To the honorable the Judge of the Orphans
Court of Berks county.
The petition of Elizabeth Stout, widow,
and sister and heir at law of Conrad Christ, late of Bern Township, Berks
County, yeomen, deceased. Respectfully showeth:
That your petitioner said brother,
Conrad Christ, died intestate on or about the 10th day of June in the year
1841, leaving no widow nor any lineal descendant, but leaving your petitioner
and children of a deceased Brother, John Christ, of which said children
there are now living, John, David, Jacob, Benjamin and David Christ.
Maria, intermarried with John Stout, Esther intermarried with - Seaman,
and Elizabeth Christ and children of a deceased sister, Catharine, married
to -Seltzer of which said children there are now living, George Seltzer
and Elizabeth intermarried with - Ebouch, All of whom are of full age,
excepting David Christ who is yet in his minority under the guardianship
of John Buck:
And that the said Intestate died seized
in his demise or offer, of and in a certain Messuage, plantation and tract
of land, situate in the township and county aforesaid, bounded by lands
of John Geiss, John Christ, late Philip Filbert, Peter Umbenhauer and others
and containing about one hundred acres more or less with the appurtenances.
Your petitioner therefore prays your
Honor to avoid an Inquest and make petition of the premises aforesaid to
and among the petitioners and the nephews and ni4ece and representative
of the said intestate, in such manner and in such proportions as of the
law of this commonwealth is directed if such partition can be amade without
prejudice to or exhorting of the whole, but if such partition cannot be
made thereby as aforesaid, then to value and appraise the same. And
further to enquire and ascertain whether the said Real Estate with the
appurtenance will conveniently now --- one of the heirs of said decedent
and if so how many it will conveniently accommodate and make report of
the proceeding at next Orphans' court
And she will pray

Elizabeth Stout, widow, Sister and Heir at
law of Conrad Christ, late of the township of Bern, in said county, yeoman
deceased, preferred a Petition to the Judges of the Orphans' court of the
said county, setting forth that the said Conrad Christ, dec'd on or about
the 10th day of June 1841, leaving no widow, nor lineal decedent, but leaves
petitioner and children of a deceased brother, John Christ of which said
children there are; John, Daniel, Jacob, Benjamin and David. Maria
intermarried with John Stout, Esther, intermarried Seaman and Elizabeth
and children of a deceased sister Catharine Seltzer, of which said children
now living, George Seltzer and Elizabeth intermarried with Wm Ebaugh, the
said David, being in his minority and under the guardianship of John Bucks.
That the said intestate, at the time
of his decease was seized in his demesne as of fee and in a certain messuage,
plantation and Tract, situate in the Township and County aforesaid bounded
by lands of John Geiss, John Christ, late, Philip Peter Umbehocker and
others and containing about one hundred acres more or less with appurtenances.
