There is no proof that Richard and Thomas are brothers, but they had transactions with the same families and both resided in Westmoreland Co., VA, before Thomas moved to Talbot Co., MD.

Henry Hawkins, will of 1673 Talbot Co who mentions Sarah and William Smith. [His father was likely Henry Hawkins who d. by 1642/3 who married Alice Crouch or Alice Crough who d c 1649.] Separately, 1666 immigration records indicate Henry, wife Eleanor, son John. Henry Jr. likely had a brother, Samuel.

Richard Mentor Johnson, 9th Vice President of the United States, descends from this line.

" ... 1607, with the arrival of three ships from England, that the Europeans established a permanent settlement in the New World at Jamestown, Virginia. Captain John Smith, who arrived with the first group, began an extensive exploration of the Bay. In 1608 he sailed north, exploring the area near Poplar Island and what is now Talbot County. In his second edition map of the colony in 1626, he named the area "Brooke's Forest."

"In 1627, the Governor of Virginia authorized William Claiborne to explore and locate the source of the Chesapeake Bay. During the expedition, Claiborne selected an island (present day Kent Island) to establish a trading post and the first permanent English settlement in Maryland. He named nearby Popeley's Island (Poplar Island), making it one of the first areas of Talbot County to be named by its settlers.

"The first settlement on Poplar Island occurred in the 1630s when Richard Thompson was granted the entire island. Thompson farmed the land and operated a trading post until 1637 when, upon returning from a trading expedition, he arrived to find the settlers murdered. At Thompson's death, Thomas Hawkins inherited the island and records indicate that he lived there in 1654 when the island was larger than 1,000 acres."

Notes for Elizabeth <Unknown>:

Elizabeth married 1st Thomas Hawkins and 2nd Seth Foster. Some suggest that she was also a Hawkins by birth.

Her surname is unknown, possibly Thompson. Richard Thompson was an earlier owner of Poplar island and a cousin of Col. William Claiborne, also a previous owner of Poplar Island. Some indicate that he bequeathed or gave property to Hawkins, while other records showed his land was forfeited and sold and that Thomas Hawkins purchased it from a later owner. Could she be a sister or niece? Obviously not his daughter, as that part of his family is well documented.

GREAT CHOPTANK ISLAND OR TILGHMAN'S ISLAND

Seth Foster was the original patentee of Great Choptank Island. It was surveyed for him August 11, 1659, two years prior to the organization of Talbot County, for 1200 acres and 300 acres more, doubtless of said island, were surveyed for him January 15, 1661. In 1755 it was assessed to Matthew Tilghman for 1468 acres on the Rent Rolls of Lord Baltimore.

Seth Foster married Elizabeth, the widow of Thomas Hawkins, who died 1660. In his will, probated March 12, 1674, the said Foster devises one-third of his estate, both real and personal to his widow Elizabeth; to his son-in-law (step-son), John Hawkins 1000 acres, "Tull's Delight, on Chester river:" To eldest daughter, Elizabeth Lowe, wife of Vincent Lowe, "Great Choptank Island;" to youngest daughter, Sarah (who later married Michael Turbutt), 1000 acres, "Stagdish Woods," on Chester river; to two daughters, aforesaid.

Colonel Vincent Lowe, dying in 1692, in his will, probated October 20 of that year, devised to his wife, Elizabeth, Great Chopiank Island and all pertwning thereto, which was left said wife by her father Seth Foster, as his oldest daughter, requesting her, if she die without heirs, to devise said Island to Foster Turbutt and heirs, he being the son of her sister Sarah, wife of Michael Turbutt. To Mary, daughter of Michael Turbutt, 1000 acres, "Four Square" farm, — residue of estate to be sold by executors. To brother Nicholas, land in Parish of Denby, England, left testator by his mother Ann Lowe; she was the natural daughter of Henry William Cavendish, and the wife of Vincent Lowe, Sr, of Denby, England. Their daughter, Lady Jane Lowe, married for her second husband Gov. Charles Calvert, who later became the third Lord Baltimore. She died in England January 24, 1701. Her first husband was Henry Sewell of Mattapony, secretary of the province of Maryland. Col. Vincent Lowe, Jr., her brother, was High Sheriff of Talbot County in 1675, and was appointed Surveyor General of the Province in 1679. He was one of the largest landed proprietors in Talbot County, and posmbly in the State.

