Deed: Merydith to Potts

This indenture made this seventh day of April in the year of our Lord one thousand seven hundred and eighty six by and between Job Merydith Senior of Kent County on Delaware cordwainer and Lydia his wife, Davis Merydith and Amelia his wife, Peter Merydith and Elizabeth his wife and Job Meredith Junior sons and daughters in law of the said Job Merydith Senr. and John Keys and Rachel his wife daughter and son in law to the said Job Merydith Senr. of the one part and John Potts of the same place Taylor of the other part; Witnesseth that the said Job Merydith and Lydia his wife, Davis Merydith and Amelia his wife, Peter Merydith and Elizabeth his wife, Job Merydith Junr. And John Keys and Rachel his wife for and in consideration of the sum of one hundred and fifty pounds common current money to them in hand paid by the said John Potts before the sealing and delivery of these presents the receipt whereof they and each of them do hereby acknowledge and thereof doth acquit and discharge the said John Potts his heirs and assigns forever by these [present] Doth give grant bargain sell [alien] [ ____ ] convey and confirm and by there [presents] hath given granted bargained and sold aligned enf[ __ ] conveyed and confirmed unto the said John Potts his heirs and assigns forever two third parts of a tract or parcel of land lying and being in the county afsd. And in the forrest of Murderkill hundred called and known by the name of Maidens Lott surveyed for a certain John Davis by a warrant bearing date the 22nd day of June 1747 one third part thereof being conveyed to the afsd. Job Merydith Senr. by a certain Michael Greenly and Esther his wife by deed bearing date the 20th of November 1761 and recorded in the rolls office in Dover in book Q folio 74 as will more fully appear [refference] being thereunto had the other third part [this] Job Merydith became possessed of by intermarrying with a certain Rebecca Davis one of the Representatives of the afsd. John Davis. the whole of which two third parts contains by estimation one hundred and twenty six acres and two thirds of one acre be the same more or less and also all the estate right title in trust property claim and in and whatsoever of them the said Job Merydith and Lydia his wife, Davis Merydith and Amelia his wife, Peter Merydith and Elizabeth his wife, Job Merydith Junr, and John Keys and Rachel his wife of in and unto every part and parcel of the afsd. two third parts of the afsd. tract or parcel of land with this and each of their [appurtenances] together with all houses orchards trees fences and other improvements and [appurtenances] thereunto belonging to have and to hold the afsd. part of tract or parcel of land and premises hereby bargained and sold to the said John Potts his heirs and assigns forever to his and their proper uses forever and the afsd. Job Merydith Senr. and Lydia his wife, Davis Merydith and Amelia his wife, Peter Merydith and Elizabeth his wife, Job Merydith junr., and John Keys and Rachel his wife doth for themselves their heirs executors and administrators hereby covinant grant and agree to and with the said John Potts his heirs and assigns by there presents that he the said John Potts his heirs and assigns shall and may from time to time and at all times forever hereafter quietly and peaceably have hold use occupy possess and enjoy the afsd. two third parts of the afsd. Tract or parcel of land and premises and every part thereof with their and each of their [ ________] without the [ ___ ] or hindrance of them the said Job Merydith Senr. and Lydia his wife, Davis Merydith and Amelia his wife, Peter Merydith and Elizabeth his wife, Job Merydith Junr. and John Keys and Rachel his wife their heirs executors and administrators or assigns or any other person or persons claiming by from or under them or any of them and the afsd. Job Merydith Senr. and Lydia his wife, Davis Merydith and Amelia his wife, Peter Meredith and Elizabeth his wife, Job Merydith Junr. and John Keys and Rachel his wife do hereby nominate constitute and appoint Missr. Thomas White and Richard Bassell esquires of the county afsd. Or either of them to be their lawful attorney to appear for them the said Job Merydith Senr. and Lydia his wife, Davis Merydith and Amelia his wife, Peter Merydith and Elizabeth his wife, Job Merydith Junr. and John Keys and Rachel his wife in open court of common pleas to [be] [holden] for the county afsd. At any time when said court shall be setting & then an & there acknowledge this deed with the [ ____ ] [ ______ ] therein mentioned to be the right and estate of him the said John Potts his heirs and assigns forever according to the true intent and meaning thereof which acknowledgment shall be valid in law. In witness whereof the sd. Job Merydith Senr. and Lydia his wife, Davis Merydith and Amelia his wife, Peter Merydith and Elizabeth his wife, Job Merydith Junr. and John Keys and Rachel his wife have hereunto set their hands and affixed their seals the day & year above written.

Be it remembered that on the seventh day of April, 1786 personally appeared before me the subscriber one of the Judges of the Court of Common Pleas for the County of Kent on Delaware the within named Lydia Merydith wife of the within named Job Merydith Senr. and Amelia Merydith wife of the within mentioned Davis Merydith, Elizabeth Merydith wife of the witin mentioned Peter Merydith and Rachel Keys wife of the within mentioned John Keys and they the said Lydia Merydith, Amelia Merydith, Elizabeth Merydith and Rachel Keys being by me properly examined out of the hearing of their said husbands declared they became parties to this deed of their own free will and accord without being induced thereto through fear or threats or for fear of [ _______ ] their said husbands displeasure.

Be it remembered that Thomas White esquire one of the subscribing witnesses to the within deed came unto the Court of Common Pleas held at Dover in and for the County afsd. the twelfth day of May in the year of our Lord one thousand seven hundred & eight six and then and there made oath that he saw Job Merydith, Lydia Merydith, Davis Merydith, Amelia Merydith, Peter Merydith, Elizabeth Merydith, Job Merydith, John Keys and Rachel Keys parties to the within deed sign seal and deliver the said deed and power of attorney for the uses and purposed therein specified and that he subscribed his name thereto as a witness and at the same time saw John McGifford subscribe his name as one other witness to the same. Whereupon came Richard Bassett esquire unto the same court virtue of the power and authority unto him given then and there did acknowledge the said deed unto John Potts with the lands and premises therein mentioned to be his right and property according to the purpose and effect thereof. In testimony where of I have hereunto put my hand and caused the public seal of Kent County afsd. to be hereunto affixed.
