it is ordered by the Court that letters testamentary issue to them upon their giving bonds in the penal sum of one thousand six hundred dollars conditioned according to law. The Court appoints Silas Hale, James Turner and Solman Shank appraisers of the personal estate of said Testator.

  The said Will and the proof thereof so ordered to be recorded as aforesaid, are in the words and figures following, it it to say:

  In the name of the benevolent Father of all I Austin Webb of the County of Greene in the State of Ohio do make and publish this my last will and testament as follows. " first " It is my will that all just debts and reasonable charges and expenses be fully paid out of my personal property.  " second"  I hereby will and bequeath all the remainder of my property both real and personal  to my son James Webb during his natural life. " Third "  I do hereby nominate and appoint my son Allen Webb & Austin Webb Guardians for my son James Webb he not being able or competent to manage for himself.  " fourth "  It is my will that Clarissa Webb my youngest daughter remain at home on the farm with my son James to attend and take care of him as long as she may think proper for which service my executors shall allow her a reasonable compensation. " fifth "  It is my will that after the death of my son James Webb all my estate both real and personable be equally divided amongst all my children.  " sixth "  I hereby revoke all former wills made by me.  " Seventh "  I hereby nominate and appoint my sons Allen Webb and Austin Webb my Executors of this my last will and testament. In testimony whereof I have hereunto set by my hand and Seal this 15th day of December A. D. 1859.