The widow of Col. Vincent Lowe married, for her second husband, William Coursey, another prominent citizen of Talbot County, who together with his wife, mortgaged Choptank Island to Capt. John Hyde, merchant, of London, who sold it to Matthew Tilghman Ward.

Notes for Richard Hawkins:

Richard Hawkins may be closely related to Thomas Hawkins of Kent, England who emigrated to (what became) Rappahannock Co., VA, but no documents have linked them as close kin.

In Westmoreland County (adjacent Old Rappahannock) there was a Richard Hawkins aged 28 years in deposition regarding Mr. Foster and Edward Thompson, 1655 (page 58).

Richard Hawkins transported himself and Katherine Willoughby into Northumberland County in 1650. There is a record showing Richard and Katherine Hawkins in 1658. Did he marry Katherine Willoughby?

Richard Hawkins seems to have disappeared after 1658, however, Katherine Hawkins appears as a witness in 1659 and may well have married Edward Thompson by 1660.

John may not have been born at the time his father wrote his will, but he is mentioned as 'brother' in the will of Thomas Hawkins, Jr.

Colonial Dames lists John s/o Thomas as Colonel John Hawkins (1655-1717), pg 667. Colonel John was a distinguished gentelman "prominent in public affairs" and left a sizable paper trail.

Colonel John Hawkins (1655-1717) of Queen Ann County, acquired extensive landed estates and was prominent in public affairs. In 1694 he was a County Commissioner for Talbot County, Justice of the Provincial Court of Maryland, 1698, and represented Queen Anne County in the Assembly, 1714 to 1717.

A communion service of silver, presented by him to St. Paul's Church, Centreville, is still used in that church. The tankard bears the inscription: "The Gift of Colonel John Hawkins, 1717," while on the chalice is inscribed: "The Gift of Collonell John Hawkins of Chester River in Maryland 1716." Ernault Hawkins, the son of Colonel John, completed the service by the gift of a patten on which is inscribed: "The Gift of Ernault Hawkins".

25 Mar 1696 : Daniel Field and Tobias Butler received most of the estate of Humphrey Pope as payment for debt from Patrick Muckleroy, which they then sold. Muckleroy came into possession by marrying the relict (widow) of Humphrey Pope. William Paine, husband of the daughter of Humphrey Pope, petitioned the court on behalf of his wife and her siblings for compensation from the estate of their father. Field and Butler presented evidence to the court of their claim against the estate of Humphrey. The court turned over the documents to William Paine who then decided on behalf of the children of Humphrey Pope to accept 70 pounds of tobacco from Field and Butler.

Notes for Col. Humphrey Pope I:

By his own deposition, dated 19 Nov 1673, he was "age 24 or thereabouts". All of his children were minors when he died; All 3 sons chose their brother-in-law as their guardian on 27 Feb 1696. (Humphrey JR came of age later that year). LAWRENCE was under guardianship until 1700. MARY POPE was still under guardianship in 1701/2. Therefore: all the children were born AFTER 1670.

Humphrey Pope appears are surety on a bond of John Quisenberry in Rappahannock (now Richmond) county, dated May 12, 1683. The correct date that HUMPHREY POPE received 150 acres in Westmoreland Co by deed from Thomas POPE was 2 Feb 1669.

Who was the Humphrey Pope of the following two records? (it cannot be this man, who was dead by 1684)/ This info was submitted to Rootsweb several years ago and the submitter's name was not obvious to me:

8 July 1685- Humphrey Pope was one of several hundred men convicted before Chief Justice Jefferies at the Court of Oyer and Terminer for Dorset, Somerset and Devon for waging war against the King and sentenced to be transported to the Americas (sentence enrolled on 4 February 1691). Also on the list was a John Pope.

24 October 1685 - Humphrey Pope of Taunton was among those on a list of rebels convicted after Monmouth's rebellion and transported from Bristol to Barbados by the frigate "John", Mr. William Stokes.

