Marriage: 06 Feb 1901 Benzie Co., MI; I have in my possession a color photocopy of the marriage certificate for this couple. The original is in the possession of my father, James B. Ebenstein (Benzie County, Michigan, clerk's, Marriage records.

Obituary: __ Jul 1953 Big Rapids, Mecosta Co., MI; From newspaper clipping found in papers of Nancy Ann Ebenstein, origin unknown, although the headline indicates that it may have been from a paper in Kalkaska. As the other obituary found is definitely from the Big Rapids Pioneer, this one cannot be. Note that the two obituaries are exactly the same, with the exception of the headlines. It is obvious that the funeral home provided the text to the newspapers.

1. Letter from Gordon McAfee, MD, Springfield, MO, dated 17 May 1983.

To Whom It May Concern:

RE: EBENSTEIN, Earl

Mr. Ebenstein is a 77 year old male who has been living at Mt. Vernon Park Care Center for several months. He has been transferred to St. John's Marian Center because he has been a problem to manage at the nursing home and because he needs evaluation for a competency hearing which is scheduled for May 18, 1983.

Mr. Ebenstein had been living with his wife. It is noted in the notes at Marian Center that one of the nurses had known him at Cox Medical Center last summer, and at that time they were encouraging his wife to admit him to a nursing home for care because he was becoming a problem to care for. He was confused and had memory problems at that time. She had elected to keep him with her and look after him. Following this, last fall, she apparently was killed in a car wreck; and since then, he has been staying at Mt. Vernon Park Care Center. This history is from people other than Mr. Ebenstein, and I assume it to be reasonably accurate. Mr. Ebenstein is not able to give this kind of history.

Mr. Ebenstein is poorly oriented. He believes he is in the nursing home when he is in Marian Center. He is unaware, apparently, that he has been staying at a nursing home here in Springfield, stating that he has to get back to Kansas City and look after his houses. He frequently is able to give the date as 1983. He gives the season as the fall of the year. He gives the president as Nixon. He denies that he has any heart trouble or takes any medicine for his heart. He denies that he has had any problems with his memory. He is aware that his wife is no longer living. His impression is that she died probably from heart disease or something else. He is unable to calculate his age even though he is able to say he was born in 1905 and this is 1983.

Psychological testing by Dr. Klingensmith suggests that he has severe memory deficits. I believe that report is included for review at the hearing as well.

In my opinion, Mr. Ebenstein is no longer competent to look after himself or care for his own affairs and that he needs, for his own safety and well-being, to have someone look after him. I see him as an individual who needs the appointment of a guardian.

Sincerely,

Gordon McAfee, M.D.

3. Letter from Rolland L. Comstock, Springfield MO, 13 Feb. 1984.

To the family of Earl Ebenstein:

Please accept the condolences of Carolyn Vienhage and me upon Earl's death. Although I know him for only a short period of time, I can certainly say that there was much to be admired in his spirit and thoughtfulness. I am certain that you have many questions and I will give you some background on Earl's situation. Carolyn Vienhage is the Public Administrator of Green County. This is an elective office which is charged under Missouri law with rendering assistance to mentally or physically disabled persons when there is not family member or other suitable person immediately available to do so.

After the death of his wife, it appears that Earl's health went into rapid decline. He was in the Lester E. Cox Medical Center after the accident and then transferred on November 11, 1982, to Mt. Vernon Park Care Center. His confusion and mental condition became so bad that on or about May 10, 1983, he had to be transferred to the psychiatric unit at St. John's Hospital. At that Point, the Social Worker for the nursing home brought the matter to the attention of the Public Administrator because of the fact that there was no family member readily available to assume responsibility for his care.

A Petition was filed in the Probate Division of the Circuit Court requesting that the Public Administrator be appointed Guardian and the Court ordered the estate opened on May 18, 1983. I am enclosing a medical report dated May 17, 1982, from Dr. McAfee which describes his condition at that time. In due course Earl was transferred back to the nursing home and made a great improvement. As I explained to Mrs. Harry Ebenstein on the phone the other day, Earl got along very well at the nursing home during the daytime. He truly was a "pet" of the social workers. He was content to remain there during the daytime because he believed he was an employee. The only difficulty they had with him came in the evening when he wanted to go home.

Earl became ill and was transferred to Lester E. Cox Medical Center for a few days a couple of weeks ago. His health improved and he went back to the nursing home. Finally he suffered a stroke and did not regain consciousness. I have no reason to believe that he suffered unduly because of the shortness of the time between the stroke and his passing away. There is no doubt that he was very well cared for at the nursing home and Mrs. Vienhage visited him on numerous occasions. The funeral service will be tomorrow at Greenlawn North Funeral Home. He will be buried in Greenlawn Cemetery in the space next to his wife. I do not know whether a grave marker was erected at the time of his wife's death but Mrs. Vienhage will take care of this.

It is necessary that an Administrator be appointed to complete the process of administering Earl's estate. A Petition has been filed in the Probate Division of the Circuit Court requesting that Mrs. Vienhage be continued in this capacity. Missouri law requires that this petition be set for formal hearing some 30 days off. I feel it is important that Earl's affairs be put in order as quickly as possible and I assume that none of you have objection to Mrs. Vienhage continuing.

I have prepared a nomination of Personal Representative which I would appreciate your signing and returning to me. If all of the living brothers and sisters return this form (a notary or witness is not required) we can avoid the delay caused by the necessity to set the matter for formal hearing and the process of finalizing the estate can begin much sooner.

Missouri law provided that any balance left (and I assume it will be a small sum left over after the payment of all debts and expenses) will be divided equally among his brothers and sisters. A copy of Mrs. Vienhage's Application for Letters of Administration is enclosed. Please advise me of any errors or omissions in the listing of the names and addresses of the next of kin.

Mrs. Vienhage and her staff will attend Earl's funeral. I regret that I cannot personally attend because of office appointments. I will obtain a copy of the funeral home's memorial bulletin for each of you.

Rest assure that Mrs. Vienhage and I have done everything possible to make Earl's last months of life as easy and comfortable as could be under all the circumstances. The closing of his estate should be basically routine and we will proceed with this process as quickly as allowable under Missouri law. If you have any questions, please feel free to contact me at any time.

I remain,

Sincerely yours,

Rolland L. Comstock

Event-Misc: __ ___ ____ During a visit to the Mecosta County offices in 1994, one of the clerks found a reference to James in what she called the "Afflicted Children's Index". This index covers the years 1857 - 1949.

When I inquired further about it, she said that they no longer had the records that this index referenced, having destroyed them 'at the order of the State of Michigan".

Also on the index, which was broken into two or three parts, she could tell me that in the "early" section (pre 1900) was an Ed Ebenstein. In the "late" section was James, Clarence, and another Ed (son of August).

Neither James nor myself have been able to locate any additional information on what these records were. I have inquired at the Michigan State Archives, and they did not know about the records. They also could not believe that a county had destroyed any records.
