Last Will & Testament of Thomas McCune: Recorded in Huntingdon Co., PA Will bk. 1 pg. 192

In the Name of God Amen, I Thomas McCune of Frankstown Township, Huntingdon County and State of Pennsylvania being sick of body but of sound mind & memory, do this fifteenth day of February in the year of our Lord One thousand eight hundred and two make and publish this Instrument of writing as for my last will and testament in manner and form following that is to say,

Imprimis and first of all, I order and allow all my just debts to be well and truly paid,

Secondly, I give and bequeath to my beloved wife Margaret McCune the one third of my estate real and personal after deduction of the one third of my debts and other expenses that may accrue until full settlement in fully made,

Thirdly, I give and bequeath unto my son Joseph McCune, one seventh part of the net proceeds of my estate real and personal after deduction of my beloved wifes thirds and of debts and other expenses in fully satisfied and

Fourthly, I give and bequeath unto my son James McCune one seventh part of the net proceeds of my real and personal estate after deduction of my beloved wifes thirds and debts and other expenses that may accrue before settlement in satisfy and

Fifthly, I give and bequeath unto my son Archibald McCune, one seventh part of my real and personal estate after deduction and aforesaid

in the sixth place I give and bequeath unto my daughter Mary Caldwell one seventh part of my real and personal estate after deduction of my beloved wifes thirds, debts and other expenses which may accrue until settlement and thirty pounds value she has got hereto be accomplished for in her one seventh part and,

In the seventh place I give and bequeath unto my daughter Elizabeth McCune one seventh part of my real and personal estate my beloved wifes thirds, debts and other expenses that may accrue before settlement first being satisfied and

in the eight place I give and bequeath unto my daughter Margret McCune one seventh part of the net proceeds of my real and personal estate after deduction of my beloved wifes thirds, debts and other expenses that may accrue before settlement being satisfied and

Ninthly I give and bequeath unto my daughter Isabella McCune one seventh part of the net proceeds of my personal and real estate after deduction of my beloved wifes thirds, debts and other expenses that may accrue before settlement being satisfied and

lastly I constitute and appoint my son Joseph McCune sole executor of this my last will and testament to execute the same agreeable to the true intent and meaning thereof and further I order and deem the place I live on to be occupied by my son Joseph and Archibald McCune in common with their mother for hour years after my decease, without paying any rent therefore as a compensation for their attending law suit, now in the law, also I order by this my last will and testament that after the law suit is terminated that then immediately after a settlement may take place and that the dividends becoming one to each Legatee, be paid if the executor can without injury to himself can so do, but if he cannot so perform, my will is that he paying interest to each on their de vend he must not be distressed for it before four years after the law suit is fully ended, and by this my last will and testament I do empower my dear son Joseph McCune the sole executor of this my last will and testament to convey any lands which I should convey also receive and in charge ? all D__? whatsoever in law equity? of otherwise by this my last will and testament revoking and making void all other wills, gifts and ever made by me hereto and declaring this to be my last will and testament, In testimony whereof I have hereunto set my seal dated as first above written

Signed, sealed, published, pronounces and declared by Thomas McCune as for his Last Will and Testament in our presence who were witness thereunto at testators request

On the 29th day of April 1802 before me the Subscriber Register for the Probate of Wills and granting letter of administration in and for the County aforesaid personally came James Sommerville and George Wareham who being duly sworn according to law did depose and say that they were present and did see and hear the within named Thomas McCune sign seal publish pronounce and declare the within instrument of writing to be his last will and testament and that at the time of such signing he was of sound and __mind and memory, that they subscribe their names thereunto as witness in the testator presence that his legacy? sworn and subscribe