"Nathaniel POPE was a wealthy planter who came to Westmoreland Co. about 1650 from Maryland; his daughter Anne married John Washington, great-grandfather of President George Washington. Nathaniel's son Thomas and John Washington were jointly awarded 1200 acres of land for transporting 24 persons from England to Virginia on 4 September 1661; one of those persons was Humphrey Pope. (See Nell Nugent "Cavaliers and Pioneers", Vol.1, p.449.) Humphrey was not named as an heir of Nathaniel POPE in his will (dated 1659 and proved 20 April 1660) and was almost certainly not a son of Nathaniel, although that relationship has mistakenly been circulated ... . On 2 February 1669/70 Humphrey acquired 150 acres of land from Thomas Pope, a part of his 2,450 acre patent. He resided as a neighbor of Thomas Pope but the relationship is not defined in any of the records I have seen. Humphrey's widow Elizabeth and Lawrence Washington, George's grandfather, were executors of Humphrey's will; William Bridges and John Washington provided security, which further confirms the close association among the families."

Many sources identify her birthdate as 16 Jun 1666, but that is unlikely.

Notes for Daniel McCarty:

William Carr of Westmoreland County, Virginia in his will dated 13 Jan. 1702-3 mentions his grandsons (so Crozier but probably intended for godsons) Daniel McCarty and George Eskridge.

By 19 April 1710 he had become Sheriff of Westmoreland County, and Speaker at the Grand Assembly in 1715. He made a will in Westmoreland County in 1724, and named his aunt as Barbara Tayloe, and his uncle as Joseph Tayloe. The name Billington was an honored one in this branch of the McCarty family being repeated in three successive generations; to wit, will of Billington McCarty 1753, and the will of Billington McCarty, 1771.

Sophia married 2nd John Morrison. Sophia, along with her younger children left Cumberland County about 1762 or 1763 and settled in Craven County South Carolina, later Fairfield District. Sophia was alive in 1792 when she gave slaves to her daughter. Sophia's son Thomas Muse administered the estate of John Morrison in Faifield District in 1797.

C." by Rassie E Wicker published in 1971, pp. 323-324: "MUSE--James Muse, Sr. came down from Virginia and settled on the south side of Deep River, above the mouth of McLendon's Creek in 1755, upon a tract of land purchased of James Barton. He died here, his will being dated 30 March, 1758. He lists James, Thomas and Daniel as his sons. James (Jr.) and perhaps all his brothers came down on McLendon's Creek in the vicinity of Carthage. James, the most active of these, immediately began the entry of many tracts of land on McLendon's Creek, Killet's Creek and that general area, and purchased others. In February, 1776, he joined the "McDonald" Army, and was captured at Moore's Creek. He eluded his captors somewhere on their trek to Philadelphia, and returned home. He evidently took the oath, as he remained in the county afterwards. His wife, Charity, believed by the writer to be Charity Dickerson (this is an error, as James Muse married Charity Brazille or Braswell), the daughter of Robert Dickerson, who was a near neighbor of the elder James Muse's family on Deep River, was awarded by the Moore Court, the Cross Hill house and lands which James, Jr had sold to Dr. Alexander Morrison, and which was confiscated on account of Morrison's part in McDonald's Army. It is the writer's opinion that she made this place her home during her latter days. Jesse Muse, son of James, Jr, married a daughter of George Glasscock, and seems to be the ancestor of the Carthage branch of the family. The exact location of James Jr's home has long eluded a long search by the writer. It was probably at or near the present crossing of NC Rt. 27 of McLendon's and Killet's Creeks."

I James Muse of the County of Cumberland and province of North Carolina, planter in perfect health of body and memory thanks to God, calling unto Mind the mortality of my body and knowing that it is appointed for all men once to die, do make and ordain this my lastwill and testament. That is to say principally and first of all I give and recommend my soul to God that gave it and my body I recommend to earth to be buried in decent Christian burial at the discretion of myexecutors, Nothing doubting but at the general resurrection I shall receive the same by the mighty power of God. And as Touching suchthings as Worldly estate therewith it has pleased God to bless me within this life I give and devise and dispose of in the following mannerand form.

