PROBATE: Carroll County, Ohio Wills & Probate Records, Bk. C., 1847-1853, pp. 25-28, FHL #333253. Estate of David Davis; at a court of Common Pleas held at the Court House in Carrollton, within and for the County of Carroll & state of Ohio, on Monday the 16 day of August A.D. one thousand eight hundred and forty seven . . . The last will and testament of David Davis deceased was brought into court and the two subscribing witnesses ? William Davis and Joseph Thorley came before the Court and being duly sworn . . . that the said will was signed by the testator . . . Thereupon the Court orders that letters testimentary issue thereon unto William Davis esq. and James Wilkins esq. the executors named in the will. And that they give Bond conditioned according to law in the sum of one thousand dollars with Robert Barnhill and Isaac Booth, their securities . . . Court appoints John Thorley, James Davis sr & Phillip Crab to appraise the personal and Real Estate of the deceased . . .
In the name of the Benevolent Father of all I David Davis of Carroll County, Ohio do make and publish this my last will and testament. . . . two I give and devise to my granddaughter Elysaann ? Davis twenty four dollars. 3. I give and devise to my grand Son James Davis twenty five Dollars together with my ? and all my clothing. 4th, I give and devise to my grand Son William Spice my gun and 5th I give and devise to my grand daughters son David Thompson my natch. 6th, I give and devise to my daughter Jane Day ten dollars to be sent to her by my Executors in a letter. 7th it is my will that my executor retain in their hands and apply in purchasing a tomb stone to be placed at my grave. 8 I give and devise to my daughter Mary Spice and my grand daughter Susan Thompson the one half of whatever ? remains after the above together is satisfied to be ? share and share alike between them. 9 I give and devise to my grand children William Davis, David Davis, Elyiann Davis, Abraham Davis the ? half of what may remain to be divided ? share and share alike. 10th I do hereby nominate and appoint James Wilkin and William Davis Esq. Executors of this my last will and Testament . . . I do hereby revoke all former Wills . . . In testimony whereof I have hereunto set my hand and seal this 22 day of June in the year 1847: David Davis (seal)

NOTE: At the time the following final account was presented at Court, only one of the two executors survived. It is probable that the William Davis appointed executor by the decedent was the son of William Davis, brother of David Davis. This William Davis, Jr., died at Carroll County, Ohio, 9 May 1850.

4. Amount received from notes & wheat sale; $125.59
        Total: 554.04

Oct. 5, 1849, paid Joseph Thorley as part of legacy to Eliza A Davis, $17.00. Oct. 21, 1848, paid Rosanna Thompson as a part of legacy, $62.00. Oct. 13, 1847, paid John Spice, $20.30. Sep. 2, 1848, paid John Thompson for hauling wheat to canal, $2.04. Oct. 4, 1849, paid William Davis as part of legacy $20.00. Oct. 21,1848, paid Mary Spice as a part of Legacy, $62.00. Feb. 9, 1849, paid William Brown for crying sale of land, $1.00. Oct. 4,1849, paid Rosanna Thompson as a part of her legacy, $21.37. Oct. 16, 1848, paid John Wallas for school tax, .25.
