Subject: August William EBENSTEIN (22)

Birth: 06 Jul 1850 Kleine Neuhausen, Thuringa, Germany.

Misc: between 1851 and 1929 LEGENDS: August came to the US in 1851 with his parents. He went to Michigan in 1882, where he settled in Stanwood, Mecosta Co. A picture of the land he bought is on file. His first wife died due to the birth of their youngest child, which he then gave up for adoption. The story is that he then left the family in the care of the eldest daughter and went in search of work. When he came back, he was married to Lula Tibbits. Lula was felt to be a stereotypical stepmother by the children, and aprox.1888, the couple left the children in Michigan and went to Kansas, where they settled near his parents. What happened to Lula is unknown, but August is buried with his third wife in Kansas. Another story is from Walter and Evelyn Pickering, his brother Joseph's oldest daughter and her husband. Apparently August was supposed to be caring for his mother, and requested money to cover some expenses. 'Together with all and singular, the hereditaments and appurtenances thereunto belonging, or in anywise appertaining:

'To have and to hold the said premises as above described, with the appurtenances, unto the party of the second part, and to his heirs and assigns, forever. And the said parties of the first part, for themselves, their heirs, executors and administrators, do covenant, grant, bargain and agree, to and with the said party of the second part, his heirs and assigns, that at the time of the ensealing and delivery of these presents they are well seized of the above granted premises, in fee simple; that they are free from all incumbrances whatever; and that they will, and their heirs, executors and administrators, shall warrant and defend the same against all lawful claims whatsoever.

Ebenstein in the matter of his mother's pension application. Please note that it directly contradicts some of the family stories, particularly in regard to the date that August left Michigan for Kansas.

`....My age is 51 years, occupation farming. My PO address is Baxter Springs, Cherokee Co, KS. I am son and the oldest child of the claimant Hannah B. Ebenstein and her late husband Chas. F. Ebenstein. My Mother and Father were born and raised and married in Germany and they were never divorced or separated till my father died. When the war of the rebellion broke out we were living in Delaware Co Ind. and my father enlisted in the 69th Ind. Regt in 1862. I remember when my father came home from the army, he had a wound on the side of his head and he also was ruptured. I never saw my father's rupture, till just before he died, and it was then larger than my head and looked as though it was on both sides, but I could not say whether it was.

`Do you know whether in July 1890, the soldier's rupture was on both sides, or only one side and on which side?

`No sir, for at that time, I was living in Michigan. I went to Michigan in 1883, and came back here on Dec. 1st 1898. I never knew whether my father was ruptured on the right or left side when he came home from the army. I never heard him or any one say, whether he was ruptured on both sides at any time. And I can't say how it was in July 1890.

`The soldier died on Dec 26, 1898, he had been sick about 3 weeks. I don't know for sure what was the immediate cause of his death, but he had always complained of his head after the war, and while he was sick the last time, he was partially paralyzed and the doctor said father died from apoplexy caused by the wound in his head.

`My father left no children under 16 years of age. He owned 470 acres of land in three different tracts, he left a will, giving all his property to my Mother during her life time. My Mother has never run the farms herself, but has lived first with me and then with my brother Joe, and she pays for her board and washing. Up to the last year, she has had the land rented partly for a cash rent and partly for a grain rent of 1/3. In 1899 there was about 240 acres rented for cash, for which my Mother got $1.00 an acre. In that year she received and sold some corn, some hay and oats. and something for pasturage and I would think she got from her grain to, that year about $150.00 or $160.00. Her expenses for taxes, insurance, repairs, and a ??? that year, I would say was in the neighborhood of $170.00. In 1900 the land was rented as before, but I don't know just how it stood. But I think the figures you have read me as given by my Mother and brother are correct, for that is about as I would figure it. Last year, 1901, Eli Kane had 190 acres and John ???? had 40 acres & I had but' (NOTE: the deposition ends here - apparently they forgot to put the end on the last sentence)

Turn east on the east/west road at the middle of town. Go east to Front St. Turn north. Front St. changes to 185th Ave. Follow 185th north past an 'S' curve to the top of the hill. There is (1992) a metal fence gate, on the west side of the road, which opens into a large field of new pine trees (3-4 ft tall in 1987). Walk straight west to the creek. The house site was (according to James B. Ebenstein, as related to him as a child by his father) on an outcropping of land forming a bend in the creek. There are some very large pine trees which may or may not have been there originally, as I am not a judge of the age of trees. James B. Ebenstein states that there were remains of the house still visible in the mid-1940s.

Know all men by these Presents, that we Millard K. Fillmore and Alpha Fillmore his wife do hereby declare that a minor child or August William Ebenstein and Hannah Ebenstein of the age of one year on the fourth day of June 1886 is adopted by us as our child and that we intend to make such child so adopted our heir and the heir of each of us and desire that such child shall hereafter bear our family name to wit, the name of Fillmore and we the said William K. Fillmore and Alpha Fillmore do each of us declare that this instrument is executed in good faith and we do hereby request the Judge of Probate for the County of Mecosta and State of Michigan to make and enter in the Journal of said Court an order that said Millard H. Fillmore and Alpha Fillmore his wife do stand in the place of parents to said child and that said child be their heir at law and that the name of such child be changed as aforesaid in accordance with the provisions of the statute in such case made and provided, and I. August William Ebenstein being the Father of said child and surviving parent (the mother being dead) do execute this instrument for the purpose of giving my consent in writing to the adoption and change of name of said child as aforesaid and that said child may become the heir at law of said parties so adapting her.

On reading and filing the declaration, duly acknowledged, of Millard K. Fillmore and Alpha Fillmore, his wife, declaring that said Ella May Eberstein is adopted by them as their child, and that they intend to make such child their heir, and desire that such child hall hereafter bear the name of Ella May Fillmore and be their heir at law. And on reading and filing, also the consent in writing of August William Eberstein, he being the father and sole surviving parent, to the adoption and change of name of said child as aforesaid and it appearing satisfactorily to the Court that such proceedings have been taken in good faith, and that said Millard K. Fillmore and Alpha Fillmore his wife are suitable persons to have the charge of said child.

It is therefore Ordered, Adjudged and Decreed, that said Millard K. Fillmore and Alpha Fillmore do stand in the place of parents of said minor and that the name of said minor be changed from Ella May Eberstein to Ella May Fillmore and that said Ella May Fillmore be and become the heir at law of said Millard K. Fillmore and Alpha Fillmore his wife with all the rights, privileges and duties appertaining thereto, as provided by law.