Thomas Marsh Forman joined Smallwood's regiment in the Revolution as a cadet, shortly before the battle of Long Island, New York; the next winter was commissioned lieutenant in the llth Pennsylvania regiment; then becoming captain in his uncle David Forman's continental regiment; and in 1779 succeeded James Monroe as staff officer to Maj. Gen. Lord Sterling. He served in the legislature in 1790, 1792, and 1800, and during the bombardment of Fort McHenry, War of 1812, commanded a brigade of militia. In his will, he bequeathed his estate to his grandson, Thomas Marsh Forman Bryan, son of Joseph Bryan and Delia (Forman) Bryan, provided he changed his name to Thomas Marsh Forman, which was done by the legislature of Maryland.

Charity's father left her a slave. However, her brother as executor sold her share of the estate. She filed suit in feme court, but had little right. Later, when married, she filed suit again with her husband James Burkhead. Deopistion was taken from NC,

TN and MS. In order to prove her right, Charity provided a Bible record carrying her family back to 1719.

In 1826, JAMES BURKHEAD & wife CHARITY filed a Bill of Complaint in Davidson Co NC against the heirs of one JOSEPH COLSON. The lawsuit dragged on until 1838, ending up in the NC Supreme Court. Charity claimed that her mother Charity SR & her brother Jesse, who were Exctrs of her father's estate, illegally sold Charity JR's slave Rachel, bequeathed to her in her father's will, to JOSEPH COLSON SR. Then on 6 Dec 1790, Joseph Colson SR, "by artful contrivance" obtained her signature on an actual Bill of Sale ; that she was still a minor & didn't realize wht she was signing. The Burkheads wanted the court to declare the sale invalid, & return to her all the descendants of Rachel (18 of them) that were then in possession of Joseph Colson's heirs.

Testimony in the suit proves the following:

1. Charity Muse stated she was born 24 Nov 1770; this was backed up by the Family Record of her father JAMES MUSE JR, which was presented in evidence & copied into the court record. Thomas Muse stated that the handwriting was that of his father James JR.

2. Charity stated that she married JAMES BURKHEAD 13 Jul 1790 at age 20, and witness SAMUEL DUNN exhibited the original marriage certificate of JAMES BURKHEAD to CHARITY MUSE, dated 13 July 1790. Marriage was performed by WILLIAM DUNN, J.P. .

3. Witness SAMUEL DUNN stated that his daughter RHODA married GREEN BURKHEAD, son of Charity & James.

4. Witness SAMUEL DUNN stated he married the sister of CHARITY MUSE BURKHEAD, but didn't give his wife's name. He stated that a slave bequeathed to his wife had not been sold to pay the estate'sdebts. (His wife seems to have to be MARTHA or MARY, the only two daughters of James Muse for whom there is no known marriage info). Cornelius Dowd, Sheriff of Moore Co, stated that in 1790 he sold at public auction "a negro wench named LUCY & her child." Lucy was the slave that James JR bequeathed to his daughter MARTHA. Therefore: Samuel Dunn likely married MARY MUSE, who was bequeathed a slave named Venis.

5. Witness JAMES DOWD stated that "the Executrix (Charity SR) of JAMES MUSE dec'd died 2 or 3 years before the Executor " (Jesse). We know Jesse F. Muse SR died in 1820, so this places Charity SR's death at about 1817-18.

6. Charity's brother THOMAS MUSE stated that the last time he saw the leaf of paper containing James Muse's Famioy Record, it was in the possession of ELEAZER BURKHEAD. (This is strong circumstantial evidence that Elizabeth Muse was Eleazer Burkhead's wife.)

6. In 1827 testomony was taken from Charity's neice Elizabeth (MUSE) Phillips, wife of Brinkley Phillips, from her nephew, JAMES B. MUSE & his wife, ELIZABETH (GLASSCOCK) MUSE, all living in Moore Co. They all stated that Charity was given land & livestock as compensation for the slave Rachel. ELIZABETH MUSE PHILLIPS stated in her testimony that her father was JESSE MUSE.

7. Witnesses for both plaintiffs & defendants stated that James JR's estate was deep in debt when he died, and that's why his Executors arranged to sell Charity's slave. THOMAS MUSE stated that his sister Charity was aware of the 1784 sale, & that she was given 300 acres on Killet's Creek, a mare & a colt, as compensation for the slave. (Charity conveniently failed to mention that she'd received any compensation in her Complaint) The 300 acres on Killet's creek was originally granted to James JR on 24 May 1773.

8. Charity's brother in law, SAMUEL DUNN, stated that JOSEPH COLSON SR married Charity's aunt. Joseph Colson SR was born ca 1730. In his 1788 will, Joseph Colson's wife was named MARY. If MARY was Colson's only wife, that seems to rule out a paternal aunt, since James Muse SR didn't have a daughter named MARY. (However, Mary could have been a second wife). Therefore -- this aunt was likely Charity's MATERNAL aunt, a sister of James JR's wife CHARITY. (So if we could discover the maiden name of Joseph Colson's wife MARY, we'd be able to prove the maiden name of James JR's wife CHARITY. There is no proof that Charity's maiden name was COLSON or COLSTON, but it's evident that the Muses & the Colsons were well-acquainted with each other in Moore Co., NC. Joseph Colson could have married a Kindred or a Braswell).

9. Witness Cornelius Dowd, former Sheriff of Moore Co, deposed that when he was Sheriff in 1787, 88 or 89, a writ of Execution came to his office against James Muse JR's estate "for most of his property including a slave he had willed to one of his daughters who married JAMES HOLCOMB" (This was Lydia Muse)

Notes for James Meyer Burkhead:

1822 - Commissioned as Justice of Peace with power to organize Davidson Co, NC. His wife was from that part of Cumberland Co., NC that is now Moore County.

The marriage of James Burkhead to Charity Muse is not proven but is based on tradition in both families. Circumstances suggest that the Burkhead brothers, James and Eleazer III probably lived as young men in Cumberland (now Moore) County, North Carolina in the late eighteenth century and married there. However, confirmation is impossible because all of the public records of Moore County were burned in a court-house fire in 1889. There is a long-held tradition that Charity and her sister Elizabeth Muse married the Burkhead brothers, which is presented here as a reasonable assumption of fact (supported later by the letter from her grandson, identifying her as "Charity.")

James "Burket" apparently returned with his bride to Rowan (now Davidson) County and appears in the 1790 census adjacent to his father Eleazer on Beaverdam Creek. The couple is listed with no children, having been only recently married. In the 1794 tax lists, James is assessed one white poll only and no land. Two years later, he is shown as owning 150 acres, although no record of the acquisition of this property has been located. In the 1800 census, "James Birched and Lazarus Birched" are recorded in Moore County suggesting that James and his brother Eleazer Burkhead III were again living in Moore County. Their wives' Muse family residence in Moore County makes that a logical arrangement and helps support the tradition of their marriages. By 1820, James and his family were back in Rowan (now Davidson) County near his father Eleazer on Beaverdam Creek. His brothers Levan and Eleazer III apparently remained in Moore County. They are mentioned in Robinson's history in a discussion of churches of the county:

"About 1820 there was also built a log meeting-house more than a mile west of Carthage, on the north side of the Troy Road. It was called the Burkhead Meeting-house, in honor of Leven Burkhead, who 'was then the leader of the Methodists in this community.' Among the members were Burkhead, Eleazer Burkhead, ... and James B. Muse ..."

On 14 August 1826, James Burkhead sold 87 1/2 acres on Beaverdam Creek to Jedithan Cook for $125. James was then assessed taxes on 287 acres each year from 1827 to 1841 when his holding was reduced to 237 acres and his son WIlliam A. Burkhead was assessed on 50 acres for the first time. On 24 January 1846, James sold 227 acres of the Beaverdam property to his eldest son Green M. Burkhead, who was then of Stanly County, North Carolina. James lived most of his life in Davidson County, but, according to his obituary in the Raliegh Register, he died in 1859 at the home of his son, Jesse D. Burkhead in Mooresville, Iredell County at the rather remarkable age of 93. A grandson's biography indicates he may have married 2nd a Margaret.

For the 1800 census, however, James Burkhead was found near his wife's family's home in Moore Co., NC (near Cumberland Co., NC), so she easily could have been born there.

His likely father, Allin Davis, had an part of his estate appraised in 1832 by Levi Davis, William Stripling and Elihu Richardson. Levi Davis named a child William Stripling Davis.

At the time of his marriage to Martha Burkhead, she was likely a resident of Rowan Co., NC in that area that became Davidson Co., NC in the 1820's.

The name of Richmond Terrell, common in Virginia in the 1600's and 1700's, must be a clue to Levi's ancestry; the name does not appear in his wife's ancestry.

Levi's home in Mississippi was in that area of Yalobusha County, MS that became Grenada County, which was formed in 1870. His home seems to have been located on land purchased in (later Gore Springs, MS) as early as 13 August 1837. The land was described as 31/2 Sec 20, T22, R7 East. It was sold to John Culpepper James after Levi Davis' death in 1849. The land was transferred on the second Monday in November, 1849.

Descendants resided in Calhoun County (established 1856) and Sabougla (PO established 17 Sep 1873). This village was first called Davistown, and the Terrell Davis home was perhaps the oldest house in the neighborhood.

He was from Union Co., SC, where other Davis family members from Calhoun / Webster with similar family names came from. Levi and Martha moved to Yalobusha Co. (now Calhoun) in 1835.

Census records for at least one child indicated that Levi may have resided briefly in Kentucky. A series of deeds for Trigg Co., KY names Levi Davis, Miles Davis, John B. Davis, father John Davis, and Jefferson Davis in the 1810-1830 time frame, before Yalobusha Co. was opened up. That Levi Davis patented land in Trigg Co., KY between 8 Aug 1820 and 15 Jun 1821, and he was dead by 1849.

Edward Turner was appointed as Aide-de-Camp and private secretary for Governor W. C. C. Claiborne of the Mississippi Territory and served as Clerk of the House of Representatives soon after his arrival [Goodspeed, Rowland]. In 1802 Turner was involved with local republicans in an attempt to move the territorial capitol from Washington to Greenville. On August 17, 1802, he was appointed Clerk of the County Court in Jefferson County by Governor Claiborne, succeeding John Girault.

Part IV

Turner as an Early Member of Bench and Bar

In 1805, the Territorial Assembly established a Mayor's Court in Natchez, giving it power to resolve civil cases with disputes up to $500. Turner was City Magistrate in this court and was later to write of it saying it was "...too summary for debtors-hence the outcry" [James].

Edward Turner also practiced law in Natchez. In 1807, he notified the public that he would be absent from his practice for a while and that his brother, Fielding L. Turner would attend to his business in the several courts of the Mississippi Territory. This notice was published in the Mississippi Register on May 22, 1807 [Rowland]. He soon removed to Greenville in Jefferson County and continued the practice of law. The death of Turner s infant daughter, Martha Ann Turner, on June 15, 1809, was reported in the Weekly Chronicle, of Greenville [Rowland].

Moving further north to his plantation in Warren County, in 1810, he was elected to the Territorial Assembly in 1811 and elected as Major of the Militia [Rowland]. In March of 1811, Territorial Governor David Holmes authorized Edward Turner to administer the Oath of Office to a Constable in Adams County [Carter]. On that same day, the Governor issued the following additional appointment [Carter];

Turner, Esq. is hereby authorized and impowered to administer all oaths of office required by law to the several officers whom I have or may appoint in the County of Warren and Territory aforesaid. The economy of the new territory took its ups and downs. Many of the residents purchased their land in the Mississippi Territory with borrowed money as they had no prior claim to the land based on Spanish or British grants. In September of 1811, Turner was one of 54 inhabitants of the Mississippi Territory asking for relief on installment payments due on their lands. The petition was sent to Congress and referred from Congress on November 11, 1811. An Act approving an extension was passed on December 12, 1811, extending the due date of payments until January 1, 1813 [Carter].

Edward Turner's first wife died in February of 1811 and he remarried Eliza B. Bakerin December of 1812. His second wife was a native of New Jersey [Goodspeed]. Turner and his wife were members of the Episcopal Church [Goodspeed]. In 1813, Turner announced in the Washington Republican that he will be practicing law in the courts of the counties of Wilkinson, Adams, Jefferson, Warren and Claiborne and that he will also be taking over his brother’s practice [Rowland]. This gives us a feeling for the traveling that early lawyers did in their profession. The brother he was referring to was Fielding, who was moving to Louisiana. Edward Turner returned to Natchez in 1813 and he continued the practice of law and was elected a City Magistrate and President of the Board of Selectmen. He was elected in 1815 to the last General Assembly of the Territory, sitting in 1815-1816. He won one of six posts with 396 votes from Natchez, 22 from Adams County, for a total of 418 votes [James]. In December of 1815 he was elected by the two houses to Digest the Statutes of the Mississippi Territory. This work, entitled Statutes of the Mississippi Territory, was the second publication of its kind in the Territory. It was a first printed in Natchez in 1816 by Peter Isler, the Printer to the Territory. This work has been termed the most complete, well arranged and satisfactory compilation of the United States laws applying to the Territory and the acts of the general assembly [Rowland].

Turner was President of the local Republican Party in Natchez from 1815-1819. He owned three slaves and twelve acres of land at the time [James]. On December 15, 1812, Turner was one of the signers of a Memorial to Congress asking that statehood for Mississippi not be approved until the population reached 60,000 free persons [Carter]. Four years later, Turner was one of the signers of a Memorial to the U. S. Congress asking for Mississippi statehood in 1816 [Carter]. This petition was then referred to the Committee of the Whole House on the Bill for Admission of the Western Part of the Mississippi Territory into the Union on December 30, 1816 [Carter]. Turner was then elected to the Mississippi Constitutional Convention of 1817, representing Adams County [Rowland]. He was on the committee that framed the first constitution of the State. Equally important was his work as a representative of Adams County in the first legislature (1817-1818), in which he chaired the Judiciary Committee and established the judicial system under the new constitution. In that election, he ran against nine other candidates, receiving 210 votes from Natchez and 54 votes from Adams County for a total of 255 votes [James].

In 1817, President Madison signed the law authorizing the Mississippi Territory to be split along its present lines and for a constitution to be written for the western portion. Turner was one of 47 delegates from the 14 Mississippi counties that met in the Methodist Church in Washington [James]. Also in that year, Turner was one of five supervisors appointed to oversee the State Lottery recently approved by the Mississippi Legislature. His name appears in the solicitation for the lottery posted in the Mississippi Republican [Mississippi Republican].

In 1818, Edward Turner appears as Worshipful Master at a meeting in Natchez for the purpose of establishing the Grand Lodge in the State of Mississippi. He served as Worshipful Master to 1820, then Past Master to 1822, then Demitted (discontinued membership in good standing) from 1823-1829. He belonged to the Andrew Jackson Lodge No. 2 chartered on August 13, 1816 [Henry].

In 1819, the Natchez Water Company was incorporated for the purpose of introducing water into the city by means of leaden or wooden pipes. The company was capitalized at $200,000 and could sell stock at $100 per share. Edward Turner was a charter official of the company and was President of the Corporation [James].

He continued as a member of the legislature until 1822, being twice elected as Speaker. In 1820-1821, he was appointed as State Attorney General under Governor Poindexter [Lynch, Rowland]. In 1823, he was appointed judge of the Criminal Court in Adams County; in 1824, he was appointed judge of the Supreme Court becoming presiding judge in 1829 [Lynch, Rowland]. He held this position until 1832 when judges became elected officers under the revised State Constitution. Turner took in a partner in his law practice, Duncan Walker, of Pennsylvania, who joined him in 1826 in Natchez [James]. During the period of 1818-1830, Turner was affiliated with what was called the Natchez Junto, the nearest thing to a political machine in Mississippi during this period [James].

By 1831, Turner had a plantation and slaves as records show that Turner purchased a slave named Bill from John B. Nevitt on May 2, 1831 for $600. As of February 5, 1831, Turned owned Bill s wife. Recognizing that the slave s family was split until Turner could purchase them both, Nevitt allowed Bill to visit Turner s plantation to visit his wife [James].

Edward Turner was Chancellor of the State from 1834-1839 [Lynch] and in 1839, he was a Whig candidate for governor [Rowland]. He received about 16,000 votes but was defeated by A. G. McNutt. In 1840, he was elected to the High Court of Errors and Appeals [Lynch] upon the death of Justice Pray, and in 1844 at the age of sixty-six, was elected to the State Senate by Jefferson and Franklin counties [Rowland]. At the end of his term on the bench in 1843, the Mississippi Bar, in attendance on the High Court resolved [Lynch]:
